Medly Wine Co. Affiliate Program – Terms & Conditions

1. Program Overview
These Terms & Conditions govern participation in the Medly Wine Co. Affiliate Program, administered through the Awin affiliate network. By applying to or participating in this program, you ("Publisher" or "Affiliate") agree to be bound by these terms, Awin's Publisher Terms of Service, and all applicable laws and regulations.
2. Eligibility & Approval
Participation is subject to review and approval at the sole discretion of Medly Wine Co. We reserve the right to decline or terminate any affiliate for any reason, including but not limited to content that conflicts with our brand values, targets audiences under the legal drinking age, or violates applicable advertising laws. Affiliates must be 21 years of age or older and legally permitted to promote alcohol-related products in their jurisdiction.
3. Commission Structure
- Commission Rate: 20% of net sale value (excluding taxes, shipping, and returns)
- Attribution Model: Last-click attribution
- Minimum Payout Threshold: $50 USD
- Payment Schedule: Per Awin's standard payment cycle
Commission rates and cookie windows are subject to change with reasonable notice. Commissions are not earned on orders placed by the affiliate themselves, orders that are fraudulent, or orders that are cancelled or returned.
4. Approved Promotional Methods
Affiliates may promote Medly Wine Co. through the following channels:
- Content and editorial websites
- Email marketing (CAN-SPAM and GDPR compliant; must be opted-in lists only)
- Social media (organic and paid, where permitted by platform policies)
- Comparison and review sites
- Loyalty and rewards platforms
- Coupon and deal sites (only with pre-approved offers; unauthorized coupon codes are prohibited)
5. Prohibited Promotional Methods
The following are strictly prohibited and will result in immediate termination and commission reversal:
- Bidding on Medly Wine Co. branded keywords (including misspellings and variations) in paid search without prior written approval
- Use of Medly Wine Co.'s brand name, trademark, or URL in paid search ad copy or display URLs without written approval
- Cookie stuffing, forced clicks, or any deceptive tracking method
- Incentivized traffic (cashback, points, or rewards) without prior written approval
- Pop-up or pop-under advertising
- Spam or unsolicited bulk communications
- Promotion on any website or platform containing illegal content, adult content, or content promoting excessive alcohol consumption
- Making false, misleading, or unsubstantiated claims about Medly Wine Co. products
- Violating any applicable alcohol advertising law, including restrictions on marketing to minors
6. Age-Gating & Responsible Advertising
Affiliates must not target advertising toward anyone under the legal drinking age (21 in the United States). Any promotional content must include appropriate responsible drinking messaging where required by law or platform policy. Affiliates found to be marketing to underage audiences will be immediately terminated.
7. Brand & Creative Guidelines
- Affiliates may only use creative assets (logos, images, banners) provided directly through the Awin program portal
- Creative assets may not be altered, distorted, or used in a manner inconsistent with our brand guidelines
- Affiliates may not register domain names containing "Medly," "Medly Wine," or any confusingly similar variation
- All promotional content is subject to review; Medly Wine Co. reserves the right to request removal of any content it deems inconsistent with the brand
8. Coupon & Discount Codes
Only coupon codes officially issued through the Awin platform or directly by Medly Wine Co. may be promoted. Affiliates promoting unauthorized codes will have related commissions reversed and may be terminated. Coupon sites must display only active, verified offers.
9. Tracking & Attribution
Affiliates must use Awin-provided tracking links only. No commission will be paid on sales that are not tracked through valid Awin deep links. Medly Wine Co. is not responsible for missed commissions resulting from improper link implementation. Affiliates must not manipulate tracking in any way.
10. Commission Reversals
Commissions may be reversed for any of the following:
- Returned or cancelled orders
- Fraudulent or self-referred orders
- Orders generated through prohibited promotional methods
- Chargebacks initiated by customers
- Violation of these Terms & Conditions
11. Compliance with Laws
Affiliates are solely responsible for complying with all applicable laws, including but not limited to alcohol advertising regulations, FTC disclosure requirements (affiliates must clearly disclose their relationship with Medly Wine Co. as required by the FTC), CAN-SPAM, GDPR, and CCPA where applicable.
12. Program Modifications & Termination
Medly Wine Co. reserves the right to modify commission rates, cookie durations, or any terms of this program at any time with notice posted through the Awin platform. Continued participation following notice of changes constitutes acceptance of the revised terms. Either party may terminate participation at any time. Upon termination, all use of Medly Wine Co. branding and creative assets must cease immediately.
13. Limitation of Liability
Medly Wine Co. shall not be liable for any indirect, incidental, or consequential damages arising out of or related to participation in the affiliate program. Total liability shall not exceed commissions paid in the 90 days preceding a dispute.
14. Governing Law
These Terms & Conditions shall be governed by the laws of the State of [Your State], without regard to conflict of law principles.
