This Affiliate Service Agreement (the "Agreement") is made by and between YES LIFE FOODS, Inc d.b.a. YES Cacao (“YESCacao”), and you as an Affiliate (“Affiliate”) utilizing the ShareASale service ("the Service").
DEFINITIONS
As used in the below Terms: (i) "YESCacao.com", “YESCacao”, “YES Cacao”, "We", "us", or "our" refers to YES LIFE FOODS, INC. (ii) "You" or "your" refers to the Affiliate (iii) "Our Website" refers to the YESCacao.com digital property located at https://www.YEScacao.com. "Your Website" refers to any Websites that you will link to our Website; "Program" refers to the YES Cacao Affiliate Program.
ENROLLMENT
After receiving your application, we will review your Website and notify you of your acceptance or rejection into our Program. Please allow up to 48 hours (Mon-Fri) for your application to be approved. We reserve the right to reject any application; however we encourage you to contact us if you feel we have made an incorrect decision. Please include all websites that you use in your profile as that will help us make a better decision.

You must agree to abide by the terms and conditions contained in this Agreement in order to participate. Please read this Agreement carefully before registering and using the Service as an Affiliate. By signing up, you indicate your acceptance of this Agreement and its terms and conditions. If you do not accept this Agreement, do not use the Affiliate Window Service as an Affiliate.
The following agreement is summarized as follows:
You place our banners anywhere on your site as you see fit, or within non-spam emails.
Adult, Hate, or other related sites are not allowedYou cannot link directly to the YESCacao sites outside of the Affiliate Window platform.
Any page containing our links, banners, or codes must be written in English
Affiliates need to get prior approval from YESCacao, if they wish to send out any emails about the program.
You may place banners or links within your newsletters, in content of your website, or within other web related content.
NOT ALLOWED: Any placement of creative in a "Desktop" advertising scheme. This includes any and all 3rd party advertising platforms that use a desktop application to display ads in any form.
NOT ALLOWED: Any display of a merchant window that isn't the result of a direct click by the end-user.
Failure to abide by these rules could mean the suspension of your collaboration with a complete forfeit of commissions
Fraud is a serious offense, and will be treated as such. Fraud is defined as any action that intentionally attempts to create sales, leads, or click-throughs using robots, frames, iframes, scripts, or manually "refreshing" of pages, for the sole purpose of creating commissions. ANY ATTEMPTED FRAUD OR FRAUD WILL RESULT IN MEMBERSHIP TERMINATION AND VOIDED COMMISSIONS.
EMAIL CONTACT
We reserve the right to send email to you for the purposes of informing you of applicable changes or additions to the Service or related products and services.
CHANGES TO THE SERVICE
We reserve the right to change, modify, add or remove portions of this Agreement at any time and may add to, change, suspend or discontinue any aspect of the Service at any time. In the event of any material change, we’ll notify you via email, newsletter or at least 30 days prior to any such changes taking effect, at which time you may either agree to such changes or withdraw from the Service.
PRIVACY POLICY
YESCacao will respect the privacy of its users and will not disclose personal information to third parties without the express permission of you and Your Company. If you have any questions please contact share@yescacao.com
ACTIVITIES
1. Pay Per Click search activity
Affiliates ARE NOT PERMITTED to carry out any PPC search activity sending traffic to YEScacao.com directly. If an affiliate is found running PPC activity, this may result in them being removed from the program. Any affiliate found running PPC Activity will see their participation terminated immediately and any related commissions voided.
Affiliates also must not send traffic through automatic redirects on a website page.
Affiliates generating traffic to their own sites must also abide by the following rules.
a. Using the YESCacao brand term in the sub folder of the display URL (eg www.affiliate.com/yescacao) – NOT ALLOWED
b. Using the Eatwith brand term in the sub domain of the display URL (eg www.yescacao.affiliate.com) – NOT ALLOWED
c. Using the YES Cacao brand in the ad title – NOT ALLOWED
d. Bid on the brand term “YES Cacao” – NOT ALLOWED
e. Advertise as the brand- NOT ALLOWED
f. Show adverts on competitors’ brands – NOT ALLOWED
2. Advertising as YES Cacao
Publishers are not allowed to do any form of advertising as the YES Cacao brand.
3. Discount code websites
a. Publishers must not display made up / invented discount codes on their site(s) or display discount codes that were intended for use in other channels or for other online publishers. If you are found doing this, your participation in the YES Cacao affiliate program will be terminated immediately and commissions voided.
b. Under no circumstances are publishers allowed to surreptitiously use i-frames to set cookies onto a user’s computer.
c. Discount code and deals publishers are accepted in the program as long as they do not promote discount codes.
4. Email Marketing
All email marketing must be signed off by YES Cacao.
Creative
Affiliates may not alter any of the creative made available through the Affiliate Window.com interface. Affiliates are also requested not to hardcode banners into their sites, so updates made to those available through ShareASale window, may take immediate effect. If your site requires that banners are hardcoded, please contact the account management team to obtain permission before putting this in place. This will allow us to contact you whenever updates are necessary.
DEEP LINKS
Personalized integration / text links / Deep links
YES Cacao allows you to create your own deep links.
Please ensure that you are conducting an activity that is in line with the terms and conditions of the program.
On request, selected affiliates will be provided with an official YES Cacao discount code to promote on the Internet. This code is given by YES Cacao occasionally and must be requested through ShareASale.
Forbidden: It is not allowed to promote non-existing discount codes in the name of YES Cacao. It is not allowed to promote any other existing YES Cacao discount codes that are not provided officially through ShareASale and by YES Cacao.
Penalization: Infringing this policy will be penalized by elimination of the program and non-payment of commissions
SEM POLICY
- Affiliates must not send traffic through automatic redirects on a website page.
- Affiliates are not permitted to use the brand name (including misspells and variations) as a sub domain or sub folder.

Anyone found infringing on these terms will be contacted by the YES LIFE FOODS, Inc. Legal and/or Affiliate Team.
Please note anyone found contravening the TC’s may have their commissions declined and face suspension from the program.

LINKING TO OUR WEBSITE
Upon acceptance into the Program, links will be made available to you through the Affiliate Window interface. You agree that you will only use linking code obtained from Affiliate Window without manipulation. Also, please ensure that all domains where you use our link are listed in your affiliate network profile.
You hereby agree that your Website will not in any way copy, resemble, or mirror the look and feel of our Website. You will also not use any means to create the impression that your Website is our Website or any part of our Website including, without limitation, framing of our Website in any manner. Cookie stuffing, pop-ups, and false or misleading links are strictly prohibited. In addition, wherever possible, you will not attempt to mask the referring url information (i.e. the page from where the click is originating). Using redirects to bounce a click off of a domain where the click did not originate in order to give the appearance that it came from that domain is expressly prohibited and is a direct violation of the program. This does not include using "out" redirects from the same domain where the affiliate link is placed.
PPC GUIDELINES
If you are enrolled in our Program and participate in PPC advertising, you must adhere to our PPC Guidelines as follows:
You may not bid on any of our trademarked terms, including any variations or misspellings thereof for search or content based campaigns on Google, Yahoo, Bing, Ask or any other network.
You may not use our trademark terms in sequence with any other keyword (i.e. YESCacao.com Coupons).
You may not use our trademarked terms in your ad title, ad copy, display name or as the display url.
If you automate your PPC campaigns, the responsibility is on you to exclude our trademark terms from your program and we strongly suggest you add our trademarked terms as negative keywords. We have a strict no tolerance policy on PPC trademark bidding. We will not enter a discussion about when the violation started and when it stopped; you will forfeit all commissions for a minimum of the past 30 days.
COUPON GUIDELINES
If you are enrolled in our Program and your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:
You may ONLY advertise coupon codes that are provided to you through Affiliate Window.
You may NOT advertise coupon codes obtained from our non-affiliate advertising, customer e-mails, paid search, or any other campaign.
On click through, you must link directly to our website. Framing of our website is strictly prohibited.
Cookie Stuffing: You must not mislead customers into clicking on an offer/coupon that does not exist or practice similarly deceptive tactics which are generally accepted as "cookie stuffing." These include, but are not limited to using knowingly expired offers, presenting offers that do not exist, presenting a button that claims to show all offers which sets the affiliate cookie, and technology which generates a click/sets the cookie from the action of copying a coupon code.
Unless you have been given express written permission, if you are found to be engaging in any of the aforementioned practices, we reserve the right to reverse any/all sales generated. Only discount codes approved for the affiliate channel will be approved at the full 15% commission. Transactions including non-affiliate approved discount codes will still be honored at a lower commission rate of 10%. If your Website participates in forums where active users of your Website can submit coupon codes, it is your responsibility to ensure that the coupon codes submitted do not violate our Coupon Guidelines.
Transactions including non-affiliate approved discount codes will still be honored at a lower commission rate of 10% ONLY for Content Affiliates. Please note that all transactions including non-affiliate approved discount codes from Incentive sites (voucher/cashback) will be declined.
ADVERTISING & PUBLICITY
You shall not create, publish, distribute, or permit any written material that makes reference to our Program without first submitting such material to us and receiving our prior written consent. If you intend to promote our Program via email campaigns, you must adhere to the following:
Abide by the Privacy and Electronic Communications Regulations of 2003 (Regulations 22 and 23) with respect to our Program.
E-mail must be sent on your behalf and must NOT imply that the email is being sent on behalf of YESCacao.com
E-mails must first be submitted to us for approval prior to being sent or we must be sent a copy of the e-mail.
Affilliates are not permitted to bid on the YESCacao.com brand name, use any misspelt or variation of the brand, including all references to YES Cacao sitters and/or sites/URLs or at any time be seen bidding against YES Cacao’s own Search Engine Marketing activity.
Please ensure you read our Terms & Conditions before you apply for our program.
*Please note that commission will only be awarded for promotional offers on Affiliate Window. Manually entered promotional codes, or offers promoted elsewhere will not be awarded commission.
**New terms and conditions:
- Affiliates are not allowed to use Pop Ups, Pop Unders or any other format that is deemed intrusive or use any other cookie stuffing techniques that may force the cookie in the user's browser.
- Affiliates are not allowed to buy, register or create domains or subdomains which may misslead users to believe that such site is the merchants brand website.
- Affiliates are not allowed to supplant by any means the merchant's identity in social media. Affiliate must be easily identified by users in any promotion in social media.
- Affiliates may ONLY advertise coupon codes that are distributed by the merchant (or ShareASale on behalf of the merchant). Any sales registered through other coupon codes will not be considered as valid and will be canceled.
- Affiliates are not allowed to promote coupon codes that have not been issued via the affiliate channel.
- Affiliates violating the above T&C will be rejected from the program.
