This Agreement contains the necessary terms and conditions that apply to your application and approval of becoming an affiliate in the Century Martial Arts Affiliate Program. By submitting your affiliate application you are agreeing that you have read and understand the terms and conditions of this agreement and that you agree to be legally responsible for the terms and conditions.
Affiliate Agreement Summary
PLEASE NOTE: Because we are a B2B/B2C website, we will only pay a 5% commission on B2C transactions. Any B2B transactions will be voided automatically without dispute.
We may determine that your site is unsuitable for our Affiliate Program for the following reasons:
• Promotes sexually explicit materials
• Promotes illegal violence
• Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
• Promotes illegal activities
• Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law.
• Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable to us in our sole discretion.
• Contains software downloads that potentially enable diversions of commission from other affiliates in our program.
• With a website that leads customers to believe you are Century or an official affiliation of Century
Rights
Century reserves the right, at any time, to review your placement and approve the use of Century affiliate links, and we may require that you make necessary corrections to comply within our affiliate agreement guidelines. The maintenance and the updating of your site will be your responsibility.
It is entirely your responsibility to follow all laws pertaining to intellectual property. You must have express permission to use any person's copyrighted material, whether it is writing, an image, or any other copyrightable work. You will be solely responsible for the content of your site and for any violations of copyright laws or any third party rights.
If you do not make the changes to your site required under our guidelines, we reserve the right to terminate your participation in the Century Affiliate Program. Century may not be liable to you for any commissions that may occur while under these affiliate agreement violations.
Agreement Termination
Either you or Century may end this agreement at any time, with or without cause, by giving the other party written notice. Written notice can be in the form of mail, email or fax. In addition, this Agreement will terminate immediately upon any breach of this agreement by you.
Agreement Modification
We may modify any of the terms and conditions in this Agreement at any time at our sole discretion. In such event, you will be notified by email. Modifications may include, but are not limited to, changes in the payment procedures and the affiliate program rules. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in the Century Affiliate Program, following the posting of the change notice or new Agreement on our site, will indicate your agreement to the changes.
Promotion Restrictions
Publishers may not represent themselves as Century or as a dealer or representative of Century . This also includes representing themselves as Century with advertising methods such as display and PPC ads. Also be aware that Framing of the Century website is prohibited.
PPC Restrictions
Century has a restricted PPC bidding policy. Our trademarked brand names such as Century, Century Martial Arts, Centurymartialarts.com, BOB, Wavemaster and Versys are all prohibited PPC terms. Other terms such as MMA, BJJ, heavy bags, karate, etc. are allowed.
Deceptive Advertising
Affiliate shall not engage in Parasite ware, Parasitic Marketing, Shopping Assistance Application, toolbar installations or deceptive advertisements to engage consumers. Publishers may not use site re-directs, pop-ups or pop-unders that link to Century.
Email Marketing
All electronic messages initiated or sent by the Publisher or on the Publisher’s behalf must identify Publisher as the sender and may not suggest or imply, or mislead a recipient into believing that Century is the sender. Publisher may not use a return address, subject heading, header information or message contents that misleads or confuses or is likely to mislead or confuse a recipient as to Publisher being the sender.
Publisher Content
Publishers may not use Century content unless it is provided to the affiliate through the affiliate program via datafeeds, images or links.
Datafeeds
We will not provide datafeeds.
Adult Content
Publisher may not post Century content on any page where adult content appears. Adult content includes nudity or obscenity, sexually explicit, pornographic images or material.
Publisher may not post any offensive content that is in any way harmful, threatening, obscene, harassing or racially, ethnically objectionable, or promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
