This document sets out the terms and conditions governing participation in the Vitall Check affiliate programme. Please read it carefully before applying.


 

 

1. Definitions

The following definitions apply throughout this agreement. Where a term is capitalised, it carries the meaning set out below.

“Affiliate” or “Publisher” means you, the individual or entity accepted into the Programme.

“Vitall Check” or “we” means Vitall Check, the company operating the Programme and the website at www.vitallcheck.co.uk.

“Programme” means the Vitall Check affiliate programme operated through the Awin network.

“Net Transaction Value” means the total purchase price paid by the customer, excluding VAT, shipping charges, and any discounts or promotional reductions applied at checkout.

“Validated Commission” means a commission that has passed the 30-day validation period without being reversed due to returns, cancellations, or fraud.

“Immediate Family” means a spouse, civil partner, parent, child, sibling, or any person living at the same address as the Affiliate.

“Fraudulent Activity” means any deliberate action intended to generate commissions improperly, including but not limited to cookie stuffing, self-referral, click manipulation, and the use of misleading advertising.

2. Programme Overview

The Vitall Check affiliate programme allows approved partners to earn commissions by referring customers to www.vitallcheck.co.uk through tracked affiliate links provided via the Awin network. By applying to the Programme, you agree to be bound by these terms in full, alongside Awin’s Publisher Terms and Conditions.

We have designed the Programme to be straightforward and rewarding for partners who share our commitment to accurate, responsible health information. The sections that follow set out how commissions work, what promotional methods are permitted, and the standards we expect.

3. Commission Structure and Payment3.1 Commission Rates

The table below summarises the key commercial terms of the Programme.

Commissions are calculated on the Net Transaction Value. Both first-time and returning customers qualify, and all product categories are commissionable.

3.2 Qualifying and Non-Qualifying Transactions

A transaction qualifies for commission when a customer completes a purchase after clicking your unique affiliate tracking link. No commission will be paid on:

  • cancelled or returned orders (commission will be reversed on returns)
  • fraudulent transactions, as determined by Vitall Check in its reasonable judgment
  • orders placed by the Affiliate, their Immediate Family, or any associated business entity
  • orders that use discount codes not officially provided through the Programme

3.3 Validation and Payment

Commissions are held for 30 days from the transaction date. This validation period allows time for returns, cancellations, and fraud checks. Once validated, commissions are released for payment through Awin’s standard monthly payment cycle. Your Awin publisher account settings govern the minimum payment threshold and payment method.

3.4 Commission Reversals

We reserve the right to reverse commissions where a transaction is subsequently returned or refunded, where fraud is identified, or where a breach of these terms has occurred. If you believe a reversal has been applied in error, you may raise a dispute through the Awin messaging system, and we will review it within 10 business days.

4. Tracking and Attribution

Affiliate tracking is managed through Awin’s platform. When a customer clicks your affiliate link, a cookie is placed on their device with a duration of 30 days. If the customer purchases within that window, you receive credit for the sale.

We operate a last-click attribution model. This means that if a customer clicks multiple affiliate links before purchasing, the final valid affiliate click receives the commission. Where a customer arrives at our site through a direct visit, a bookmark, or a non-affiliate marketing channel after initially clicking your link, the non-affiliate channel takes priority. Cross-device tracking is enabled where the Awin platform supports it.

We recognise that attribution can occasionally produce unexpected results. If you believe tracking has not worked correctly for a specific transaction, please contact us through Awin’s messaging system with the relevant details, and we will investigate.

5. Promotional Methods5.1 Approved Activities

We encourage creative, high-quality promotion through the following channels:

  • content marketing, blog posts, and editorial features
  • email marketing to your own opted-in subscriber lists
  • organic social media posts on your established accounts
  • YouTube, video, and podcast content
  • Comparison and review websites
  • discount code and deal websites (subject to prior written approval — see Section 7)
  • paid advertising on general health and wellness terms (subject to the restrictions in Section 5.3)

5.2 Content Standards

All promotional content must be truthful, accurate, and compliant with the regulations set out in Section 9. In particular, you must not make health claims that are unsubstantiated or that suggest our tests can diagnose, treat, cure, or prevent any disease. Every piece of content that mentions Vitall Check tests should make clear that our products are not a substitute for professional medical advice.

You must clearly disclose your affiliate relationship in all promotional content. This means using language such as “affiliate link,” “we may earn a commission,” or the hashtag #ad. The disclosure must be prominent and unambiguous, not buried in a footnote or hidden behind a “read more” link.

5.3 Paid Search Restrictions

You may bid on general health and wellness search terms such as “blood test kits,” “hormone testing,” or “at-home health tests.” However, you may not bid on any variation of the Vitall Check brand name, including misspellings. Your display URL must not contain “vitallcheck” or any similar variation, and your ad copy must not imply an official affiliation with Vitall Check unless we have given you written approval to do so.

5.4 Prohibited Promotional Methods

The following activities are strictly prohibited. Any breach of these rules may result in immediate termination from the Programme, forfeiture of pending commissions, and potential legal action.

  • Brand bidding: bidding on “Vitall Check,” “VitallCheck,” “Vitall,” or any brand variation on any pay-per-click platform.
  • Trademark misuse: using “Vitall Check” or variations in domain names, social media handles, or application names without our written permission.
  • Typosquatting: registering domains designed to capture mistyped traffic intended for vitallcheck.co.uk.
  • Adware, spyware, or toolbar traffic: any software that generates automatic clicks, impressions, or cookie placements.
  • Cookie stuffing: any technique that sets affiliate cookies without a genuine, user-initiated click.
  • Spam: unsolicited emails, SMS messages, push notifications, or any other form of unwanted communication.
  • Misleading claims: false medical claims, guaranteed results, or cure promises of any kind.
  • Impersonation: representing yourself as Vitall Check, an employee, or an official representative.
  • Incentivised clicks: paying, rewarding, or otherwise incentivising users to click your affiliate links.
  • Framing: displaying vitallcheck.co.uk within frames or iFrames that obscure the URL.
  • Intrusive advertising: pop-ups, pop-unders, or any advertising format that interferes with the user’s browsing experience.

6. Social Media

When promoting Vitall Check on social media, you must clearly mark posts as advertisements using #ad or #affiliate, in line with ASA regulations. You must not create accounts that impersonate or could be confused with official Vitall Check accounts. Where appropriate, you are welcome to tag @vitall_check for potential resharing.

7. Discount Codes and Promotions7.1 Approved Codes

You may only use discount codes that have been officially provided to you by Vitall Check through the Awin platform. Do not modify, share outside your approved channels, or create your own codes. The standard affiliate discount code offers customers a 10% discount on their order.

7.2 Coupon and Deal Sites

If you operate a coupon, deal, or voucher website, you must apply for specific approval before promoting Vitall Check codes. Approved coupon sites must adhere to a “working codes only” policy: expired codes must be removed immediately, and you must not display misleading expiry dates or create false urgency.

7.3 Restrictions

Discount codes are provided for your audience, not for personal use. You must not promote codes via paid search on brand terms, and you must not use codes in any way that undercuts Vitall Check’s published pricing strategy.

8. Brand Guidelines

Our brand name is written as “Vitall Check”, two words, both capitalised. Please do not write it as “VitallCheck,” “Vital Check,” or “Vitall.” Logos and approved promotional materials are available through the Awin interface. Use logos exactly as provided, without alteration, distortion, or recolouring, and maintain adequate clear space around the logo.

You must not suggest an official partnership, endorsement, or employment relationship with Vitall Check unless we have specifically authorised you to do so. When writing product descriptions, please use the approved descriptions from our promotional materials and always include a disclaimer that our tests do not replace professional medical advice.

9. Regulatory Compliance9.1 Advertising Standards

As an Affiliate promoting a health testing service, you operate in a regulated space. You are responsible for ensuring that your promotional activities comply with all applicable laws and regulations, including:

  • The UK Advertising Standards Authority (ASA) Code
  • The Committee of Advertising Practice (CAP) Code
  • The Consumer Rights Act 2015 and Distance Selling Regulations
  • MHRA guidance on medical device advertising, where applicable
  • Any other local advertising laws that apply in your jurisdiction

9.2 Health and Medical Claims

This is particularly important given the nature of our products. You must not claim or imply that Vitall Check tests diagnose, treat, cure, or prevent any disease. You must not provide medical advice. All promotional content should include the disclaimer: “This test is not a substitute for professional medical advice.”

9.3 Data Protection

You must comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. You must not collect or store any customer personal data beyond what is strictly necessary for tracking purposes. If you conduct email marketing, you must hold valid consent and provide a clear unsubscribe mechanism. Your website must display an accessible privacy policy and obtain cookie consent where required.

For the avoidance of doubt, Vitall Check is the data controller for customer transactions, and you act as an independent data controller for any personal data you collect through your own promotional activities. On termination of your participation in the Programme, you must delete any Vitall Check-related data in your possession.

9.4 Affiliate Disclosure

ASA regulations require that affiliate relationships be disclosed clearly and prominently. You must make it obvious to your audience that you may earn a commission from purchases made through your links. Acceptable disclosures include “affiliate link,” “we may earn a commission,” or “#ad.” The disclosure must appear before or alongside the affiliate link, not after it or in a separate location.

10. Application and Approval10.1 Application Process

All applications to the Programme are manually reviewed. We aim to process applications within 5–7 business days, though this may take longer during busy periods. We reserve the right to decline any application without providing a reason.

10.2 What We Look For

We typically approve Affiliates who have an established website or social media presence with quality content relevant to health, fitness, or wellness. We look for professional presentation, alignment with our brand values, and no history of spam or unethical marketing practices.

10.3 Ongoing Review

Approval is not permanent. We conduct periodic reviews of Affiliate promotional methods and reserve the right to revoke approval at any time if these terms are breached. We will notify you of any concerns through the Awin messaging system and, except in cases of serious or deliberate breach, give you a reasonable opportunity to remedy the issue before taking further action.

11. Prohibited Content

You must not promote Vitall Check on or alongside websites, channels, or platforms that contain:

  • illegal content or content promoting illegal activities
  • adult or sexually explicit material
  • content promoting violence, hatred, or discrimination
  • promotion of dangerous health practices, anabolic steroids, or unlicensed medical products
  • copyright-infringing material
  • malware, deceptive downloads, or phishing content

12. Intellectual Property

All Vitall Check trademarks, logos, product images, and marketing content remain our exclusive property. Your participation in the Programme grants you a limited, non-exclusive, revocable licence to use these materials solely for the purpose of promoting Vitall Check in accordance with these terms. No transfer of intellectual property rights occurs.

This licence terminates immediately upon your departure from the Programme, whether voluntary or otherwise. You must remove all Vitall Check branding, logos, and promotional content from your channels within seven days of termination. Unauthorised use of our intellectual property after termination may result in legal action.

13. Confidentiality

During your participation in the Programme, you may receive information that is confidential to Vitall Check, including commission structures offered to you personally, promotional strategies, unreleased product information, and internal performance data. You must not disclose this information to any third party without our prior written consent. This obligation continues after you depart from the Programme.

14. Changes to These Terms14.1 General Modifications

We reserve the right to modify these terms at any time. Changes will be communicated through the Awin messaging system. For material changes — including changes to commission rates, cookie duration, or attribution models, we will provide at least 30 days’ notice. Your continued participation in the Programme after the notice period constitutes acceptance of the modified terms.

14.2 Programme Suspension or Closure

We reserve the right to pause or close the Programme at any time. If we do so, we will honour all Validated Commissions and provide notice where commercially reasonable. Pending commissions that have not yet been validated at the time of closure will be processed through the standard validation cycle before any final payment.

15. Termination15.1 Termination by Vitall Check

We may terminate your participation in the Programme immediately and without notice in cases of serious breach, including Fraudulent Activity, use of prohibited promotional methods, damage to the Vitall Check brand, or violation of applicable laws. For less serious breaches, we will notify you and provide 48 hours to remedy the issue before terminating.

15.2 Termination by the Affiliate

You may leave the Programme at any time by withdrawing through the Awin platform. Validated Commissions will be paid according to the normal payment schedule. You must remove all Vitall Check promotional materials from your channels within seven days.

15.3 Consequences of Termination

On termination, for any reason:

  • All pending commissions that have not yet been validated are forfeited
  • Validated Commissions will be paid according to the standard schedule
  • All licences to use Vitall Check materials are immediately revoked
  • confidentiality obligations under Section 13 continue to apply
  • You must delete any Vitall Check-related data in your possession

16. Liability and Indemnification16.1 Our Liability

Vitall Check’s total liability under this agreement is limited to the value of unpaid Validated Commissions owed to you at the time a claim arises. We are not liable for lost profits, lost opportunities, or any indirect or consequential damages. Technical issues with tracking are governed by Awin’s terms of service, and we will work in good faith with Awin to resolve any tracking disputes you raise.

16.2 Your Liability

You agree to indemnify and hold harmless Vitall Check, its directors, employees, and agents against any claims, losses, damages, or expenses (including legal fees) arising from your promotional activities, any breach of these terms, any violation of third-party rights, or any non-compliance with applicable laws.

16.3 Force Majeure

Neither party is liable for failure to perform obligations under this agreement where such failure results from circumstances beyond reasonable control, including but not limited to system outages, natural disasters, pandemics, or government actions. This includes interruptions to the Awin tracking platform.

17. Dispute Resolution

If a dispute arises in connection with this agreement, both parties agree to attempt to resolve it informally through the Awin messaging system in the first instance. If the dispute cannot be resolved within 30 days, either party may escalate the matter to formal mediation before pursuing legal proceedings. This clause does not prevent either party from seeking urgent injunctive relief where necessary.

18. Tax

You are solely responsible for reporting and paying any taxes due on commissions earned through the Programme. Vitall Check does not deduct tax from commission payments and is not responsible for your tax obligations. If you are VAT-registered, it is your responsibility to account for VAT where applicable.

19. Monitoring and Support19.1 Compliance Monitoring

We reserve the right to monitor your promotional activities at any time, including through mystery shopping, automated brand monitoring tools, and requests for examples of your content. If we identify a violation, we will notify you through the Awin messaging system, and you must correct it within 48 hours unless a longer period is agreed upon.

19.2 Performance and Reporting

You can monitor your performance through the Awin dashboard, which provides near real-time reporting on clicks, conversions, and commission status.

19.3 Support

For all Programme-related enquiries, please use the Awin messaging system. We aim to respond within 2–3 business days. Promotional materials, including logos, banners, and product descriptions, are available through the Awin interface. We will announce seasonal campaigns and new promotions in advance through Awin.

20. Territory

The Programme is open to Affiliates based in the United Kingdom. International Affiliates may apply but must ensure that their promotional activities comply with both UK regulations and those of their own jurisdiction. Commissions are payable on qualifying sales regardless of the customer’s location, provided the transaction is completed through vitallcheck.co.uk.

21. General Provisions

Entire Agreement. These terms, together with Awin’s Publisher Terms and Conditions, constitute the entire agreement between you and Vitall Check regarding the Programme.

Governing Law. This agreement is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

Severability. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

Waiver. Our failure to enforce any right or provision of this agreement does not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer your participation in the Programme without our prior written consent.

No Employment or Agency. Nothing in this agreement creates an employment relationship, partnership, or agency between you and Vitall Check. You are an independent contractor.
