Affiliates Terms and Conditions – Haven Caravan Sales
Promotional Activity:
1. From time-to-time Haven will communicate the details of promotional activity to the Publishers for their consideration on an opt in basis. These promotions may include increased rates of commission, discounts or other enhancements designed to increase sales / engagement at a given time and for a specific period.
2. Haven reserves the right to terminate promotional activity on notice to the Publishers at any time.
Intellectual Property (IP):
1. Intellectual Property (IP) includes any logos, business names, trademarks (whether registered or unregistered), internet domain names, copyright, and moral rights, and the right to sue for passing off and any other rights equivalent to any of the foregoing in any jurisdiction world-wide and any application for registering the foregoing.
2. Haven will issue approved marketing images, copy, logos and URL links along with any other assets deemed necessary for use by the Publishers either on the AWIN platform or directly to the Publishers via email or an agreed document transfer platform.
3. Haven hereby grants the Publisher a right to use its IP as expressly defined above for the purposes only of exercising its rights and complying with its obligations in relation to the authorised promotional activity.
4. Any Publisher found to be using Haven IP beyond that permitted above will be notified by Haven or AWIN on Haven’s behalf and then, within an expressed time period (depending on the severity of the infraction), suspended and or removed from the programme permanently.
5. The Parties hereby acknowledge that neither shall acquire rights in the other’s IP by virtue of any act in connection with the marketing. Any and all of the Parties’ IP shall at all times remain the sole and absolute property of that Party.
6. The Publisher will not permit any third party to use Haven’s IP without the prior written consent of Haven.
Brand / Trademark Bidding:
1. Haven do not allow any Publishers to undertake trademark or brand bidding across any search engines and/or devices. This exclusion includes but is not limited to:
1.1 bidding on Haven parks and misspelling and/or extensions of the brands i.e., Haven, Haven Holidays, Haven Caravan Sales, Haven Holiday Home Ownership, Haven holidays UK etc.
1.2 bidding on the Haven website address i.e., Haven.co.uk and/or
1.3 undertaking trademark + bidding i.e., Haven discounts, Haven parks activities etc.
How to make sure you are not flagged for PPC bidding? We recommend that you add Haven and common misspelling as broad match negative terms to all paid search campaigns.
Any Publishers found breaching Haven brand / trademark terms will be notified by Haven or AWIN on Haven’s behalf and then, within an expressed time period (depending on the severity of the infraction), suspended and or removed from the programme permanently.
General Behaviour:
1. Publishers will be audited by Haven from time to time and any concerns will be notified to the Publisher.
2. Publishers will endeavour at all times to present Haven content and IP professionally and without error including but not limited to the correct size and shape images, correctly spelled copy and avoidance of colloquialisms and no use of swearing.
3. Haven will not tolerate any connection, be it direct, indirect or implied, to content that is deemed at the express opinion of Haven to be:
3.1 discriminatory in any way;
3.2 sexual in nature;
3.3 linked to gambling;
3.4 linked to drug-taking;
3.5 overtly linked to politics;
3.6 encourages violence; and/or
would generally be deemed inappropriate at the express opinion of Haven.
4. Any Publisher found breaching this general behaviour section will be notified by Haven or AWIN on Haven’s behalf and then, within an expressed time period (depending on the severity of the infraction), suspended and or removed from the programme permanently.
Caravan Sales Validation Process
Validation will work in line with the following;
1.a Cookie tracking window is 30 days post click on Publisher content
1.a.i The guest journey is;
1.a.i.1 firstly, to register their interest in Caravan Ownership with Haven and;
1.a.i.2 to arrange a visit to a Haven park and to complete a Caravan Sales meeting
1.b Once the guest has registered with Haven (becomes a ‘Lead’) the Lead then has a period of (max) 12 months in which to book and attend a Caravan Sales meeting at a Haven park.
1.b.i Should the Lead already exist within the Haven database (from any source), then the Lead will remain attributable to the originating source / publisher.
1.c If within the 12-month period the valid Lead arranges a visit to (any) park and on the day of the visit, arrives at the park and completes the arranged meeting with the Haven Caravan Sales representative, then a validation will be triggered for the Publisher;
1.c.i Payments will be processed 30 days after each completed Caravan Sales meeting, less any duplicated Leads (B,i), any periods beyond the allotted 12 month validation window (B) and upon confirmation from the park that the meeting was completed by the expected Lead.
1.c.ii Payments will be made via the AWIN platform.
1.d For clarity, Haven will only pay commissions for fully validated completed sales meetings at Haven parks and not for brochure requests, general requests or completed sales / future upgrades, site fee payments, part exchanges or any other transaction occurring between a prospective Caravan Owner (a Lead) or a Caravan Owner.
Commission Payments:
Publishers are eligible for commission payments at the prevailing rates from Haven on the basis that:
1. Publishers adhere to all the terms listed in this document; and
2. confirmed caravan sales appointments originated directly from the Publishers have:
2.1 been booked and tracked successfully via an official affiliate link;
2.2 not been cancelled by the guest; and
3. the guest has arrived for and completed their caravan sales meeting.
4. Any Publishers found breaching this Commission Payments section will be notified by Haven or AWIN on Haven’s behalf. Commissions are offered to Publishers on a goodwill basis and abuse of this goodwill could result in declined Commission Payments and/or removal from the programme.
5. In the case of Commission Payment disputes, Haven will take reasonable steps to investigate the claims but Haven decisions in the matter of Commission Payment disputes will be final.
