Affiliate Program Terms and Conditions
Effective Date: January 23, 2025
These Terms and Conditions (the “Agreement”) govern your participation in the Kat Scrappiness Affiliate Program (the “Program”).
By signing up for the Program, you (the “Affiliate”) agree to comply with this Agreement. Please read it carefully before applying.
1. Eligibility Requirements To join the Program, you must: Be at least 18 years old. Operate a legitimate website, social media account, or other online platform that complies with applicable laws and our standards of conduct. Not engage in any activities prohibited by Section 7 of this Agreement. Kat Scrappiness reserves the right to accept or reject any application at its sole discretion.
2. Affiliate Responsibilities As an Affiliate, you agree to: Promote Kat Scrappiness products or services using the materials and tracking links provided. Ensure all promotions comply with the Federal Trade Commission (FTC) guidelines and disclose affiliate relationships (e.g., using #ad or similar disclosure). Not misrepresent Kat Scrappiness or its offerings in any way.
3. Commission Structure Affiliates will earn a commission rate as assigned via the network platform (e.g., ShareASale, Awin). Commissions will be tracked and paid out according to the settings established on the platform. Payment Terms: Payments lock after 20 days to account for chargebacks, returns, fraudulent purchases, and duplicate orders. Only qualifying commissions will be paid out according to the payment schedule assigned in the network platform.
4. Affiliate Tools Kat Scrappiness will provide: Unique tracking links. Promotional materials, such as banners, text links, and product images. Access to a dashboard to monitor your performance. Affiliates are not allowed to modify any materials provided without prior written consent.
5. Coupon Code Use Affiliates must comply with the following guidelines regarding coupon codes: Only coupons provided to Affiliates through the network platform or directly from the Affiliate Program Manager may be used. Affiliates may not publish or promote any third-party codes or coupons found on the Kat Scrappiness website, in marketing materials, or distributed elsewhere, without express written permission from Kat Scrappiness. Affiliates are responsible for ensuring all codes are kept up to date, and expired codes must be promptly removed from promotional channels. The use of unauthorized or expired codes may result in commission reversals, program suspension, or termination.
6. Prohibited Activities Affiliates must not: Use spam or unsolicited emails to promote Kat Scrappiness. Bid on branded keywords, including variations and misspellings, for paid search campaigns. Use cookie stuffing or other deceptive practices to generate commissions. Promote on sites containing offensive or illegal content. Use any form of toolbar, browser extension, or software application to promote Kat Scrappiness or generate affiliate links without express written permission from Kat Scrappiness. Violations may result in termination and forfeiture of any unpaid commissions.
7. Termination Either party may terminate this Agreement at any time, with or without cause, by providing written notice. Upon termination: You must remove all Kat Scrappiness promotional materials and links. Any pending commissions will be paid only if they meet the criteria for Qualifying Purchases prior to termination.
8. Confidentiality Any information shared with you as part of the Program, including performance data, promotional materials, and customer information, is confidential and must not be disclosed to third parties.
9. Intellectual Property Kat Scrappiness retains all rights to its trademarks, logos, and promotional materials. Affiliates may use these solely for the purpose of promoting [Company Name], as authorized under this Agreement.
10. Limitation of Liability Kat Scrappiness will not be liable for any damages arising out of your participation in the Program, including but not limited to lost profits, incidental damages, or punitive damages.
11. Indemnification You agree to indemnify and hold harmless Kat Scrappiness and its affiliates from any claims, damages, or liabilities arising from your actions as an Affiliate.
12. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.
13. Amendments Kat Scrappiness reserves the right to modify these Terms and Conditions at any time. You will be notified of any changes via email or through the Program dashboard. Continued participation in the Program after changes are made constitutes acceptance of the revised Agreement.
