FYRTORR LTD. (BEN’S NATURAL HEALTH)
AFFILIATE PROGRAM TERMS AND CONDITIONS
These Affiliate Program Terms and Conditions (the “Agreement”) govern participation in the Fyrtorr Ltd. (“Fyrtorr”, “we”, “us”, “our”) Affiliate Program. By participating in the Affiliate Program via AWIN or any tracking platform designated by Fyrtorr, you (“Affiliate”, “you”) agree to be bound by this Agreement.
1. Definitions
1.1 “Affiliate Link” means the unique tracking link assigned to Affiliate for redirecting users to Fyrtorr Websites.
1.2 “Customer” means a bona fide end user purchaser of Products. A Customer may be either a New Customer or an Existing Customer.
1.3 “New Customer” means a Customer who, at the time of purchase, has never previously purchased any Fyrtorr Product through any channel, including but not limited to:
Any Fyrtorr Website
Subscription or auto-order program
Telephone orders
Marketplace platforms
Third-party retailers
Any other sales venue or media
1.4 “Existing Customer” means any Customer who is not a New Customer, including any Customer who has previously purchased any Fyrtorr Product through any channel.
1.5 “Products” means supplements, books, and other goods and services sold under the Ben’s Natural Health or Fyrtorr brands.
1.6 “Sale” means only the first bona fide purchase made by a New Customer via the Affiliate Link during the same browsing session (a “Qualifying Purchase”).
No Fees shall be payable for purchases made by Existing Customers.
2. Commission Structure
2.1 Commissions are payable only on Qualifying Purchases made by New Customers.
2.2 No commissions shall be paid for:
Purchases by Existing Customers
Repeat purchases
Subscription renewals
Auto-order charges
Reactivations
Upsells
Cross-sells
Additional orders by the same Customer
2.3 If a transaction is refunded or charged back, associated commissions will be reversed.
2.4 Fyrtorr’s determination of whether a purchaser qualifies as a New Customer or Existing Customer shall be final and binding, provided such determination is made reasonably and in good faith.
3. Tracking and Attribution
3.1 Sales must occur through the Affiliate Link to qualify for commission.
3.2 Fyrtorr is not responsible for tracking failures caused by Affiliate error.
3.3 Fyrtorr reserves the right to withhold or reverse commissions generated through prohibited activity or policy violations.
4. Paid Search (PPC) Policy
Participation in paid search advertising is strictly regulated.
4.1 Prohibited Brand and Product Bidding
Affiliates may not bid on, purchase, or otherwise use in paid search campaigns any keywords including:
“Ben’s Natural Health”
“Fyrtorr”
Any variation or misspelling of the above
Any Product name
Any variation or misspelling of any Product name
Any Fyrtorr domain name or URL
Any combination of the above with “discount”, “coupon”, “promo”, “code”, “offer”, “deal”, or similar terms
This prohibition applies to all match types.
4.2 Negative Keyword Requirement
Affiliates must add all brand names, product names, and known misspellings as negative keywords in all paid search campaigns.
Failure to maintain negative keywords constitutes a material breach.
4.3 Trademark Use in Ads
Affiliates may not:
Use Fyrtorr trademarks or Product names in ad headlines or copy
Use trademarks in display URLs
Imply official endorsement
Use terms such as “official site”
4.4 Direct Linking Prohibited
Affiliates may not direct link from paid search advertisements to any Fyrtorr Website using an Affiliate Link.
Paid search traffic must land on an Affiliate-owned website containing original content.
4.5 Enforcement
Violations may result in:
Immediate commission reversal
Suspension
Termination
Forfeiture of unpaid commissions
5. Promotional Conduct
5.1 Affiliates must comply with all applicable laws, including FTC, ASA, GDPR, UK Data Protection Act, CAN-SPAM, CASL, TCPA, and advertising regulations.
5.2 Affiliates may not:
Make false, misleading, or unsubstantiated claims
State or imply that products treat or cure a disease
Use prohibited medical terms, including “cure”, “treat”, or similar disease claims
Engage in incentivised traffic or survey traffic
5.3 SMS, text message, ringless voicemail, and telephone marketing are strictly prohibited.
6. Fraud
Fraudulent activity includes, but is not limited to:
Cookie stuffing
Forced clicks
Artificial traffic generation
Tracking manipulation
Use of stolen or false payment information
Fraud results in immediate termination and forfeiture of commissions.
7. Confidentiality
Affiliate shall not disclose confidential or proprietary information obtained through the Affiliate Program.
8. Term and Termination
Fyrtorr may terminate Affiliate participation at any time for any reason.
Upon termination, Affiliate must immediately remove all Affiliate Links and Creative.
9. Limitation of Liability
Fyrtorr shall not be liable for indirect, incidental, or consequential damages.
Liability shall not exceed commissions paid in the six (6) months preceding any claim.
10. Governing Law
This Agreement is governed by the laws of England and Wales.
11. General
Fyrtorr reserves the right to update these Terms at any time. Continued participation constitutes acceptance of any updates.
Affiliate is an independent contractor. Nothing in this Agreement creates a partnership, agency, or employment relationship.
