1. Introduction
These Terms & Conditions (“Terms”) govern participation in the Pearky Affiliate Programme (“Programme”), operated by Yeehlow Ltd under the brand name Pearky. By joining the Programme, the affiliate (“Affiliate”, “You”) agrees to comply with all conditions below. Pearky reserves the right to update or modify these Terms at any time. Continued participation constitutes acceptance of any changes.
2. Programme Overview
The Pearky Affiliate Programme allows Affiliates to earn commissions by promoting Pearky eSIMs through approved marketing channels and directing users to www.pearky.com or other authorised Pearky links.
3. Commission Structure
Standard Commission Rate: 7%-15% per first-time sale.
High-Volume Tier: 100+ eSIM sales per day = 15%-20% commission.
Cookie Duration: 30 days.
Non-Eligible Transactions: Cancelled orders, refunds, chargebacks, fraudulent or invalid transactions.
4. Payout Terms
Payment schedule: Awin’s standard payment cycle.
Payment method: As provided through Awin.
Refunds or chargebacks automatically void related commissions.
5. Affiliate Eligibility
No country restrictions.
Permitted Affiliates: coupon/deal sites, cashback platforms, content creators, travel blogs, influencers (pre-approved).
Prohibited: incentivised traffic, adult content, VPN/proxy traffic, fraudulent activity.
6. Promotional Rules
Brand Bidding: Not allowed.
PPC Advertising: Allowed for non-brand keywords. - In order to avoid broad and phrase match issues we also require affiliates to add ‘Pearky’, “Pearky eSIM” as a negative into any PPC campaigns they are running. Direct linking is also NOT permitted to the Pearky site.
Paid Social Ads: Allowed.
Influencers: Pre-approval required.
Email Marketing: Must comply with anti-spam laws (GDPR, CAN-SPAM).
Logo & Assets: Only approved creatives may be used.
CONTENT AND PROMOTIONS:
- Affiliates are not allowed to engage in remarketing or retargeting activities.
- Only content published in the language of the target country is permitted.
- Content with offensive, discriminatory, political, pornographic, or health-threatening references is strictly prohibited.
- Affiliates must disclose sponsored content on social media by using appropriate tags such as #PearkyAffiliates.
- We reserve the right to suspend or block affiliates who do not comply with our Creative Assets guidelines or publish inappropriate content.
PROMOTIONAL CODES:
- Only promotional codes provided directly by Pearky within the affiliate program may be used. Use of unauthorized codes will result in non-attribution of sales to the affiliate.
- Affiliates must not distribute promotional codes on deal sites, coupon aggregators, cashback, or loyalty platforms unless explicitly approved by Pearky.
TRANSACTION VALIDATION:
- Commissions are due for validated transactions only. Pearky reserves the right to verify and confirm conversions before the commission is paid. Valid conversions are subject to internal checks and must meet our performance criteria.
- eSIM orders, which include successful registrations and payment completion, will be considered valid transactions. Returns or cancellations are excluded from the commission.
- Validation of conversions will occur within 30 days of the transaction. Only the last-click conversion will be rewarded.
- No commission will be paid if no valid transactions are recorded.
7. Prohibited Activities
Cookie stuffing, URL hijacking, fake leads, misrepresentation, unauthorized discounts, spam, trademark violations, fraudulent activity. Violations may result in removal and loss of commissions.
8. Termination
Pearky may terminate any affiliate with or without notice for breaches. Pending commissions may be forfeited if violations occur. Legitimate unpaid commissions prior to termination will be honoured unless tied to fraud or breaches.
9. Intellectual Property
All trademarks, logos, assets, and content remain the property of Yeehlow Ltd. Affiliates may not modify or redistribute without permission.
10. Liability & Indemnification
Pearky is not responsible for loss of revenue, system outages, or tracking failures. Affiliates participate at their own risk. Affiliates indemnify Pearky for claims arising from their promotions.
11. Data Protection & Privacy
Affiliates must comply with GDPR, CCPA, PECR, and other privacy laws. Personal data of users cannot be collected on Pearky’s behalf.
12. Governing Law
Terms are governed by the laws of England & Wales. Disputes shall be resolved in the courts of England & Wales.
