Please read these Program Terms carefully. These Terms govern your participation as an Affiliate (“you” or “Affiliate”) in the EYCE LLC Affiliate Program (“Program”) operated through the Awin affiliate network (“Awin”). By submitting an application to the Program or participating as an Affiliate, you agree to be bound by these Terms.
As used herein, “EYCE,” “we,” or “us” refers to EYCE LLC. “Site” refers to any website, social media account, or digital property used by the Affiliate to promote EYCE.
1. Enrollment & Acceptance - To participate in the Program, you must submit a complete affiliate application through Awin. EYCE reserves the right, in its sole discretion, to approve or reject any application for any reason. Applications may be rejected or later terminated if the Affiliate’s content, audience, or promotional methods are deemed unsuitable, including but not limited to sites or content that:
- Promote violence, hate, or discrimination
- Promote illegal activity or unlawful product use
- Contain misleading, fraudulent, or deceptive content
- Infringe upon EYCE’s intellectual property
- Misrepresent themselves as EYCE or impersonate EYCE branding
- Target minors or restricted audiences
- Violate applicable laws, regulations, or Awin policies
Acceptance into the Program does not guarantee continued participation. EYCE reserves the right to remove Affiliates at any time.
2. Affiliate Links & Tracking - Approved Affiliates may use tracking links, banners, and creatives provided through the Awin platform. Only valid links generated by Awin will be tracked for commission eligibility. EYCE is not responsible for tracking issues caused by improperly formatted links, browser restrictions, disabled cookies, or third-party interference.
3. Promotional Guidelines & Restrictions - Affiliates agree to the following conditions:
- No framing, mirroring, or modifying EYCE websites or content
- No impersonation of EYCE or representation as an official brand channel
- No unsolicited email, spam, or unauthorized mass messaging
- No redistribution of EYCE customer or affiliate communications
- No misleading claims about product use, legality, or effects
EYCE products are marketed for legal herbal use only. Content promoting illegal substances, controlled substances, tobacco, nicotine, or restricted behavior is strictly prohibited.
4. Trademark & Paid Media Restrictions - Affiliates may not:
- Register domains containing “EYCE” or product name variations
- Bid on EYCE brand terms, trademarks, or misspellings in paid search
- Use EYCE trademarks in paid ads without prior written approval
Use of EYCE trademarks is limited to approved creatives and must not imply endorsement beyond the affiliate relationship.
5. Order Processing & Customer Relationship - All customer transactions, fulfillment, returns, and customer service are handled exclusively by EYCE. Customers purchasing through affiliate links are customers of EYCE. EYCE reserves the right to reject, cancel, or refund orders in accordance with its policies.
6. Commissions & Validation - Affiliate commissions are calculated based on qualifying net sales, excluding taxes, shipping, refunds, chargebacks, and fraudulent transactions. Commission validation follows EYCE’s published returns period plus Awin’s validation buffer. Transactions not declined within the validation window may auto-approve per Awin policy. Commission rates and structures are set within the Awin platform and may be updated at any time.
7. Compliance & Monitoring - EYCE reserves the right to monitor Affiliate activity and promotional methods to ensure compliance with these Terms. Affiliates agree to provide reasonable cooperation if compliance issues arise. Failure to comply may result in withheld commissions, suspension, or removal from the Program.
8. Termination- Either party may terminate participation in the Program at any time. EYCE may terminate immediately for violations, fraud, misrepresentation, or non-compliance. Upon termination, Affiliates must remove all EYCE links, trademarks, and promotional materials.
9. Independent Contractor Relationship - Affiliates are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship. Affiliates have no authority to bind EYCE or make representations on its behalf.
10. Confidentiality - Non-public information regarding EYCE operations, pricing, commissions, or business practices is confidential and may not be disclosed without prior written consent.
11. Limitation of Liability - EYCE shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program. EYCE’s total liability shall not exceed the commissions paid or payable to the Affiliate.
12. Indemnification - Affiliates agree to indemnify and hold harmless EYCE, its officers, employees, and partners from any claims, losses, or damages arising from Affiliate content, conduct, or breach of these Terms.
13. Modifications - EYCE may modify these Terms at any time by posting updated terms within Awin or providing notice through the platform. Continued participation constitutes acceptance of any changes.
