ThePhoneLab Affiliate Programma – Algemene Voorwaarden
Deze voorwaarden zijn van toepassing op deelname aan het ThePhoneLab Affiliate Programma op het Awin platform en vormen een aanvulling op de algemene voorwaarden van Awin. Lees deze voorwaarden aandachtig door voordat u zich aanmeldt, zodat u alle regels kunt begrijpen en accepteren.
Elke overtreding van deze voorwaarden door een geregistreerde partner kan leiden tot onmiddellijke uitsluiting uit het affiliate programma en annulering van alle openstaande commissies.
1. Geschiktheidsvereisten
- Deelname is voorbehouden aan publishers van minimaal 18 jaar oud die volledig handelingsbekwaam zijn.
- Websites met politieke, gok-, gewelddadige, pornografische of illegale inhoud zijn uitgesloten van deelname.
- Websites die in aanbouw zijn of foutmeldingen vertonen, worden niet goedgekeurd. Voorafgaande controle van de website is vereist.
- White label winkels en white label prijszoekmachines worden niet geaccepteerd en leiden tot verwijdering uit het programma.
- Banner netwerken, betaalde mailers en laadlagen (layer advertenties) zijn niet toegestaan.
2. Gebruik van Merknaam & Domeinen
- Het is niet toegestaan om domeinen te registreren of te gebruiken die "ThePhoneLab" bevatten, inclusief spelfouten of varianten daarvan, zonder voorafgaande schriftelijke toestemming van ThePhoneLab.
- Directe kopieën of nabootsingen van de ThePhoneLab website zijn verboden.
- Het gebruik van de productfeed voor winkelachtige constructies buiten de eigen website is niet toegestaan zonder expliciete goedkeuring.
3. Advertentiemateriaal
- Al het door ThePhoneLab aangeleverde advertentiemateriaal (banners, logo's, productafbeeldingen) is auteursrechtelijk beschermd en mag uitsluitend worden gebruikt op de bij aanmelding geregistreerde websites.
- Wijziging of uitbreiding van het beschikbaar gestelde advertentiemateriaal is niet toegestaan zonder voorafgaande toestemming.
- De publisher is verantwoordelijk voor het actueel houden van het advertentiemateriaal en dient dit onverwijld te verwijderen zodra ThePhoneLab hierom verzoekt.
- Het gebruik van pop-ups of lagen die worden geactiveerd bij het laden van een pagina is niet toegestaan.
4. Productfeed
- Het is niet toegestaan de door ThePhoneLab aangeleverde productdatafeed te gebruiken op platforms van derden (zoals Google Shopping) zonder expliciete goedkeuring.
- De publisher dient altijd de meest recente versie van de productfeed te gebruiken en deze dagelijks bij te werken.
- De publisher is verantwoordelijk voor eventuele onjuiste informatie en de juridische gevolgen die daaruit voortvloeien.
5. Search Engine Advertising (SEA & CSS)
- Het is niet toegestaan om direct verkeer door te sturen naar de ThePhoneLab website via betaald zoekverkeer zonder voorafgaande toestemming.
- Adverteren op merkgerelateerde zoekwoorden in alle zoekmachines is verboden. De volgende zoekwoorden dienen als negatieve zoekwoorden te worden toegevoegd:

- the phone lab
- thephonelab kortingscode
- kortingscode thephonelab
- thephonelab shop
- thephonelab winkel
- thephonelab online
- thephonelab nl
- thephonelab aanbieding
- Google CSS is niet toegestaan, tenzij hiervoor expliciete schriftelijke toestemming is verkregen van ThePhoneLab.
- Adverteren via Facebook Ads, Instagram Ads of andere betaalde sociale mediakanalen op merkgerelateerde termen is eveneens niet toegestaan zonder toestemming.
6. SEO & Content
- Wij verwachten unieke en kwalitatieve content op de website of account van de publisher.
- Op aanvraag kan ThePhoneLab een lijst delen met aanbevolen zoektermen, focusproducten en tips om content beter te lokaliseren.
- Publishers kunnen een maandelijkse nieuwsbrief ontvangen met actuele promoties en focusproducten voor het affiliate kanaal.
- ThePhoneLab ontvangt graag een preview van content waarin het merk of de producten worden gepromoot, voordat deze wordt gepubliceerd.
7. E-mailmarketing
- Het versturen van commerciële uitingen is alleen toegestaan als de publisher aantoonbaar voldoet aan artikel 11.7 van de Telecommunicatiewet, de richtlijnen van de ACM en de gedragsregels van het affiliate netwerk.
- Mailings mogen uitsluitend worden verstuurd na het indienen van een preview en het ontvangen van schriftelijke goedkeuring. Previews kunnen worden ingediend via het affiliate platform of per e-mail bij de accountmanager.
- De preview dient te bevatten: datum van verzending, aantal adressen, afzender en onderwerpregel.
- Alleen e-mailadressen verkregen via dubbele opt-in en conform ACM-regelgeving mogen worden gebruikt.
- Bij verzending zonder goedkeuring worden alle gegenereerde sales afgekeurd.
- De publisher is zelf verantwoordelijk voor eventuele juridische gevolgen bij het versturen van spam of ongeautoriseerde commerciële uitingen.
8. Kortingscodes & Promoties
- Publishers mogen uitsluitend kortingscodes en promoties gebruiken die door ThePhoneLab zijn goedgekeurd voor het affiliate programma.
- Transacties waarbij niet-geautoriseerde kortingscodes zijn gebruikt, worden niet vergoed.
- Cashback- en loyaliteitspartijen mogen kortingscodes niet combineren met cashback, tenzij hier expliciete toestemming voor is verleend.
- Publishers mogen geen kortingscodes suggereren of impliceren die niet daadwerkelijk beschikbaar zijn.
9. Adware, Spyware & Retargeting
- Adverteren via adware of spyware is niet toegestaan.
- Samenwerking op basis van postview, retargeting, remarketing of programmatic advertising is niet toegestaan, tenzij hier schriftelijke toestemming voor is verleend. Zonder overeenkomst worden alle hieruit voortkomende sales afgekeurd.
10. Commissiebeleid
- Commissie wordt uitbetaald over de nettoorderwaarde, exclusief BTW, verzendkosten en eventuele andere toeslagen, na aftrek van annuleringen en retourzendingen.
- Bestellingen die niet door de klant zijn betaald, zijn uitgesloten van commissie-uitbetaling.
- De commissie is gebaseerd op het commissiemodel dat is toegewezen aan de betreffende partner.
- Transacties worden binnen maximaal 60 dagen gevalideerd (goedgekeurd of afgekeurd).
- Over B2B-orders wordt geen commissie uitbetaald.
Commissie kan worden afgekeurd om de volgende redenen:
- Bestelling geannuleerd
- (Deel van de) bestelling geretourneerd
- Bestelling niet betaald
- Dubbel geregistreerde bestelling
- Schending van de programmavoorwaarden
- Gebruik van niet-geautoriseerde kortingscodes
- Afspraak niet nagekomen
11. Cookie & Attributie
- De cookieperiode bedraagt 30 dagen.
- Attributie vindt plaats op basis van last-click, ontdubbeld tegen andere betaalde online marketingkanalen van ThePhoneLab.
- Wanneer een klant de website van ThePhoneLab bereikt, wordt de cookie bevroren. Affiliates die tot 30 minuten na dit moment voor het eerst deelnemen aan de customer journey, worden niet meegenomen in de commissie-uitbetaling.
12. Terugkerende Transacties & Cadeaubonnen
- Voor terugkerende klanten wordt uitsluitend de eerste aankoop binnen de cookieperiode van 30 dagen vergoed.
- Aankopen afgerekend met een cadeaubon worden niet meegenomen in de commissie-uitbetaling.
13. Sub-netwerken
- Sub-netwerk affiliates zijn alleen toegestaan indien zij een login kunnen verstrekken aan het ThePhoneLab Affiliate team.
- Sub-netwerk affiliates dienen direct aangesloten te zijn aan het ThePhoneLab Affiliate programma. Aansluiting via andere affiliates (sub-sub-networks) is niet toegestaan.
14. Betalingsvoorwaarden
- Commissies worden op maandelijkse basis uitbetaald na goedkeuring, conform de volgende cyclus:
- Een conversie in januari wordt in februari goedgekeurd.
- Na goedkeuring in februari wordt de sale opgenomen in de factuur van februari, die in maart wordt uitgestuurd.
- Na ontvangst van de factuur in maart vindt betaling plaats binnen 30 dagen.
- De totale betalingscyclus bedraagt maximaal 90 dagen.
15. Verwijdering uit het Programma
ThePhoneLab behoudt zich te allen tijde het recht voor om partners te verwijderen uit het affiliate programma wegens schendingen van deze voorwaarden, inclusief maar niet beperkt tot: spamming, illegale activiteiten, ongepaste advertenties, merkinbreuk of fraude.

ThePhoneLab Affiliate Program – Terms & Conditions
These terms and conditions apply to participation in the ThePhoneLab Affiliate Program on the Awin platform and supplement Awin's general terms and conditions. Please read these terms carefully before applying, so that you are able to understand and accept all rules.
Any violation of these terms by a registered partner may result in immediate exclusion from the affiliate program and cancellation of all outstanding commissions.
1. Eligibility Requirements
- Participation is limited to publishers who are at least 18 years of age and have full legal capacity.
- Websites containing political, gambling, violent, pornographic or illegal content are excluded from participation.
- Websites under construction or displaying error messages will not be approved. Prior review of the website is required.
- White label shops and white label price comparison engines are not accepted and will result in removal from the program.
- Banner networks, paid mailers and layer advertisements are not permitted.
2. Use of Brand Name & Domains
- It is not permitted to register or use domains containing "ThePhoneLab", including misspellings or variations thereof, without prior written consent from ThePhoneLab.
- Direct copies or imitations of the ThePhoneLab website are prohibited.
- Use of the product feed for shop-like constructions outside of the publisher's own website is not permitted without explicit approval.
3. Advertising Materials
- All advertising materials provided by ThePhoneLab (banners, logos, product images) are protected by copyright and may only be used on the websites registered at the time of application.
- Modification or extension of provided advertising materials is not permitted without prior consent.
- The publisher is responsible for keeping advertising materials up to date and must remove them promptly upon request by ThePhoneLab.
- The use of pop-ups or layers triggered upon page load is not permitted.
4. Product Feed
- It is not permitted to use the product data feed provided by ThePhoneLab on third-party platforms (such as Google Shopping) without explicit approval.
- The publisher must always use the most recent version of the product feed and update it on a daily basis.
- The publisher is responsible for any inaccurate information and any legal consequences arising from it.
5. Search Engine Advertising (SEA & CSS)
- It is not permitted to drive traffic directly to the ThePhoneLab website through paid search without prior consent.
- Bidding on brand-related keywords across all search engines is prohibited. The following keywords must be added as negative keywords:

- the phone lab
- thephonelab discount code
- discount code thephonelab
- thephonelab shop
- thephonelab store
- thephonelab online
- thephonelab nl
- thephonelab deal
- Google CSS is not permitted unless explicit written consent has been obtained from ThePhoneLab.
- Advertising on brand-related terms via Facebook Ads, Instagram Ads or other paid social media channels is also not permitted without prior consent.
6. SEO & Content
- We expect unique and high-quality content on the publisher's website.
- Upon request, ThePhoneLab can share a list of recommended search terms, focus products and tips to better localise content.
- Publishers may receive a monthly newsletter with current promotions and focus products tailored to the affiliate channel.
- ThePhoneLab welcomes a preview of any content featuring the brand or products prior to publication.
7. Email Marketing
- Sending commercial messages is only permitted if the publisher is demonstrably compliant with applicable telecommunications legislation, regulatory guidelines and the code of conduct of the affiliate network.
- Mailings may only be sent after submitting a preview and receiving written approval. Previews can be submitted via the affiliate platform or by email to the account manager.
- The preview must include: date of sending, number of recipients, sender name and subject line.
- Only email addresses obtained via double opt-in and in accordance with applicable regulations may be used.
- If a mailing is sent without approval, all generated sales will be declined.
- The publisher is solely responsible for any legal consequences resulting from sending spam or unauthorised commercial messages.
8. Discount Codes & Promotions
- Publishers may only use discount codes and promotions that have been approved by ThePhoneLab for the affiliate program.
- Transactions involving unauthorised discount codes will not be compensated.
- Cashback and loyalty partners may not combine discount codes with cashback unless explicit written permission has been granted.
- Publishers may not suggest or imply the availability of discount codes that are not genuinely available.
9. Adware, Spyware & Retargeting
- Advertising via adware or spyware is not permitted.
- Collaboration based on post-view, retargeting, remarketing or programmatic advertising is not permitted unless written consent has been provided. Without an agreement, all resulting sales will be declined.
10. Commission Policy
- Commission is paid on the net order value, excluding VAT, shipping costs and any other surcharges, after deduction of cancellations and returns.
- Orders not paid by the customer are excluded from commission payment.
- Commission is based on the commission model assigned to the respective partner.
- Transactions will be validated (approved or declined) within a maximum of 60 days.
- No commission is paid on B2B orders.
Commission may be declined for the following reasons:
- Order cancelled
- Order (partially) returned
- Order not paid
- Duplicate registered order
- Violation of program terms
- Use of unauthorised discount codes
11. Cookie & Attribution
- The cookie window is 30 days.
- Attribution is based on last-click, de-duplicated against ThePhoneLab's other paid online marketing channels.
- Once a customer reaches the ThePhoneLab website, the cookie is frozen. Affiliates that enter the customer journey for the first time within 30 minutes of this moment will not be included in the commission payment.
12. Recurring Transactions & Gift Vouchers
- For returning customers, only the first purchase within the 30-day cookie window will be compensated.
- Purchases paid with a gift voucher are excluded from commission payment.
13. Sub-networks
- Sub-network affiliates are only permitted if they can provide login access to the ThePhoneLab Affiliate team.
- Sub-network affiliates must be directly connected to the ThePhoneLab Affiliate program. Connection via other affiliates (sub-sub-networks) is not permitted.
14. Payment Terms
- Commissions are paid on a monthly basis following approval, in accordance with the following cycle:
- A conversion made in January will be approved in February.
- Once approved in February, the sale will be added to the February invoice, which is issued in March.
- Once the invoice is received in March, payment will be made within 30 days.
- The total payment cycle is a maximum of 90 days.
15. Removal from the Program
ThePhoneLab reserves the right at all times to remove partners from the affiliate program for violations of these terms, including but not limited to: spamming, illegal activities, inappropriate advertising, brand infringement or fraud.
