This Affiliate Agreement (the "Agreement") contains the complete terms and conditions between myChway ("us" or "we") and you ("Affiliate"), regarding your application to and participation in the myChway Affiliate Program (the "Program") through Awin, and the establishment of links from Affiliate's websites, social media accounts, or other approved channels to our website, www.mychway.online (the "myChway Site").
By applying to join or by participating in the Program via Awin, you confirm that you have read this Agreement and agree to be bound by its terms and conditions.
1. Eligibility
To participate in the Program, you must be at least eighteen (18) years of age (or the age of majority, whichever is greater) in your country of residence. Employees of myChway or its subsidiaries, affiliates, or related companies are not eligible.
2. Definitions
Affiliate: A participant in the Program who has been approved by myChway through Awin.
Link: A tracking-enabled link provided through Awin that directs potential customers to the myChway Site.
Qualified Purchase: A completed purchase by a referred customer that meets all Program requirements and is tracked by Awin.
Referral Fees / Commission: The compensation earned by Affiliate for Qualified Purchases, as set in Awin’s platform.
Referred Customer: A new customer referred to the myChway Site via Affiliate’s Awin tracking link.
3. Enrollment in the Program
Applications are submitted through Awin. We reserve the right to accept or reject any application at our sole discretion.
4. Links
Affiliate must only use tracking links provided through Awin. We are not responsible for tracking errors caused by altering or misusing links.
5. Content and Posts
Affiliates must:
Clearly disclose their affiliate relationship (e.g., using #ad or #sponsored).
Provide accurate and honest descriptions of myChway products.
Not misrepresent, disparage, or make false claims about myChway or its competitors.
Not display, promote, or link to competing products on the same page where myChway is promoted.
6. Prohibited Conduct
Affiliates may not impersonate myChway, its employees, or representatives.
No unauthorized use of myChway trademarks, logos, or branding.
No spam, misleading advertising, or incentivized clicks that violate Awin’s Publisher Terms.
7. Paid Search & Traffic Restrictions
Bidding on “myChway” or variations/misspellings of the brand name is prohibited.
Affiliates must comply with Awin’s Paid Search Policy.
No fraudulent traffic, bots, or practices designed to artificially inflate performance.
8. Violations and Enforcement
If Affiliate violates these terms or Awin’s Publisher Terms, myChway reserves the right to:
Withhold commissions.
Suspend or terminate participation in the Program.
Cancel pending or unpaid Referral Fees.
9. Order Processing
myChway is responsible for processing all orders. Tracking and validation of sales will be based on Awin’s tracking system, which is the sole source of truth.
10. Referral Fee / Commission
The current standard commission rate is 15% per Qualified Purchase, unless otherwise stated in Awin.
Commissions may vary by product category, campaign, or promotion.
Only sales completed and approved by Awin’s system will qualify.
11. Payment of Referral Fees
Referral Fees are paid via Awin’s monthly consolidated payment system.
Payment schedule, thresholds, and methods are governed by Awin’s payout policies.
myChway is not responsible for additional bank or platform fees deducted by Awin.
12. Reporting and Disputes
Performance reports are available through Awin.
In case of discrepancies, Awin’s tracking and reporting system will prevail.
Disputes must be submitted through Awin’s dispute resolution process within the timeframe specified by Awin.
13. Policies and Pricing
All customers referred through the Program are customers of myChway. Prices, promotions, and policies are subject to change at any time. Affiliates may not display outdated or inaccurate pricing.
14. Intellectual Property
myChway grants Affiliate a limited, revocable, non-exclusive license to use approved banners, creatives, and text links provided in Awin. Unauthorized use of trademarks or content is prohibited.
15. Relationship of Parties
Affiliate is an independent contractor. Nothing in this Agreement creates an employer-employee, agency, or joint venture relationship.
16. Limitation of Liability
myChway is not liable for indirect, incidental, or consequential damages, or for any loss of revenue, profits, or data arising from participation in the Program.
17. Termination
Either party may terminate participation in the Program at any time, with or without cause, by deactivating the relationship in Awin. Upon termination, Affiliate must immediately cease using all myChway content and links.
18. Confidentiality
Affiliate agrees not to disclose confidential information, including Program performance data, commission rates (beyond what is public in Awin), or business practices.
19. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law rules.
20. Entire Agreement
This Agreement, together with Awin’s Publisher Terms, constitutes the entire understanding between myChway and Affiliate. In the event of a conflict, Awin’s platform rules and tracking data shall prevail.
