ENROLLMENT IN THE PROGRAM
To begin the enrollment process, you must submit a complete Program application through the AWIN Affiliate Network at https://www.awin.com/us.
We will evaluate your application and notify you of your acceptance or rejection via the AWIN platform. Employees of Rise & Puff and its affiliated entities are not eligible to participate in the Program.
You are also not eligible to enroll if your Site offers rewards, points, cash back, or similar incentives, or if it promotes discounted Rise & Puff gift cards.
We reserve the right to reject your application for any reason, including, but not limited to, our determination that your Site is unsuitable for the Program. Unsuitable Sites include those that:
(a) contain or link to pornography or sexually explicit materials;
(b) promote violence, discrimination, or illegal activities;
(c) infringe intellectual property rights or privacy rights of any third party;
(d) promote pyramid schemes or deceptive marketing;
(e) contain defamatory, fraudulent, or harassing material;
(f) include “Rise & Puff,” “riseandpuff.com,” or misspellings thereof in their domain name; or
(g) distribute content to third parties without approval.
If your Site distributes content, you must provide a list of distribution partners for Rise & Puff’s written approval and notify us of any additions thereafter.
AGREEMENTS FOLLOWING ACCEPTANCE
The following terms and conditions take effect only upon acceptance into the Program.
By applying to be a Rise & Puff Affiliate, you agree to be bound by these terms and conditions.
Links on Your Site
To enable accurate tracking, reporting, and referral fee accrual, we will authorize AWIN to give you access to special tagged link formats (“Special Links”) to be used in all links between your Site and ours. You must ensure that all links properly use these formats.
We will not be liable for any failure to use Special Links, including any resulting loss of commissions.
Each Special Link will appear as a Rise & Puff logo, text link, or product image provided via AWIN’s servers. You agree to use only the Rise & Puff creatives made available through AWIN, and not obtain them elsewhere.
Order Processing
We will process all customer orders placed through Special Links. We reserve the right to reject any orders that do not comply with our requirements.
AWIN will track sales and provide reporting of transactions and commissions through its affiliate dashboard. You agree not to share these reports or data with third parties without written consent from Rise & Puff.
Referral Fees and Payments
Referral fees will be calculated and paid in accordance with the Referral Fee Schedule posted within AWIN. We reserve the right to update these fees or terms with notice via the AWIN platform.
Payments will be issued monthly, typically within 45 days of month-end, via AWIN’s payment system. Referral fees under $25 may be carried over until the balance reaches $25 or the Agreement terminates.
If a referred sale is canceled or refunded, the corresponding referral fee will be deducted from future payments.
Policies and Pricing
Customers purchasing through affiliate links are customers of Rise & Puff. Our policies, pricing, and operational procedures apply. Product pricing and availability may vary and are subject to change without notice.
Use of Rise & Puff Marks
All trademarks, trade names, and logos provided through AWIN remain the property of Rise & Puff. You are granted a limited, non-exclusive, revocable license to use them solely for participation in the Program. You may not modify, register, or misrepresent the Rise & Puff brand in any form.
Customer and Sales Information
All customer data, sales information, and related materials remain the property of Rise & Puff. You may use aggregated sales data solely for internal reporting or performance analysis, and may not disclose customer data to any third party.
Prohibited Conduct
You may not:
Use Rise & Puff’s name or variations in domains, ads, or hidden code.
Run paid search ads bidding on “Rise & Puff” or related terms.
Distribute unauthorized coupon codes or promotions.
Frame Rise & Puff’s site or interfere with its tracking or user experience.
Violation of these terms may result in immediate termination and forfeiture of commissions.
Termination
Either party may terminate this Agreement at any time, with or without cause, via written or electronic notice through AWIN.
Upon termination, you must immediately remove all Rise & Puff links, marks, and materials. Commissions earned before termination will be paid only for valid, non-returned orders.
Modifications
We may update this Agreement or the Referral Fee Schedule at any time through notice on the AWIN platform. Continued participation constitutes acceptance of those modifications.
Relationship of the Parties
Both parties are independent contractors. Nothing in this Agreement creates a partnership, joint venture, or employment relationship.
