Les Fumées

1. Overview

Welcome to the Les Fumées Affiliate Program (“Program”), operated through AWIN US. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Affiliate,” “you,” or “your”) and Les Fumées LLC (“Company,” “we,” “our,” or “us”) regarding participation in our affiliate marketing program.

By applying for and participating in the Program, you agree to comply with these Terms and AWIN’s policies and platform requirements.

2. Enrollment

To join the Program, you must submit a complete and accurate application through AWIN.
Les Fumées reserves the right to approve or reject any application at its sole discretion, including for reasons such as:

• Content inconsistent with our brand values or image;
• Promotion of illegal, hateful, or adult content;
• Involvement in misleading, deceptive, or spam-based marketing.

You will be notified of your acceptance or rejection via the AWIN platform.

3. Affiliate Responsibilities

As an approved Affiliate, you agree to:

• Promote Les Fumées products truthfully, responsibly, and in good faith.
• Clearly and conspicuously disclose your affiliate relationship with Les Fumées in compliance with FTC Endorsement Guidelines (e.g., including “#ad” or “#affiliate” in social or blog posts).
• Use only the marketing materials, links, and creative assets provided or approved by Les Fumées.
• Avoid misleading claims about Les Fumées products or pricing.
• Not use unauthorized paid search (PPC) or bid on Les Fumées branded keywords, trademarks, or close variations.
• Refrain from coupon scraping, cookie stuffing, or any fraudulent activity intended to artificially inflate commissions.
• Comply with all applicable U.S. federal, state, and local laws.

4. Commissions & Payment

Commissions are managed and tracked through the AWIN platform.

You will earn a commission on eligible sales generated via your unique affiliate links, as defined by AWIN’s tracking system.

Commission rates, cookie duration, and other earning details are available in your AWIN dashboard.

Payments are made by AWIN in accordance with their standard schedule and minimum payout thresholds.

Les Fumées reserves the right to withhold or reverse commissions for orders that are canceled, refunded, or deemed fraudulent.

5. Intellectual Property

All content, images, trademarks, and creative materials provided by Les Fumées remain our exclusive property.
You are granted a limited, non-exclusive, revocable license to use these materials solely for promoting Les Fumées under this Program.
You may not modify, distribute, or use our assets in any way that implies an official partnership beyond affiliate promotion.

6. Termination

Either party may terminate participation in the Program at any time, with or without cause, by providing notice via AWIN.

Les Fumées reserves the right to immediately suspend or terminate your participation if:

You breach these Terms or AWIN’s policies;

• You engage in fraudulent, deceptive, or unethical practices;
• Your promotional content damages the reputation of Les Fumées.

Upon termination, you must promptly remove all Les Fumées links, logos, and content from your platforms.

7. Limitation of Liability

Les Fumées shall not be liable for indirect, incidental, special, or consequential damages (including loss of revenue or data) arising out of participation in this Program.
We make no warranties, express or implied, regarding the Program’s operation or the accuracy of information provided through AWIN.

8. Modifications

Les Fumées may modify these Terms, commission rates, or Program details at any time. Notice of material changes will be provided via AWIN. Continued participation after such changes constitutes acceptance of the revised Terms.

9. Independent Contractor Relationship

Affiliates are independent contractors. Nothing in these Terms creates any employment, partnership, or agency relationship between you and Les Fumées. You are solely responsible for any taxes or reporting obligations associated with your earnings through AWIN.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Davidson County, TN.
