Eventim Terms and Conditions
Awin LTD 2025 (“Awin”) operates a global affiliate platform between advertisers and publishers. The following terms and conditions govern your (“you”, “your”, “publisher” as required) conduct associated with the affiliate account of Eventim UK Limited (“Eventim”) administered by Awin as part of the affiliate platform (“Affiliate Programme”).
Under the Affiliate Programme, Awin may provide you with links to Eventim’s website (“Link”) and associated content including event listings, dates, times, artists and organisers relating to an event (“Eventim Content”), for the purpose of you publishing the Link on your website allowing users of your website to purchase tickets from Eventim by accessing the Link (“Tickets”). By participating in the Affiliate Programme with Eventim you agree to be bound by these terms.
Publisher Obligations
You warrant, represent and undertake to Eventim that at all times when you display the Link and/or Eventim Content on your website, you shall not display or permit to be displayed on your website, any content considered by Eventim to be libellous, defamatory, against public morals, infringing any third-party rights (including, without limitation, intellectual property rights), is otherwise illegal or causes damage or injury to any person or property or that could bring Eventim or any of its affiliated companies into disrepute.
You further agree and undertake to Eventim that you shall not:
- engage in, or permit, any other use or disclosure of the Link and/or Eventim Content by it or any third party;
- sell, lease, licence, sub-licence, copy, market or distribute any Eventim Content and/or Link;
- remove or alter any trademark, trade name, service mark, domain name, logo, copyright or other proprietary notice of Eventim;
- legend, symbol or label or any other distinctive brand feature from any Link and/or Eventim Content;
- in any way modify, redirect, suppress or substitute the operation of any Link or other interactive feature of Eventim’s website;
- attempt to artificially increase the commission payable to you by Awin;
- purchase or register any trade marks, search engine keywords, AdWords, search terms or other identifying terms that include the brand “Eventim” or any similar or confusingly similar word or any derivative thereof;
- use automated means to generate the impression of users accessing the Link, such as spiders, scripts or other non-human agents;
- offer any cash or equivalent incentives (such as gift cards) to users who view or interact with the Link;
- itself purchase Tickets via a Link or otherwise for the purposes of re-sale or other commercial use;
- take any action that could reasonably cause any end user confusion as to your relationship with Eventim; and/or
- use any other method whatsoever designed to fraudulently, deceptively or artificially inflate the number of impressions, clicks or other measurable actions on the Link.
You agree to indemnify and hold Eventim (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers) harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, including reasonable legal fees, as result of any of your actions or omissions in breach of these terms, or your violation of any law or the rights of a third party or any claim of whatsoever nature arising out of or in connection with your use of the Link and/or Eventim Content.
Please note affiliates on the Eventim programme are unable to subcontract the data contained in the Eventim feed to third parties.
Commissions
As an Eventim affiliate, you send traffic to Eventim’s website through Links which allow Eventim to track and monitor your referred traffic. Once a qualifying transaction occurs as a result of your referral, you will earn a commission. Eventim reserves the right to exclude certain Links and events from being qualifying completely or for set periods of time. Eventim will use reasonable endeavours to give you advance notification of these excluded events and for what periods. Whereby a qualifying transaction has been processed but Eventim deems it is not qualifying or breaches any of these terms, Eventim will promptly investigate and notify you an appropriate outcome.
All commissions are ex transaction costs and delivery fees
Commissions will not be payable with respect to sales of any other products or services or any purchases made over the phone or for any sales for events that are subsequently cancelled by the promoter post purchase.
Intellectual Property
All Eventim Content, trademarks, data and intellectual property are owned by Eventim. Eventim and Eventim’s licensors, reserve all rights in any intellectual property in connection with these terms and conditions. Eventim grants you a non-exclusive, non-sublicensable, non-transferable, royalty-free licence to use the Eventim Content made available to you solely for the purpose of the Affiliate Programme in accordance with these Terms.
Confidentiality
If you choose, or you are provided with, a username, password or any other piece of information as part of the Affiliate Programme, you must treat such information as confidential. You must ensure that our confidential information is not disclosed or distributed to any third party.
Data Protection
Eventim, Awin and the publisher are joint controllers for any personal data it processes under these terms and shall comply with all applicable data protection laws.
The publisher uses affiliate tracking technology provided by Awin. This may involve the use of cookies or similar technologies or track user interactions and attribute commissions. These cookies typically last for up to 30 days. You shall ensure that appropriate user consent is obtained before placing or enabling any non-essential cookies including Awin tracking cookies in accordance with the applicable data protection laws.
Liability
Eventim shall have no liability to you for any loss or any damages which may be suffered or incurred or which may arise directly or indirectly in respect of the Affiliate Programme but not limited to caused by your failure or inability to insert Links or if there is any deficiency, unavailability or inaccuracy in the Eventim Content.
Eventim shall have no liability to you for any breach of these terms caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; and flood, fire, explosion or accident.
Eventim have no liability to you for any unforeseeable loss or damage, such as loss of profit, loss of business, business interruption, or loss of business opportunity.
You shall indemnify us in the event that Eventim incurs any claims, costs, damages, losses, or other liability as result of any your actions or omissions at any date, or through using the Eventim Content in breach of these terms.
Nothing in these terms excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or any other liability that cannot be validly limited or excluded from applicable law.
General
The Terms do not create or infer any rights that are enforceable by any person who is not a party to them.
Eventim may transfer our rights and obligations under these Terms to another organisation, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or obligations under these terms to another person if Eventim agrees in writing.
If Eventim decides not to exercise or enforce any right that Eventim has against you at a particular time, then this does not prevent Eventim from later deciding to exercise or enforce that right.
Each of the conditions of these terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
