BLUSHARK STRAPS
AFFILIATE SERVICE AGREEMENT (AWIN NETWORK)
This Affiliate Service Agreement (the “Agreement”) is entered into by and between BluShark Straps (“BluShark,” “we,” “us,” or “our”) and you, the affiliate partner (“Affiliate,” “you,” or “your”), in connection with your participation in the BluShark Straps affiliate program operated through the AWIN network (“AWIN” or the “Service”).
By applying to, enrolling in, or participating in the BluShark Straps affiliate program through AWIN, you acknowledge that you have read, understand, and agree to be bound by this Agreement. If you do not agree, you must not participate in the program.
1. Program Overview
Subject to the terms of this Agreement, BluShark grants Affiliate a limited, non-exclusive, non-transferable, and revocable right to promote BluShark products using approved tracking links, banners, creatives, and product feeds made available through AWIN.
2. Permitted Promotional Methods
Affiliate may:
Place approved BluShark banners, links, and creatives on Affiliate’s website(s), blog(s), or social media channels.
Include approved links or creatives within non-spam, permission-based email communications.
Use product links and data solely from the AWIN product feed or Offer section.
All promotional content must:
Comply with all applicable laws, regulations, and AWIN policies.
Be accurate, non-misleading, and clearly identify Affiliate as an independent third party.
3. Prohibited Content and Sites
Affiliate may not promote BluShark on or through any site or channel that contains or promotes:
Adult, pornographic, or sexually explicit content
Hate speech, violence, discrimination, or illegal activity
Malware, spyware, adware, or deceptive practices
BluShark reserves the right to immediately suspend or terminate Affiliate participation for violations of this section.
4. Link and Content Restrictions
Affiliate agrees that:
Direct linking to BluShark websites outside of the AWIN platform is prohibited.
Product links must be taken only from the official AWIN product feed.
Altering BluShark creatives is strictly prohibited without written permission.
5. Prohibited Advertising Practices
The following practices are strictly prohibited:
Any “desktop” advertising schemes or software-based ad delivery.
Pop-ups, pop-unders, or forced merchant windows not initiated by a direct user click.
Automatic redirects, cookie stuffing, or hidden tracking mechanisms.
Use of iframes or scripts to set cookies without a user’s intentional action.
6. Pay-Per-Click (PPC) and Search Restrictions
Affiliate may not engage in PPC or paid search activity that directs traffic to BluShark directly.
Specifically prohibited actions include:
Bidding on the brand term “BluShark,” “BluShark Straps,” or any misspellings or variations
Using the BluShark brand in:
Subfolders (e.g., www.affiliate.com/blushark)
Subdomains (e.g., www.blushark.affiliate.com)
Ad titles or ad copy
Advertising as or impersonating BluShark
Running ads on competitor brand terms
Sending traffic through automatic redirects
Any violation may result in immediate termination and forfeiture of commissions.
7. Brand Representation
Affiliate may not represent itself as BluShark or imply any formal partnership, employment, or agency relationship beyond participation in the affiliate program.
8. Discount and Voucher Code Sites
If Affiliate operates a coupon or deal website:
Affiliate may not display invented, misleading, expired, or unauthorized discount codes.
Codes intended for other channels or affiliates may not be promoted.
Use of hidden iframes or cookie-setting tactics is strictly prohibited.
BluShark reserves the right to terminate participation and void commissions for violations.
9. Email Marketing
Affiliate is solely responsible for compliance with all applicable email marketing laws, including CAN-SPAM, GDPR, and similar regulations.
10. Fraud and Abuse
Fraud is strictly prohibited.
Fraud includes, but is not limited to:
Artificially generating clicks, leads, or sales
Use of bots, scripts, frames, iframes, or page refreshing
Any attempt to manipulate tracking, attribution, or commissions
Any attempted or actual fraud will result in immediate termination and voiding of all commissions.
11. Affiliate Payments
Commissions are tracked and reported through AWIN.
Transactions are subject to validation, cancellation, and return review.
BluShark operates a 365-day payment window.
Certain transactions may be delayed or declined due to order cancellations, returns, fraud review, or supplier confirmation.
Commission eligibility is governed by AWIN’s payment and validation policies.
12. Cookies
BluShark operates a 30-day cookie duration, unless otherwise specified in AWIN.
13. Email Communications
BluShark may send Affiliate emails relating to:
Program updates
Policy changes
Account or compliance notices
14. Privacy
BluShark respects Affiliate privacy and will not knowingly disclose personal information to third parties except as required to operate the program, comply with law, or through AWIN’s systems.

15. Changes to the Agreement or Program
BluShark reserves the right to modify, suspend, or terminate this Agreement or any part of the affiliate program at any time.
Continued participation after changes take effect constitutes acceptance.
16. Termination
Either party may terminate participation at any time.
Upon termination, all promotional activity must cease immediately.
BluShark reserves the right to withhold unpaid commissions in cases of fraud or material breach.
17. Independent Contractors
The parties are independent contractors. Nothing in this Agreement creates any partnership, joint venture, agency, or employment relationship.
18. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.
By enrolling in the BluShark Straps affiliate program through AWIN, you acknowledge and agree to all terms set forth above.
