ThinkCar Affiliate Program Agreement
This Affiliate Program Agreement (the "Agreement") sets forth the terms and conditions governing the participation of affiliates (the "Affiliate" or "you") in the ThinkCar Affiliate Program (the "Program") offered by ThinkCar, Inc. ("ThinkCar", "we", "us", or "our"). By participating in the Program, you agree to comply with all terms and conditions contained herein.
Program Participation
To participate in the Program, you must first apply by submitting an application through ShareASale. We reserve the right to accept or reject any application at our sole discretion. Upon approval, you will be provided with a unique referral link, promotional materials, and access to your affiliate dashboard.
Affiliate Responsibilities
As an Affiliate, you agree to:
a. Promote ThinkCar products in a manner that is consistent with our brand values and target audience.
b. Use only the promotional materials provided in your affiliate dashboard, and refrain from using any unauthorized materials.
c. Comply with all applicable laws, rules, and regulations, including but not limited to advertising, privacy, and data protection laws.
d. Clearly disclose your affiliate relationship with ThinkCar, in compliance with the Federal Trade Commission's guidelines on endorsements and testimonials.
Prohibited Activities
Affiliates are strictly prohibited from engaging in any of the following activities:
a. Using any form of spam or unsolicited email marketing.
b. Promoting ThinkCar products on websites or social media accounts that contain adult, gambling, or other inappropriate content.
c. Using any deceptive or misleading advertising practices, including but not limited to false claims, unauthorized discounts, or hidden fees.
d. Bidding on ThinkCar's trademarked keywords or using our trademarks in domain names or social media profiles.
e. Using cookie stuffing or other techniques to manipulate tracking cookies.
Commission Structure and Payments
Affiliates will earn a commission on each sale generated through their unique referral link, in accordance with the commission rates and payment terms set forth in the Program description. Commissions are subject to a 30-day holding period to account for potential refunds or chargebacks. Payments will be made through ShareASale on a monthly basis, subject to meeting the minimum payment threshold.
Termination
We reserve the right to terminate your participation in the Program at any time, with or without cause. In the event of termination, all unpaid commissions will be forfeited, and you must immediately cease using any ThinkCar promotional materials and remove all referral links from your website or social media accounts.
Modification
We may modify the terms of this Agreement at any time, at our sole discretion. It is your responsibility to periodically review the Agreement for any changes. Your continued participation in the Program constitutes your acceptance of any such modifications.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of laws provisions. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in [Your State].
By participating in the ThinkCar Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement, as well as the ShareASale Terms of Use.
