1. Compliance with Laws and Regulations
Affiliates must comply with all applicable laws, regulations, and guidelines, including but not limited to, the Federal Trade Commission (FTC) guidelines on advertising and endorsements.
2. Prohibited Promotional Methods
No Spamming: Affiliates are strictly prohibited from engaging in unsolicited email marketing (spam) or posting in forums, social media groups, or any other platforms where such postings are considered spam.
No Misleading Promotions: Affiliates must not make false claims, provide misleading information, or misrepresent the products or services being promoted.
No Cookie Stuffing: Affiliates are not allowed to use cookie stuffing techniques that set tracking cookies without the user's knowledge and consent.
3. Use of Intellectual Property
Affiliates are granted a limited license to use our trademarks, logos, and approved marketing materials provided within the ShareASale platform. Any other use must be pre-approved by us in writing.
No Domain Squatting: Affiliates must not use our brand name or any variation of it in their domain names, including misspellings.
4. Paid Search Policy
Affiliates may not bid on our trademarked terms, including variations or misspellings, in any pay-per-click (PPC) or search engine marketing (SEM) campaigns.
Affiliates are not permitted to use our brand name in their paid search ad copy.
5. Content Guidelines
Affiliates must ensure that their websites, blogs, or any promotional content do not contain offensive, discriminatory, or illegal content. All content must be family-friendly.
Affiliates should clearly disclose their affiliate relationship with us, as required by the FTC or other regulatory bodies.
6. Tracking and Reporting
Affiliates must use the provided Awin's affiliate links for tracking purposes. Manipulating tracking links or data to falsely attribute sales to your affiliate account is strictly prohibited.
7. Commission Reversal and Payment
We reserve the right to reverse commissions if a sale is found to be fraudulent, canceled, or refunded.
Affiliates will be paid according to Awin's standard payment schedule. Any disputes regarding commissions must be raised within 30 days of the transaction date.
8. Termination of Agreement
We reserve the right to terminate this agreement at any time, for any reason. Causes for termination include, but are not limited to, violation of this agreement, engagement in fraudulent or unethical activities, or poor performance.
9. Modification of Terms
We may modify any of the terms and conditions within this agreement at any time and at our sole discretion. Affiliates will be notified of any changes via email or through the awin's platform. Continued participation in the program following any modification constitutes acceptance of the new terms.
10. Limitation of Liability
We will not be liable for any indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this agreement or the affiliate program.
