Intellectual Property Rights
Affiliates agree that all rights to copyright, trademarks, patents, trade names, domain names and any other Intellectual property rights, shall remain the property of Nothing and the Affiliates shall respect such rights of Nothing.
If an Affiliate infringes the aforesaid rights, Nothing may remove them from the program and may withhold any commission that would otherwise be due to the Affiliate.
Use of creative/links/offers
Affiliates must use creative/links/offers as provided on the Awin interface and agree not to alter or modify creative/links/offers. Use of creative/links/offers other than those provided on the Awin interface shall be approved in writing by Nothing. Affiliates shall be permitted to promote creative/links/offers through any social media platform or Affiliates’ own Blog, other than Prohibited Website as mentioned below.
Specifically, the Affiliate (i) may promote Nothing on social media campaigns and may send traffic from the campaigns to Nothing’s webpage; (ii) get all the social media campaigns/post approved from Nothing before posting; (iii) should not tag Nothing in the campaigns/post.
Affiliates agree not to promote products/offers using spam or unsolicited commercial terms. The Affiliate represents and warrants that (i) each address on the mailing list has opted to receive email from the Affiliate regarding the products/offers; (ii) each email sent by the Affiliate will contain clear instructions for recipients to unsubscribe from receiving future emails.
The Affiliate must not use the brand name or typos in the “From” address line. All Affiliates email correspondence must contain the Affiliates email addresses.
Prohibited WebSite
Affiliates must not place any creative/links/offers to Nothing’s website on any webpage containing material that promotes activities which are illegal, relating to gambling, obscene or sexually explicit, pornographic, violent, relating to sales of weapons, spread of terrorism, discriminatory (based on sex, religion, race, natural origin, physical disability, sexual orientation or age), blasphemous, defamatory or otherwise may be designated by Nothing.
Domain Name Restrictions
Affiliates are asked not to register domain names which are similar or confusingly similar to Nothing, including any misspellings of the same.
Affiliates may neither use any domain name owned by Nothing as the display url or landing url of their paid search advertising activities without express permission, nor are they allowed to alter product or pricing information without Nothing’s consent.
Affiliates may not put Nothing’s website into frames or use masked URLs.
Product and Pricing
Nothing will provide data on products available for Affiliate offers through the Awin interface.
Affiliates are requested to make every effort to maintain Nothing’s most current pricing information in their promotions.
Linking
In order for the sale to be accurately recorded, it's essential that the right links are included when promoting. It is recommended that Affiliates take links directly from the Awin interface or from Nothing.
Any affiliate that is found to be in violation of these terms and conditions may be suspended or removed from the program, and any commissions that are due could be cancelled.
Data Protection and GDPR Compliance
The Affiliate hereby confirms that they are in full compliance with their respective obligations under the General Data Protection Regulation, (GDPR) (EU) 2016/679. The Affiliate will, if applicable, notify Nothing in a timely manner in the event of a data breach that involves the data of Nothing or its customers.
Paid Search Policy
Branded Terms: Affiliates are not allowed to bid on any keyword or its variable or typos that reflects the “Nothing” brand or its product models, including but not limited to: Nothing, Nothing Tech, Nothing earbuds, Nothing ear, Nothing Phone. In addition, affiliates must add “nothing”, “ear stick”, “ear 2”, “phone 1” (phrase match) as negative keywords to their paid search activities for Nothing’s promotion.
None-branded terms: Affiliates are allowed to bid on any keyword or its variable or typos that does not reflect the: Nothing brand or its product models.
Display URL: Affiliates are not allowed to use https://nothing.tech or its sub-domains as display urls for their paid search activities.
Platforms of paid search activities mentioned above include but are not limited to: Google, Bing, Yahoo, Yahoo Japan, Naver.
Failure to comply with our Terms and Conditions may result in canceling any or all the payment due towards commission or removal from the program.
