AlltheMen Affiliate Program Agreement
This Program Agreement ("Agreement") sets forth the terms and conditions governing the AlltheMen affiliate program ("Program"). By participating in the Program, you ("Affiliate") agree to the following terms and conditions:
1. Program Overview The AlltheMen affiliate program allows Affiliate to promote and market AlltheMen's products and earn commissions on qualifying sales generated through their unique affiliate links. AlltheMen offers a wide selection of high-quality men's fashion products, making it an attractive opportunity for Affiliate to earn passive income through affiliate marketing.
2. Eligibility and Enrollment To be eligible for the Program, Affiliate must meet the following criteria:
• Have a valid and active website or blog with relevant content related to fashion, men's clothing, lifestyle, or related topics.
• Maintain an ethical and reputable online presence.
• Comply with all applicable laws and regulations.
• Agree to the terms and conditions of this Agreement and the ShareASale Terms of Use.
To enroll in the Program, Affiliate must complete the registration process on the ShareASale platform and be approved by AlltheMen. AlltheMen reserves the right to approve or decline any application for any reason.
3. Prohibited Activities Affiliate is strictly prohibited from engaging in the following activities: a. Unlawful or deceptive marketing practices, including false advertising or misleading promotions. b. Unauthorized use of copyrighted materials or trademarks owned by AlltheMen or its partners. c. Spamming or engaging in unsolicited email marketing. d. Misrepresentation of the AlltheMen brand, products, or services. e. Creating or promoting inappropriate or offensive content related to AlltheMen or its products. f. Promotion of AlltheMen on adult or illegal websites. g. Violation of any applicable laws or regulations.
Any violation of these prohibitions may result in the immediate termination of Affiliate's participation in the Program and forfeiture of any unpaid commissions.
4. Affiliate Tracking and Commissions AlltheMen uses a robust and reliable tracking system provided by ShareASale to monitor and attribute sales generated by Affiliate's promotional efforts. Affiliate will receive a unique affiliate ID and tracking links to ensure accurate commission attribution.
Commissions will be paid to Affiliate based on the agreed-upon commission rate for qualifying sales. A qualifying sale is a purchase made by a customer who clicks on Affiliate's unique tracking link and completes a transaction on the AlltheMen website within the cookie duration period.
5. Commission Rates and Payment AlltheMen offers competitive commission rates on qualifying sales. The commission rate may vary based on the type of products and promotional campaigns. Affiliate will be notified of the current commission rate upon approval into the Program.
Commissions will be paid on a regular payment schedule as specified in the Program terms. Payments will be made through the ShareASale platform, and Affiliate is responsible for ensuring accurate payment details are provided.
6. Promotional Materials and Brand Guidelines AlltheMen will provide Affiliate with a variety of marketing materials, including banners, text links, product images, and promotional content. Affiliate is encouraged to use these materials to effectively promote AlltheMen products.
Affiliate must adhere to AlltheMen's brand guidelines when using promotional materials to ensure consistency and alignment with the brand image. Unauthorized modification or alteration of promotional materials is strictly prohibited.
7. Termination and Account Closure AlltheMen reserves the right to terminate this Agreement and remove Affiliate from the Program at any time for any reason. Reasons for termination may include, but are not limited to, violation of the Program Agreement, engaging in prohibited activities, or any conduct deemed detrimental to AlltheMen's reputation.
Upon termination, Affiliate must remove all AlltheMen promotional materials from their website or blog and cease any further promotion of AlltheMen products.
8. Intellectual Property Rights AlltheMen retains all rights to its trademarks, logos, copyrighted materials, and other intellectual property. Affiliate is granted a limited, non-exclusive, revocable license to use the provided marketing materials solely for the purpose of promoting AlltheMen products in accordance with this Agreement.
Affiliate may not use AlltheMen's trademarks, logos, or copyrighted materials for any other purposes without explicit written consent from AlltheMen.
9. Compliance with Laws Affiliate shall comply with all applicable laws and regulations while participating in the Program. This includes but is not limited to consumer protection laws, privacy laws, and intellectual property laws.
10. Modification of Agreement AlltheMen reserves the right to modify the terms and conditions of this Agreement at any time. Such modifications will be communicated to Affiliate through the ShareASale platform or by email. Affiliate's continued participation in the Program after the effective date of the modifications constitutes acceptance of the revised terms.
11. Confidentiality Affiliate agrees to keep all Program-related information, including commission rates and payment details, confidential and not disclose such information to any third parties without prior written consent from AlltheMen.
12. Limitation of Liability AlltheMen shall not be liable for any indirect, special, punitive, or consequential damages arising out of or in connection with the Program or this Agreement.
13. Indemnification Affiliate agrees to indemnify and hold harmless AlltheMen, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses arising out of Affiliate's participation in the Program, including but not limited to violations of this Agreement and any applicable laws.
14. Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of laws principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in [Your Jurisdiction], and each party irrevocably submits to the personal jurisdiction of such courts for the purposes of any such action or proceeding.
15. Entire Agreement This Agreement constitutes the entire understanding between AlltheMen and Affiliate regarding the Program and supersedes all prior agreements, representations, and understandings.
By participating in the AlltheMen affiliate program, Affiliate acknowledges that they have read, understood, and agree to abide by this Program Agreement and the ShareASale Terms of Use.
