I. General Terms and Conditions
§ 1 Basic provisions
(1) The following terms and conditions apply to contracts that you conclude with us as a provider (Pakama Athletics GmbH) via the website pakama-athletics.com/. Unless otherwise agreed, the inclusion of any of your own terms and conditions used by you will be objected to.
(2) A consumer within the meaning of the following regulations is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his independent professional or commercial activity.
§ 2 Conclusion of the contract
(1) The object of the contract is the sale of goods.
(2) Already with the listing of the respective product on our website, we submit a binding offer to you to conclude a contract under the conditions specified in the article description.
(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are stored in the "shopping cart". Via the corresponding button in the navigation bar you can call up the "shopping cart" and make changes there at any time.
After calling up the "Checkout" page and entering the personal data as well as the payment and shipping conditions, all order data will be displayed again on the order overview page.
If you use an instant payment system (e.g. PayPal / PayPal Express, Amazon Payments, Sofort) as a payment method, you will either be led to the order overview page in our online shop or you will first be redirected to the website of the provider of the instant payment system.
If the forwarding takes place to the respective instant payment system, make the appropriate selection or entry of your data there. Finally, you will be redirected back to our online shop on the order overview page.
Before sending the order, you have the option of checking all information again, changing it (also via the "back" function of the Internet browser) or cancelling the purchase.
By submitting the order via the button "order with obligation to pay" you declare the acceptance of the offer in a legally binding manner, whereby the contract is concluded.
(4) The processing of the order and transmission of all information required in connection with the conclusion of the contract is partly automated by e-mail. You must therefore ensure that the e-mail address you have stored with us is correct, that the receipt of the e-mails is technically ensured and, in particular, that spam filters do not prevent it.
Legal background:
If you use an immediate payment method, payment will be requested during the ordering process or shortly after ordering.
Therefore, when using instant payment methods in the online shop,
lead the customer's order to the conclusion of the contract without the need for a separate express acceptance of the contract. This in turn means that your offers in the online shop must be binding. Otherwise, the customer would pay in advance without knowing whether the contract will actually be accepted by you.
Please note:
The binding nature of the offer applies in accordance with the provision in § 2 of the GTC for all offers that are available via the shopping cart, even if the customer does not use an immediate payment method.

for the tested shop. Please download the terms and conditions / customer information again and set them in the shop. Please remember to use the terms and conditions that you send to the customer after ordering also in the new version.
Please note:
All you have to do now is send the customer an e-mail immediately after placing an order confirming the order and the conclusion of the contract. Attach the terms and conditions / customer information, the cancellation policy together with the sample revocation form and the imprint data to this e-mail. If you choose the pdf format, a reference to a free pdf reader must be included in the e-mail.

§ 3 Conclusion of the contract for download products
(1) The subject matter of the contract is the sale of download products (digital content that is not delivered on a physical data carrier).
Already with the posting of the respective download product on our website, we submit a binding offer to you to conclude a contract under the conditions specified in the article description.
(2) The contract is concluded via the online shopping cart system as follows:
The download products intended for purchase are stored in the "shopping cart". Via the corresponding button in the navigation bar you can call up the "shopping cart" and make changes there at any time. After calling up the "Checkout" page and entering the personal data and the terms of payment, all order data will be displayed again on the order overview page.

§ 4 WIDERRUFSBELEHRUNG
Sofern Sie Verbraucher im Sinne des § 13 BGB sind, die Bestellung also zu einem Zweck vornehmen, der weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden kann, gilt folgende Widerrufsbelehrung:
(1) Widerrufsrecht
Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) oder - wenn Ihnen die Sache vor Fristablauf überlassen wird – auch durch Rücksendung der Sache widerrufen. Ihre Ware senden Sie bitte an Optima Global GmbH, Charlottenstrasse 120, 45289 Essen, Germany.
Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) oder vor Vertragsschluss (bei der Erbringung von Dienstleistungen) und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Absatz 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312g Absatz 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. (2) Widerrufsfolgen
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und gegebenenfalls gezogene Nutzungen (z.B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung sowie Nutzungen (z.B. Gebrauchsvorteile) nicht oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren bzw. herausgeben, müssen Sie uns insoweit Wertersatz leisten. Bei der Erbringung von Dienstleistungen kann dies dazu führen, dass Sie die vertraglichen Zahlungsverpflichtungen für den Zeitraum bis zum Widerruf gleichwohl erfüllen müssen. Für die Verschlechterung der Sache und für gezogene Nutzungen müssen Sie Wertersatz nur leisten, soweit die Nutzungen oder die Verschlechterung auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter "Prüfung der Eigenschaften und der Funktionsweise" versteht man das Testen und Ausprobieren der jeweiligen Ware, wie es etwa im Ladengeschäft möglich und üblich ist, ohne dass dabei Gebrauchsspuren entstehen. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.
§ 5 Rückversand / Rücknahme
(1) Findet gemäß unserer Widerrufsbelehrung (§ 4) ein Rückversand der Ware statt, so gelten die dort enthalten Bedingungen für den Rückversand.
(2) Der Kunde hat die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht. Andernfalls trägt die Pakama Athletics GmbH die Kosten der Rücksendung.
(3) Ihre Ware senden Sie bitte an Optima Global GmbH, Charlottenstrasse 120, 45289 Essen, Germany.
§ 6 Nutzungslizenz bei Download-Produkten
(1) Die angebotenen Download-Produkte sind urheberrechtlich geschützt. Sie erhalten zu jedem bei uns erworbenen Download-Produkt eine einfache Nutzungslizenz, soweit im jeweiligen Angebot nichts anderes angegeben ist.
(2) Die einfache Nutzungslizenz umfasst die Erlaubnis, eine Kopie des Download-Produkts für Ihren persönlichen Gebrauch auf Ihrem Computer bzw. sonstigem elektronischen Gerät abzuspeichern und/oder auszudrucken.
Jede weitere Kopie ist Ihnen untersagt. Es ist Ihnen ausdrücklich verboten, eine Datei oder Teile davon zu verändern oder zu bearbeiten und in irgendeiner Weise Dritten privat oder kommerziell zur Verfügung zu stellen.
§ 7 Vertragslaufzeit / Kündigung bei Abonnement-Verträgen
(1) Der zwischen Ihnen und uns geschlossene Abonnement-Vertrag hat die vereinbarte Laufzeit. Wird der Vertrag nicht 3 Wochen vor Vertragsende (soweit im jeweiligen Angebot keine andere Frist geregelt ist) von einer der Parteien in Textform (z.B. E-Mail) gekündigt, verlängert er sich stillschweigend jeweils um die vereinbarte Grundlaufzeit. Beträgt die Grundlaufzeit mehr als ein Jahr, verlängert sich der Vertrag jedoch jeweils nur um ein Jahr.
(2) Das Recht zur fristlosen Kündigung aus wichtigem Grund bleibt hiervon unberührt.
§ 8 Zustandekommen des Vertrages bei Kursen
(1) Gegenstand des Vertrages ist die Durchführung von Kursen.
Bereits mit dem Einstellen des jeweiligen Kursangebots auf unserer Internetseite unterbreiten wir Ihnen ein verbindliches Angebot zum Abschluss eines Vertrages zu den in der jeweiligen Kursbeschreibung angegebenen Bedingungen.
(2) Der Vertrag kommt über das Online-Warenkorbsystem wie folgt zustande:

§ 9 Provision of services for courses
(1) The courses are held in the form described in the respective offers on the agreed dates.
(2) Insofar as the implementation of the courses depends on the number of participants, the minimum number of participants results from the respective offer.
If the minimum number of participants is not reached, we will inform you at least 7 days before the start of the course in text form (e.g. by e-mail) about the non-occurrence of the booked course. In this case, any services already provided will be refunded immediately.
(3) In the event of cancellation of an individual event due to short-term absence of the course instructor due to illness or for other important reasons, the services already provided will be refunded immediately.
In the case of events consisting of several event dates, in the event of cancellation of an appointment due to short-term absence of the course instructor due to illness or for other important reasons, the cancelled appointment will be made up on an alternative date.
(4) In connection with the use of course rooms and objects, you must comply with the local house rules. You must follow our instructions or the instructions of the course instructor.
§ 10 Special agreements on offered payment methods
(1) Payment by invoice via Klarna Germany
In cooperation with Klarna, we offer you the purchase on account as a payment option. The payment period is 14 days from the invoice date. The invoice is issued when the goods are shipped and sent either by e-mail or together with the goods. Payment is made to Klarna. Please note that Klarna bill is only available to consumers. Privacy policy
Klarna checks and evaluates your data and, if there is a legitimate interest and occasion, maintains a data exchange with other companies and credit agencies. Your personal data will be processed in accordance with the applicable
Data protection provisions and in accordance with the information in the Klarna Privacy Policy.
§ 11 Right of retention, retention of title
(1) You can only exercise a right of retention if it concerns claims from the same contractual relationship.
(2) The goods remain our property until full payment of the purchase price.
§ 12 Warranty
(1) The statutory warranty rights exist.
(2) As a consumer, you are requested to check the item immediately upon delivery for completeness, obvious defects and transport damage and to inform us and the freight forwarder of any complaints as soon as possible. If you do not comply with this, this will have no effect on your statutory warranty claims.
§ 13 Choice of law, place of performance, place of jurisdiction
(1) German law shall apply. In the case of consumers, this choice of law shall only apply insofar as this does not withdraw the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence (principle of favourability).
(2) The place of performance for all services arising from the existing business relationships with us as well as the place of jurisdiction is our registered office, insofar as you are not a consumer, but a merchant, a legal entity under public law or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if the domicile or habitual residence is not known at the time the action is brought. The right to appeal to the court at another statutory place of jurisdiction remains unaffected by this.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.
