1. Introduction
These Terms and Conditions (“Terms”) govern participation in the Druids Golf Ltd affiliate programme (“Programme”), operated via the Awin affiliate network. By joining the Programme, each publisher (“Affiliate”, “Publisher”, “you”) agrees to be bound by these Terms in full.
Druids Golf Ltd (‘we’, ‘us’, ‘our’) reserves the right to amend these Terms at any time. Publishers will be given a minimum of 7 days’ notice of any material changes via the Awin platform. Continued participation in the Programme following such notice constitutes acceptance of the updated Terms.
2. Programme Overview
The Druids Golf Ltd affiliate programme allows approved Publishers to earn commission by directing customers to our website and generating qualifying sales. We operate as a direct-to-consumer (D2C) brand and expect all promotional activity to reflect our brand values accordingly.
3. Commission & Transaction Value3.1 Commissionable Transaction Value
Commissions are calculated solely on the net product subtotal of each qualifying order, as tracked via our Shopify integration with Awin. The following are explicitly excluded from the commissionable transaction value:
- VAT and all applicable sales taxes
- Delivery and shipping charges
- Credit card or payment processing fees
- Gift wrapping and other ancillary service charges
3.2 Non-Commissionable Products
Commissions are not payable on gift card purchases. Any order consisting solely of gift cards will not generate a commission payment.
3.3 Discounts
Where discount codes or promotions have been applied to an order, commission will be calculated on the order subtotal after discounts have been applied.
4. Commission Decline Reasons
Druids Golf Ltd reserves the right to decline commission payments in the following circumstances:
- Order was cancelled by the customer or by Druids Golf Ltd
- Item was returned by the customer
- Customer failed a credit check
- Breach of these Programme terms and conditions by the Publisher
- Duplicate order detected
- Item was out of stock at the time of order
- Any other circumstance at the reasonable discretion of Druids Golf Ltd
5. De-Duplication Policy
Druids Golf Ltd operates a de-duplication policy across all online advertising channels. Where a sale has also been attributed to one or more of the following channels, commission to the Affiliate Publisher may be withheld or reduced accordingly:
- PPC Brand advertising
- PPC Generic advertising
- Email advertising
- Display advertising
- Direct partnerships
- Price comparison sites
- In-house publisher programmes
- Other affiliate networks
Druids Golf Ltd retains final discretion in determining attribution and commission eligibility under this de-duplication policy.
6. Approved Publisher Types
The following promotional types are approved to participate in the Programme:
- Cashback
- Community
- Content
- Discount Code
- Email
- Loyalty
- Search
The following promotional types are not approved and will not be accepted into the Programme:
- Behavioural Retargeting
- Media Brokers
7. Brand & Content Standards
All promotional content produced by Publishers must reflect the Druids Golf Ltd brand values as a direct-to-consumer brand. The following are expressly prohibited:
- Promotion of adult content or age-restricted products in conjunction with our brand
- Promotion across unrelated verticals that are inconsistent with our brand identity
- Mass-market, low-quality placements that may damage brand perception
Druids Golf Ltd reserves the right to refuse or revoke approval of any Publisher or promotional placement that does not meet our brand standards, at our sole discretion and without prior notice.
8. Pay-Per-Click (PPC) Advertising
Publishers approved to run search (PPC) activity must adhere to the following:
- Bidding on Druids Golf Ltd brand terms, brand variations, or misspellings is strictly prohibited unless express written permission has been granted
- Affiliates must not display ads in a way that competes with or misrepresents Druids Golf Ltd’s own paid search activity
- All PPC activity must comply with the relevant search engine’s advertising policies
Violation of these PPC terms may result in immediate removal from the Programme and forfeiture of outstanding commissions.
9. Discount Codes & Vouchers
Publishers may only promote discount codes that have been officially issued by Druids Golf Ltd and shared through the Awin platform. The use of expired, unauthorised, or third-party discount codes is prohibited. Druids Golf Ltd reserves the right to decline commissions on transactions where an unauthorised code was used.
10. Notice Periods
Druids Golf Ltd will endeavour to provide Publishers with adequate notice of the following:
- Changes to Programme terms and conditions: minimum 7 days’ notice
- Planned website maintenance or downtime that may affect tracking: minimum 7 days’ notice
Where changes are required urgently due to legal, technical, or commercial necessity, we reserve the right to implement changes with immediate effect and will notify Publishers as soon as reasonably practicable.
11. Programme Management & Final Authority
Druids Golf Ltd retains full and final authority over all aspects of the Programme, including but not limited to:
- Publisher approval and removal
- Commission rates and structures
- Attribution and de-duplication decisions
- Content and promotional approval
- Interpretation of these Terms
Any disputes regarding commission, attribution, or Programme eligibility will be resolved at the sole discretion of Druids Golf Ltd. Our decision is final.
12. Termination
Druids Golf Ltd reserves the right to terminate a Publisher’s participation in the Programme at any time, with or without cause, and with or without notice. Upon termination, any outstanding commissions may be reviewed and withheld if they relate to activity that breached these Terms.
13. Limitation of Liability
Druids Golf Ltd shall not be liable for any indirect, incidental, or consequential losses arising from participation in the Programme. Our total liability to any Publisher shall not exceed the value of commissions paid to that Publisher in the preceding three months.
14. Governing Law
These Terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Scotland.
