Welcome to the CircuitMess Affiliate Program. These Terms and Conditions ("Terms") govern your participation in our affiliate program ("Program") operated by CircuitMess, Inc. ("CircuitMess," "we," "us," or "our") through the Awin network. By applying to and/or participating in the Program, you ("Publisher," "you," or "Affiliate") agree to be bound by these Terms in addition to Awin's standard Publisher Service Agreement.
1. ACCEPTANCE AND APPROVAL
Acceptance into the Program is at CircuitMess's sole discretion. We reserve the right to approve or decline any application, and to remove Publishers from the Program, without providing reasons. Application to the Program does not guarantee acceptance, and acceptance does not constitute endorsement of your website, promotional methods, or content.
2. PROGRAM OVERVIEW
CircuitMess designs and manufactures STEM education kits - DIY smartwatches, robots, gaming consoles, and AI-powered projects for kids, teens, and adults. Publishers are rewarded with commission on qualifying sales generated through approved affiliate links, subject to the commission structure and validation rules stated in the Program.
3. PERMITTED PUBLISHER TYPES
The following promotional models are approved to participate in the Program:
- Content and editorial publishers - blogs, review sites, tech media, parenting sites, educational resource sites.
- Community and social publishers - forums, Discord servers, Reddit communities, hobbyist groups, provided promotional activity complies with the rules of the platform used.
- Cashback sites - permitted provided they do not combine cashback with coupon codes or additional incentives without prior written approval.
- Loyalty and rewards sites - permitted subject to the same conditions as cashback.
- Coupon and voucher sites - permitted only when using codes officially issued by CircuitMess for affiliate distribution. See Section 7.
4. PROHIBITED PUBLISHER TYPES
The following models are not permitted under this Program without express prior written consent from CircuitMess:
- Email marketing to third-party or purchased lists.
- Pure search arbitrage ("search" affiliates whose sole model is bidding on paid search).
- Behavioural retargeting and display remarketing publishers.
- Media brokers, ad networks, and sub-affiliate networks that resell or repackage program access.
- Downloadable toolbars, browser extensions, and cookie-stuffing software.
- Adware, spyware, or any software that modifies, intercepts, or injects content into users' browsing sessions.
5. COMMISSION AND TRACKING
- Commissions are calculated on the net order value, excluding gift wrapping, service charges, and any product categories that may be excluded from time to time.
- Commission values include product price, VAT/sales tax, delivery charges, and credit card processing fees, as configured in the Program's transaction terms.
- Tracking is handled via Awin's tracking system. CircuitMess is not liable for missed commissions resulting from user-side issues such as ad blockers, cookie rejection, cross-device behaviour, or browser privacy settings that prevent tracking.
- Cookie duration: 30 days, last-click attribution.
6. PAID SEARCH (PPC) POLICY
Publishers may:
- Promote CircuitMess via PPC on Google, Yahoo, Bing, and other search engines, subject to the rules below.
- Link directly from paid search ads to circuitmess.com.
- Display the CircuitMess brand name in the visible display URL of ads (e.g., circuitmess.com).
- Bid on generic, non-brand keywords and on brand+product combinations (e.g., "CircuitMess kit," "CircuitMess robot").
Publishers may not, without explicit prior written consent from CircuitMess:
- Use "CircuitMess" or any variation, misspelling, or phonetic equivalent (e.g., "Circut Mess," "Circuit Mes," "Circiut Mess") in ad titles, ad copy, or ad descriptions.
- Bid on the term "CircuitMess" or any misspelling, abbreviation, or close variant as a standalone keyword.
- Bid on branded product names as standalone keywords (e.g., "Ringo," "MAKERphone," "CircuitMess Batmobile").
- Use dynamic keyword insertion (DKI) in a way that would cause brand terms to appear in ad copy.
- Direct PPC traffic through cloaking, redirects, or any destination other than circuitmess.com.
- Run shopping ads (Google Shopping, Bing Shopping, or comparable CSS placements) featuring CircuitMess products without prior written approval.
Publishers running PPC must add "CircuitMess" and common variations as negative keywords in any campaign promoting CircuitMess.
Prohibited keyword categories also include: highly competitive generic terms where Publisher bidding would directly compete with CircuitMess's own paid search activity, and any terms that would constitute trademark infringement of third parties or violate Google/Bing/Yahoo advertising policies.
7. COUPON AND VOUCHER CODES
- Publishers may only distribute coupon, voucher, or discount codes that have been officially issued to them by CircuitMess for affiliate use.
- Publishers may not publish, circulate, or imply the existence of codes that have not been officially sanctioned. This includes, but is not limited to, "we found a code" or "try XYZ at checkout" content where no code has been provided.
- Codes issued for specific publishers, campaigns, or time windows may not be shared with other publishers, coupon aggregators, or the general public outside the approved channel.
- Leaking codes - including posting them on extension-based coupon tools (e.g., Honey, Rakuten, Capital One Shopping) without prior approval - is a material breach of these Terms and may result in removal from the Program and reversal of associated commissions.
8. CONTENT AND BRAND STANDARDS
Publishers must:
- Represent CircuitMess accurately and in a manner that does not mislead consumers.
- Use only official product names, descriptions, imagery, and pricing. Imagery and logos are available on request via the contact details below.
- Ensure all claims about CircuitMess products - including educational, age-appropriateness, safety, and technical claims - are consistent with information published on circuitmess.com.
- Comply with all applicable advertising, consumer protection, and data protection laws in their jurisdiction (including GDPR, CCPA, and FTC disclosure requirements where applicable).
- Clearly disclose affiliate relationships where required by law or platform policy.
Publishers may not:
- Use CircuitMess trademarks, logos, or brand assets in a modified, distorted, or misleading form. See the Branding section of our Program Terms for full logo usage guidelines.
- Present CircuitMess products alongside content that is adult, hateful, defamatory, or otherwise incompatible with a brand whose core audience includes children and families.
- Make false statements about CircuitMess products, pricing, availability, or promotions.
- Impersonate CircuitMess, its staff, or any official channel (including customer support, social media accounts, or email senders).
9. FRAUD AND PROHIBITED TECHNIQUES
The following are strictly prohibited and will result in immediate removal from the Program, reversal of all pending and paid commissions, and may be referred to Awin for broader network action:
- Cookie stuffing, forced clicks, iframe tricks, or any technique that sets affiliate cookies without a genuine user click.
- Click bots, impression bots, automated traffic generation, or any form of artificial traffic.
- Self-referrals or referrals from accounts controlled by the Publisher or their immediate associates.
- Use of incentivised traffic (paid-to-click, reward-based clicks) without prior written approval.
- Any form of domain squatting, typosquatting, or use of domains confusingly similar to circuitmess.com.
- Unauthorised use of AI-generated content that impersonates CircuitMess, fabricates product claims, or is designed to manipulate search results at scale.
10. COMMISSION ADJUSTMENTS AND DECLINES
Sales may be declined, reversed, or adjusted for the following reasons:
- Order cancellation by the customer.
- Returned or refunded items.
- Failed credit check or payment processing failure.
- Duplicate orders.
- Items out of stock and subsequently cancelled.
- Breach of these Terms by the Publisher.
- Fraudulent, suspicious, or non-genuine transactions.
- Other legitimate reasons at CircuitMess's reasonable discretion.
11. CHANGES TO COMMISSION RATES AND TERMS
- CircuitMess may reduce standard commission rates by a maximum of 20% per change, with at least 7 days' written notice via Awin, and no more frequently than once every 30 days.
- CircuitMess may increase commission rates, add bonus incentives, or offer temporary boosts at any time without notice.
- CircuitMess may amend these Terms at any time. Material changes will be communicated via Awin with at least 7 days' notice. Continued participation after the notice period constitutes acceptance.
12. TERMINATION
Either party may terminate participation in the Program at any time. CircuitMess may immediately suspend or terminate a Publisher's participation for breach of these Terms, fraudulent activity, or conduct that harms the CircuitMess brand. Upon termination, Publishers must remove all CircuitMess branding, links, and references from their properties within 7 days.
Commissions earned in good faith prior to termination, and not associated with any breach, will be paid in accordance with Awin's standard payment schedule.
13. LIABILITY
The Program is provided on an "as is" basis. To the maximum extent permitted by law, CircuitMess is not liable for indirect, consequential, or incidental damages arising from participation in the Program, including lost profits or lost commissions resulting from tracking failures, site downtime, or changes to the Program.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Any disputes will be resolved in accordance with the dispute resolution provisions of Awin's Publisher Service Agreement.
