Marley's Monsters reserves the right in its sole and unfettered discretion to disqualify any individual who does not meet the eligibility requirements or comply with any other provisions of these terms. In addition, Marley's Monsters reserves the right to terminate any Ambassador deemed in Marley's Monsters's sole discretion to violate these terms. All such decisions will be final.
By joining the Affiliate program, participants accept and agree to be bound by these terms. Any violation of these terms may result in termination from the program. Participants understand and agree that no confidential or fiduciary relationship is established by joining the program hereunder and nothing in these terms shall be deemed to place Marley's Monsters in any different position from anyone else that has not joined the program. Marley's Monsters’s failure to enforce any term of these terms shall not constitute a waiver of that provision.
This program is subject to all applicable Federal and State laws of the United States and the District of Columbia and are subject to change without notice in order to comply with them. Marley's Monsters reserves the right to verify eligibility at any time.
The value of any commission or gift earned by a member may be reported for tax purposes and as required by law. Lost or stolen gift or coupon codes will not be replaced. Any portion of the gift, commission or coupon code that is not used is forfeited. Gifts are non-transferable, are not redeemable for cash, and may not be given, bartered or sold. Marley's Monsters reserves the right to substitute the gift(s) for one of equal or greater value if the designated gift(s) should become unavailable for any reason. The coupon codes cannot be used in conjunction with any other promotion or offer. Participant agrees to accept gift(s), commissions and coupon codes “as is”, and participants hereby acknowledge that Marley's Monsters has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the gift, commission or coupon code, including express warranties (if any) provided exclusively by a gift supplier, such as those offered by a retailer.
Incidental expenses and all other costs and expenses, which are not specifically listed as part of the gift(s), commission or coupon code in these terms and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded gift(s), commission or coupon code, are solely the responsibility of the participant. Marley's Monsters will determine all details and other restrictions of the gift(s), commissions and coupon codes not specified in these terms, in its sole discretion. The gift(s), coupon codes and commissions will be delivered only to an address in the United States. All federal, state and/or local income and other taxes, if any, associated with the receipt of use of any gift(s) and commission are the respective participant’s sole responsibility. Valid taxpayer ID or Social Security number may be required from the participant when accepting the gift(s) and/or commission. An IRS1099 form or other applicable tax form may be issued to the respective participant. The gift(s) or commission shall not be awarded until all such properly executed and forms are returned within the time allotted required by Marley's Monsters. Participant will indemnify and hold Marley's Monsters harmless from and against all damages, liabilities, losses, penalties, fines, expenses and costs (including reasonable fees and expenses of attorneys and other professionals) arising out of or relating to any obligation imposed by law on participant to pay any taxes pursuant to the program.
These terms incorporate the terms of use and privacy policy from the Marley's Monsters website.
Under no circumstances will any participant be permitted to obtain awards for, and participants hereby knowingly and expressly waive all right to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses and/or any rights to have damages multiplied or otherwise increased. All causes of action arising out of or connected with this program, or any gift(s), coupon code and commission awarded, shall be resolved individually, without resort to any form of class action. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs.
