These Terms and Conditions ("Terms") govern your participation in the Tatum Affiliate Program ("Program") operated through Awin. By joining the Program, you agree to comply with these Terms as well as all applicable Awin terms, policies, and compliance requirements.

1. Eligibility

To participate, you must be of legal age in your jurisdiction, comply with applicable laws, and not have been previously suspended from Tatum services. If you are acting on behalf of a legal entity, you confirm that you are authorized to bind that entity to these Terms. An active Awin publisher account is required. Employees of Tatum and their immediate family members are not eligible.

2. Program Overview

The Program allows affiliates to earn commissions by referring customers to Tatum. All tracking, attribution, and reporting are handled through Awin using affiliate tracking links. Only transactions recorded within Awin are eligible for commission.

3. Tracking and Attribution

Referrals are tracked using Awin’s systems, including cookies and related technologies. Attribution is typically based on a last-click model, with cookie duration and other rules defined within Awin. Tracking may be affected by browser restrictions, ad blockers, or user behavior, and Tatum does not guarantee that all referrals will be successfully recorded. In the event of discrepancies, Awin’s data will be considered final.

4. Commissions

Commissions are tracked when a qualifying transaction occurs and remain pending until reviewed and approved. Tatum may approve or decline transactions at its discretion, including where a transaction is canceled, refunded, unpaid, or otherwise invalid. Commissions become payable only after approval and in accordance with Awin’s payment cycle.

Tatum reserves the right to reverse or deny commissions in cases of fraud or abuse, including self-referrals, artificial traffic, or manipulation of attribution mechanisms.

5. Validation and Payment

Transactions are subject to a validation period, typically between 30 and 60 days, during which they may be reviewed and approved or declined. Approved commissions are paid out by Awin once they are funded by Tatum and processed according to Awin’s payout schedule and thresholds.

Tatum is not responsible for delays, fees, or errors related to Awin’s payment systems. Affiliates are responsible for maintaining accurate payment details and handling any applicable tax obligations.

6. Promotional Guidelines

Affiliates must promote Tatum in a truthful and compliant manner. This includes using accurate information and avoiding misleading claims. Affiliates may not represent themselves as Tatum, bid on Tatum trademarked terms in paid search without approval, or engage in spam or deceptive marketing practices. Any attempt to manipulate tracking, including techniques such as cookie stuffing or forced clicks, is strictly prohibited.

Tatum may request the removal or modification of any promotional content that does not meet these standards.

7. Brand and Intellectual Property

Affiliates may use Tatum branding and materials only as provided and solely for the purpose of promoting the Program. Unauthorized use of trademarks or brand assets is not permitted, and Tatum may revoke usage rights at any time.

8. Data Protection

Any personal data is handled in accordance with Tatum’s Privacy Policy and Awin’s data protection policies. Affiliates are responsible for complying with applicable data protection laws.

9. Termination

Tatum may suspend or terminate your participation in the Program at any time if you violate these Terms or applicable Awin policies. Any commissions associated with non-compliant activity may be withheld or revoked. You may also leave the Program at any time through Awin.

10. Changes to Terms

Tatum may update these Terms from time to time. Updates may be communicated via Awin or email, and continued participation in the Program constitutes acceptance of the updated Terms.

11. Limitation of Liability

Tatum is not liable for any indirect, incidental, or consequential damages arising from participation in the Program. This includes any issues related to tracking, attribution, or payments handled by Awin.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA. You agree to the exclusive jurisdiction of the courts located in Delaware.

13. Electronic Communications

By participating in the Program, you consent to receive electronic communications related to your participation. These communications satisfy any legal requirement for written notice.
