Section 1 Scope
These General Terms and Conditions apply to participation in the affiliate partner program of Just Spices GmbH, hereinafter referred to as the "Advertiser."
Section 2 Object of the Contract
The Advertiser offers an affiliate partner program where partners receive a percentage commission for successful sales generated through their affiliate links. The exact commission rate is determined in the individual partner contract.
Section 3 Participation Requirements
- The partner is obliged to include all of the Advertiser's brand keywords as negative keywords according to the guidelines in the "Branding" tab. All brand keywords are to be excluded as "Exact" and “Phrase.”
- Participation of voucher publishers is not permitted.
- Participation of cashback publishers is not permitted.
- Participation of discount publishers is not permitted.
- Participation of display (retargeting) publishers is not permitted.
Section 4 Sanctions for Violation of Participation Requirements
In the event of a violation of one or more of the participation requirements stated in Section 3, the Advertiser reserves the right to:
- Cancel all outstanding commissions of the respective partner.
- Remove the respective partner from the partner program without prior notice.
- Revoke the respective partner's right to future commission.
Section 5 Commission Payments
- The partner will be credited with the commission for each successful sale made through the affiliate link generated by them.
- Billing and payment of commissions occur monthly, unless otherwise agreed upon.
- The partner is responsible for properly taxing the received commissions.
Section 6 Deduplication and Exclusion of Coupon Codes
(a) Deduplication: The Advertiser reserves the right to perform deduplication when observing CPC, SMP, or the ?gclid parameter during the customer journey. This deduplication aims to ensure that no commissions are paid to multiple sources for the same sale.
(b) Exclusion of Coupon Codes: In particular, coupon codes starting with "JUST-," "CB-," or "SOV-" are generally excluded from commission calculation. Partners using such coupon codes are not entitled to the corresponding commission payment for the respective transactions.
Section 7 Confidentiality
Partners commit to confidentiality regarding all knowledge and information acquired within the partnership.
Section 8 Liability
The liability of the Advertiser is, as far as legally permissible, limited to intent and gross negligence.
Section 9 Changes to the Terms and Conditions
The Advertiser reserves the right to change these terms and conditions at any time. Partners will be informed of changes in a timely manner.
Section 10 Final Provisions
Should individual provisions of these terms and conditions be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected.
