Penelope Chilvers Affiliate Programme – General Terms & Conditions
1. Programme Overview These terms govern participation in the affiliate programme operated by Penelope Chilvers Limited (69 Duke Street, Mayfair, London W1K 5NX) via the Awin network. They apply in addition to the Awin Publisher Master Service Agreement, the Penelope Chilvers website Terms & Conditions, and the policies set out in the PPC, Transactions, Branding, Publishers, Notice Periods and De-Duplication tabs of this profile. We may amend these terms at any time, with changes effective on publication.
2. Application & Approval All publishers are reviewed and approved at our sole discretion. We may decline or remove any publisher whose website, audience or promotional methods do not align with the brand. Approval does not constitute endorsement of your website or content.
3. Brand Representation Penelope Chilvers is a premium footwear and accessories brand combining contemporary, fashion-led design with enduring style and traditional craftsmanship, and all promotion must reflect this positioning. Publishers must represent the brand accurately and must not make false, misleading or exaggerated claims about products, pricing, promotions or availability.
4. Approved Publisher Types We welcome content, cashback, loyalty, community, email, search and media broker publishers. The Discount Code publisher category is not accepted, and behavioural retargeting is not permitted. Publishers must only promote within the type for which they were approved.
5. Commission Basis Commission is paid on validated, confirmed sales at the rate published in the Awin interface. The transaction value used to calculate commission excludes VAT/sales tax, delivery charges, credit card fees, and gift wrapping or other service charges. Where an order is returned, commission is calculated on the discounted price actually paid.
6. Declined Commission Commission will be declined where an order is cancelled, returned, found to be a duplicate, fails a credit check, relates to an out-of-stock item, or where these terms or the wider programme terms have been breached. We reserve the right to refuse or cancel any order we deem invalid or fraudulent, and to decline commission for other valid reasons in line with network rules.
7. Promotions, Voucher & Discount Codes Only codes supplied directly by Penelope Chilvers or distributed through Awin may be used. Publishers must not generate, guess, distribute or use unauthorised, expired or staff codes, nor present non-working codes as valid. Only one promotional code may be used per order, codes are valid for a limited time only, and some promotional products cannot be combined with other offers or codes. We reserve the right to cancel any offer, limit code redemptions, or refuse any individual's benefit from an offer at any time.
8. Paid Search / PPC PPC is not permitted except for approved CSS (Comparison Shopping Service) partners. Publishers must not bid on "Penelope Chilvers," any misspellings, variations or combinations (e.g. "Penelope Chilvers discount code"), and must not use the brand name in their display URL, ad title or description. The brand name and common variations must be added to negative keyword lists. Any unauthorised brand bidding will result in termination of the partnership and forfeiture of associated commission.
9. Trademarks & Intellectual Property The Penelope Chilvers name, logo, product imagery and other brand assets remain the property of Penelope Chilvers Limited and may only be used as supplied via the Awin programme, without alteration. Any other use requires our prior written permission, which may be withdrawn at any time.
10. Promotional Standards Publishers must not use spam, unsolicited email, cookie-stuffing, forced clicks, adware, malware or any technology that artificially sets tracking cookies, must not misrepresent themselves as Penelope Chilvers, and must not promote the brand alongside illegal, defamatory, discriminatory, adult or otherwise objectionable content.
11. Tracking & Compliance Publishers are responsible for correct implementation of links and tracking. We are not liable for commission on sales that fail to track due to publisher error, and we reserve the right to audit activity and to withhold or reverse commission where these terms are breached.
12. Termination We may suspend or remove any publisher at any time, with or without notice, for breach of these terms or at our discretion in line with the notice periods set out in this profile. Commission earned through fraudulent or non-compliant activity will be forfeited.
