Program Terms

Numi Affiliate Program – Terms & Conditions

By participating in the Numi affiliate program (“Program”) on Awin, you (“Publisher”) agree to the following terms and conditions, in addition to Awin’s network terms and any applicable laws and regulations.
 

1. Program Participation

1.1. Participation in the Program is subject to approval by Numi and may be revoked at any time at Numi’s sole discretion.
1.2. Numi reserves the right to decline or remove any Publisher whose content, behavior, or traffic sources are deemed inappropriate, misleading, fraudulent, or non-compliant with these terms.
1.3. Publisher is responsible for ensuring that all promotional activity for Numi complies with applicable laws, regulations, and advertising standards in all relevant jurisdictions.
 

2. Commission & Tracking

2.1. Approved sales tracked and validated through Awin’s platform will be eligible for commission according to the agreed commercial terms within the Awin interface.
2.2. Numi reserves the right to reverse or decline commissions for cancelled orders, returned items, suspected fraud, self-referrals, violations of these terms, or any behavior that artificially inflates traffic or sales.
2.3. Tracking, attribution windows, and reporting are governed by Awin’s technology and may be subject to technical limitations; Numi is not liable for tracking issues outside of its reasonable control.
 

3. Trademark & Paid Search Policy (No TM+)

3.1. Trademark bidding (TM+) is not permitted. Publishers may not bid on, purchase, or otherwise target Numi brand terms, misspellings, or variations as keywords in paid search or other biddable media.
3.2. Restricted terms include, but are not limited to: “Numi,” “Wear Numi,” “WearNumi,” and any close variations, misspellings, or combinations with other words (e.g., “Numi discount,” “Numi promo code”).
3.3. Publishers may not use Numi trademarks, brand terms, or domains in:

Paid search ad copy, display URLs, or destination URLs when used to misrepresent affiliation or ownership.

Domain names, subdomains, or social handles that could cause confusion with the official Numi brand or website.
3.4. Direct linking from paid search ads to Numi’s website (or any Numi-owned landing page) is prohibited unless explicitly approved in writing by Numi.
3.5. Numi reserves the right to withhold or reverse commissions and/or remove a Publisher from the Program for any violation of this trademark and paid search policy.
 

4. Content Standards & Brand Representation

4.1. All content promoting Numi must be accurate, honest, and not misleading. Claims about product benefits, pricing, or promotions must reflect current, publicly available information.
4.2. Publishers may not make medical, health, or other regulated claims about Numi products that have not been officially stated by Numi.
4.3. Publishers must not engage in spam, adware, malware, cookie stuffing, or any other deceptive or intrusive marketing practices.
4.4. Use of Numi’s brand assets (logos, images, copy) is granted solely for the purpose of Program promotion and may not be altered in a way that misrepresents the brand. Numi may request removal or modification of any promotional content at any time.
 

5. FTC Disclosure & Compliance

5.1. All posts, content, and communications that include Numi affiliate links must include clear and conspicuous disclosure of the affiliate relationship, in compliance with FTC guidelines or equivalent regulations in the Publisher’s jurisdiction.
5.2. Acceptable disclosures should be placed close to the affiliate link or endorsement and in language that is easily understood by the average consumer (e.g., “This post contains affiliate links. I may earn a commission if you make a purchase through my link, at no additional cost to you.”).
5.3. Failure to maintain proper disclosures may result in reversal of commissions, suspension, or removal from the Program. Publishers are solely responsible for understanding and complying with all disclosure and consumer protection requirements.
 

6. Coupon, Deal, and Incentive Sites

6.1. Publishers listing coupons or deals must only promote valid, authorized offers provided through the Awin interface or directly by Numi.
6.2. Fabricated, expired, or misleading coupon codes are not permitted. Publishers must promptly remove outdated promotions upon notice by Numi.
6.3. Incentivized traffic (e.g., cashback, points, rewards) is allowed only if clearly disclosed to users and compliant with these terms and network policies.
 

7. Email, Social, and Other Channels

7.1. Email campaigns must comply with all applicable anti-spam laws (e.g., CAN-SPAM, CASL) and include the required disclosures, opt-out mechanisms, and sender identification.
7.2. Social posts must clearly identify affiliate relationships (e.g., “#ad”, “#affiliate”) in a way that is visible and understandable to users.
7.3. Any use of paid social, native ads, or other paid placements must comply with platform advertising policies and these Program terms.
 

8. Prohibited Activities

8.1. The following activities are strictly prohibited:

TM+ bidding and other violations of the trademark and paid search policy.

Cookie stuffing, forced clicks, or automatic redirection without user intent.

Misrepresentation of being Numi or an official Numi site.

Use of offensive, hateful, illegal, or adult content alongside Numi promotions.
8.2. Numi may, at its sole discretion, withhold payment and terminate participation for any Publisher engaged in prohibited activities.
 

9. Data, Privacy & Confidentiality

9.1. Publishers must comply with all applicable data protection and privacy laws when collecting, processing, or storing user data (e.g., GDPR, CCPA, or local equivalents).
9.2. Any non-public information provided by Numi (e.g., private offers, performance data) is confidential and may not be shared or disclosed without prior written consent.
 

10. Term, Modification & Termination

10.1. Numi may modify these Terms & Conditions at any time. Continued participation in the Program after changes are posted in Awin constitutes acceptance of the updated terms.
10.2. Numi or the Publisher may terminate participation in the Program at any time, with or without cause, via the Awin platform.
10.3. Upon termination, Publisher must immediately cease use of Numi’s brand assets and remove or disable all affiliate links where reasonably practical.
 

11. Limitation of Liability

11.1. Numi is not liable for indirect, incidental, or consequential damages arising from participation in the Program, to the maximum extent permitted by law.
11.2. Numi does not guarantee any specific level of traffic, conversions, or earnings as part of the Program.
