Program Overview:
1.1. The Smiler AWIN Affiliate Program ("Program") allows affiliates to earn commissions by promoting Smiler's photography services and driving qualified sales through their unique affiliate links.
1.2. Affiliates are required to comply with these terms and conditions, as well as any additional guidelines or policies provided by Smiler.
Affiliate Eligibility:
2.1. To participate in the Program, affiliates must have an active AWIN affiliate account and comply with AWIN's terms and conditions.
2.2. Affiliates must have a functioning website or an active digital marketing platform to promote Smiler's photography services.
Affiliate Responsibilities:
3.1. Affiliates are responsible for promoting Smiler's photography services using authorized promotional materials provided by Smiler or approved by Smiler in writing.
3.2. Affiliates must not engage in any misleading or unethical marketing practices that may harm Smiler's reputation or violate applicable laws and regulations.
3.3. Affiliates shall not engage in spamming or unsolicited email marketing to promote Smiler's services.
3.4. Affiliates must promptly update their affiliate links or promotional materials when requested by Smiler.
Commission Structure:
4.1. Affiliates will earn a commission on qualified sales made through their unique affiliate links.
4.2. Commission rates and payment terms will be agreed upon and communicated between Smiler and each affiliate individually.
4.3. Commissions will only be paid for confirmed and completed purchases that comply with the terms set forth in these terms and conditions.
4.4. Commission payments will be made according to the payment schedule agreed upon with each affiliate.
4.5. The commission is paid when the photoshoot date has passed and the order has not been cancelled.
Cookie Tracking:
5.1. Smiler utilizes cookie tracking to attribute sales to the respective affiliate.
5.2. The cookie duration is determined by Smiler and may vary for different promotions or campaigns.
5.3. Only sales made within the cookie duration will be eligible for commission.
Termination:
6.1. Smiler reserves the right to terminate an affiliate's participation in the Program at any time, for any reason, with or without cause.
6.2. Affiliates may also terminate their participation in the Program by providing written notice to Smiler.
6.3. Upon termination, all rights and obligations of both Smiler and the affiliate will cease, except for any commission payments due up until the termination date.
Limitation of Liability:
7.1. Smiler will not be held liable for any indirect, special, or consequential damages arising out of or in connection with the Program or the use of affiliate links.
7.2. Smiler's liability to affiliates for any claim arising under or in connection with the Program will not exceed the total commission paid to the affiliate during the three-month period preceding the event giving rise to the claim.
Modification of Terms:
8.1. Smiler reserves the right to modify or amend these terms and conditions at any time by providing notice to affiliates.
8.2. Affiliates will be deemed to have accepted the modified terms and conditions if they continue to participate in the Program after the effective date of the changes.
