Program Terms

Terms & Conditions

Please read our affiliate terms and conditions (“T&Cs”) carefully before applying to join our program (the “Financial Modeling Institute Inc. Affiliate Program”). These T&Cs are written to ensure the success of our fminstitute.com affiliate program and our valued affiliate partners. By signing up, you indicate your acceptance of these T&Cs. If you do not accept these T&Cs, do not use the Affiliate Window Service as an Affiliate.



It is each Affiliate's responsibility to ensure compliance at all times. Thank you for your interest in our program. We look forward to working with you.



Definitions

1.         As used in the below T&Cs: (i) "fminstitute.com", "we", "us", or "our" refers to the Financial Modeling Institute Inc. (ii) "You", "your" or “Affiliate” refers to you as the affiliate (iii) "Our Website" refers to the fminstitute.com and properties located at https://fminstitute.com/; (iv) "Your Website" refers to any websites (your website or a third party website) that you will link to Our Website; (v) "Program" refers to
this Financial Modeling Institute Inc Affiliate Program.



2.         Affiliate Obligations. Affiliate will fulfill its obligations by acting as affiliate and promoting FMI's programs and accreditations, all as more particularly described herein. In performing its obligations herein, Affiliate shall adhere to the FMI Code of Ethics and Professional Conduct (https://fminstitute.com/code-of-conduct).



3.         Intellectual Property Rights. You acknowledge and agree that we own all rights, titles and interests in Our Websites and materials and content found therein.  Further, we own any logos, trademarks or tradenames found on Our Websites or as otherwise identified by us. The parameters of any use of FMI's logos, trademarks or tradenames will be clearly set out by FMI in writing. If applicable, Affiliate may use such logos, trademarks or tradenames exactly as provided by FMI. Use of any of our copyrighted and trademarked terms as part of the domain or subdomain for Your Website is strictly prohibited i.e. fmi.website.com or www.fmi-coupons.com



4.         Limitation of Liability. We assume no liability to you whatsoever, including without limitation, direct, indirect, consequential, special, punitive or exemplary damages in connection with your participation in the Program.



5.         Indemnities. You agree to indemnify, defend and hold us and our affiliates and each of our respective directors, officers and personnel harmless from and against all losses, costs, damages, expenses and liabilities whatsoever (including reasonable legal fees) which may be suffered or incurred by us or our affiliates arising out of or as a result of or relating in any manner whatsoever in connection with your participation in the Program.



6.         No Spam. Affiliate may not use any Qualifying Links in any electronic message without the express written authorization of the FMI. If so permitted, electronic messages: (i) must comply in all respects with this Agreement, the FMI's terms and conditions, and any applicable laws regarding the delivery of unsolicited electronic communications, also known as SPAM; and (ii) must not identify FMI as a sender or sponsor of such electronic message without the express written authorization of FMI.



7.         Taxes. Affiliate is responsible for determining the applicability of certain tax laws depending on the location of their
operations, the scope of their activity, and other applicable criteria. Affiliate agrees to comply with all applicable tax laws, and Affiliate is solely responsible for any tax obligations, including reporting, arising from or in connection with any compensation earned by Affiliate.



8.         Termination. In our sole discretion, we may terminate the Program and your affiliation with our Program at any time upon written notice to you. Upon termination, you shall remove all references to us, including our logos, trademarks or tradenames, from any internal or publicly available website or other online presence. Sections 3, 4 and 5 will survive the termination of your participation in the Program along with any other provision in these Terms that was intended to survive.



9.         The Program and your affiliation with it will be governed by and construed in accordance with the laws of the Province of
Ontario and the federal laws of Canada applicable therein.



General


  • You will be bound by the following:


  • You can place our banners anywhere on Your Website as you see fit, or within non-spam emails.


  • Adult, Hate, or other related sites are not allowed, as determined by us in our sole discretion.


  • You are not permitted to link directly to Our Websites outside of the Affiliate Window platform.


  • If you are creating product links, please be sure to take these from the product feed. Links taken from other sources may result in commissions being declined as they are identified as coming from a different channel. You CANNOT take content directly from FMI, which is not present on the product feed or on the Offer section.


  • Any page containing our links, banners, or codes must be written in English.


You may place banners or links within your newsletters, in content of Your Website, or within other web related content.

NOT ALLOWED: Any placement of creative in a "Desktop" advertising scheme. This includes any and all 3rd party advertising platforms that use a desktop application to display ads in any form.

NOT ALLOWED: Any display of a merchant window that isn't the result of a direct click by the end-user.

Failure to abide by these rules could mean the suspension of your collaboration with a complete forfeit of commissions and/or our termination of your participation in the Program.

Fraud is a serious offense, and will be treated as such. Fraud is defined as any action that intentionally attempts to create sales, leads, or click-throughs using robots, frames, iframes, scripts, or manually "refreshing" of pages, for the sole purpose of creating commissions. ANY ATTEMPTED FRAUD OR FRAUD WILL RESULT IN MEMBERSHIP TERMINATION AND VOIDED COMMISSIONS.

Affiliates MUST NOT register/buy or use domains that users may believe are associated or otherwise affiliated with Financial Modeling Institute.

Affiliates may not create websites that may impersonate the Financial Modeling Institute website.

Affiliates are not allowed to buy, register or create domains or subdomains which may mislead users to believe that such a site is Our Website.

Affiliates are not allowed to supplant by any means our identity in social media.

Affiliates must be easily identified by users in any promotion in social media.

Affiliates may ONLY advertise coupon codes that are distributed by us. Any sales registered through other coupon codes will not be considered as valid and will be canceled.

Affiliates are not allowed to promote coupon codes that have not been issued via the affiliate channel.

If you cannot or do not wish to abide by these T&C or you have proposals which are not contemplated here, please contact us at

Linking To Our Website

Upon acceptance into the Program, links will be made available to you through the Affiliate Window interface. You agree that you will only use linking code obtained from Affiliate Window without manipulation. Also, please ensure that all domains where you use our link are listed in your affiliate network profile.



You hereby agree that Your Website will not in any way copy, resemble, or mirror the look and feel of Our Website. You will also not use any means to create the impression that Your Website is Our Website or any part of Our Website including, without limitation, framing of Our Website in any manner. Cookie stuffing, pop-ups, and false or misleading links are strictly prohibited. In addition, wherever possible, you will not attempt to mask the referring url information (i.e. the page from where the click is originating). Using redirects to bounce a click off of a domain where the click did not originate in order to give the appearance that it came from that domain is expressly prohibited and is a direct violation of the program. This does not include using "out" redirects from the same domain where the affiliate link is placed.



SEO Policy

The use of the word 'FMI', 'Financial Modeling Institute', 'AFM', 'Advanced Financial Modeler' or misspellings is not allowed in the
following parts of the landing page:



  • Domain Name / URL of the page / Page title.


  • Meta description / , ,

    or

    tags / ALT text of any image in the page

The word 'FMI' or misspellings may only appear in the body text of the page a maximum of 2 times. - Our goal is to protect the Financial Modeling Institute brand and the Affiliate should not appear in the first top 6 positions in any brand-search in Google.





  • Example 1: Blog that uses "FMI" 2 times in the text --> OK


  • Example 2: Blogs that want to use "FMI" 3 times. --> OK as long as it doesn't appear in the first 6 position in Google for "FMI" single-keyword




It is important that all links redirected to our website are labeled as "nofollow"



We need to include the "nofollow" tag in your code using the "rel" tag: anchor text here



PPC Bidding Rules

You are not allowed to use branded search terms for the company or its products. Examples include:

If you are enrolled in our Program and participate in PPC advertising, you must adhere to our PPC Guidelines as follows:





  • You may not bid on any of our trademarked terms, including any variations or misspellings thereof for search or content based campaigns on Google, Yahoo, Bing, Ask or any other network.


  • You may not use our trademark terms in sequence with any other keyword (i.e. fminstitute.com Coupons).


  • You may not use our trademarked terms in your ad title, ad copy, display name or as the display url.




If you automate your PPC campaigns, it is your responsibility to exclude our trademark terms from your program and we strongly suggest you add our trademarked terms as negative keywords. We have a strict no tolerance policy on PPC trademark bidding. In our sole discretion, if we are of the view that you have violated this policy, we will not pay out any commissions for a minimum of the past 30 days.



Current trademarked & copyright terms include: fmi, fminstitute.com, www.fminstitute.com, FM Institute, Financial Modeling Institute, Advanced Financial Modeler, AFM, Foundations in Financial Modeling. We may update this list may be from time to time.



Advertising & Publicity

You shall not create, publish, distribute, or permit any written material that makes reference to our Program without first submitting such material to us and receiving our prior written consent. If you intend to promote our Program via email campaigns, you must adhere to the following:





  • Abide by the Privacy and Electronic Communications Regulations of 2003 (Regulations 22 and 23) with respect to our Program.


  • E-mail must be sent on your behalf and must not imply that the email is being sent on behalf of fminstitute.com


  • E-mails must first be submitted to us for approval prior to being sent or we must be sent a copy of the e-mail.




*Please note that commission will only be awarded for promotional offers on Affiliate Window. Manually entered promotional codes, or
offers promoted elsewhere will not be awarded commission.



Social Media Policy

If you are using the FMI logo, branding you are only permitted to use approved creative provided by the FMI and in the ways in which FMI may permit.



Coupons and Deals Policy

The FMI will provide you with new coupons and deals each month for marketing purposes. Our coupons expire regularly, so it is your responsibility to only use current coupons and ensure that they are updated regularly.



If you are enrolled in our Program and Your Website promotes coupon codes, you must adhere to our Coupon Guidelines as follows:





  • You may ONLY advertise coupon codes that are provided to you through Affiliate Window.


  • You may NOT advertise coupon codes obtained from our non-affiliate advertising, customer e-mails, paid search, or any other
    campaign.


  • On click through, you must link directly to Our Website. Framing of Our Website is strictly prohibited.




Cookie Stuffing: You must not mislead customers into clicking on an offer/coupon that does not exist or practice similarly deceptive tactics which are generally accepted as "cookie stuffing." These include, but are not limited to using knowingly expired offers, presenting offers that do not exist, presenting a button that claims to show all offers which sets the affiliate cookie, and technology which generates a click/sets the cookie from the action of copying a coupon code.



Unless you have been given express written permission, if you are found to be engaging in any of the aforementioned practices, we reserve the right to reverse any/all sales generated. Only discount codes approved for the affiliate channel will be approved at the full 20% commission. Transactions including non-affiliate approved discount codes, may be honored at a lower commission rate. If Your Website participates in forums where active users of Your Website can submit coupon codes, it is your responsibility to ensure that the
coupon codes submitted do not violate our Coupon Guidelines.



Email Contact

We reserve the right to send email to you for the purposes of informing you of applicable changes or additions to the Program or related products and services.



Changes to the Program

We reserve the right to change, modify, add or remove portions of these T&Cs at any time and may add to, change, suspend or discontinue any aspect of the Program at any time. In the event of any material change, we will notify you via email, newsletter or at least 30 days prior to any such changes taking effect, at which time you may either agree to such changes or withdraw from the Program.



Cookies

FMI operates a 30 day-cookie policy.



Privacy Policy
