2. Partner Responsibilities
Compliance: Partners must comply with all applicable laws, regulations, and industry best practices, including data protection regulations.
Ethical Marketing: Partners must engage in ethical and responsible marketing practices, avoiding any deceptive or misleading tactics. This includes:
- Transparency: Clearly disclose the affiliate relationship to consumers.
- Misrepresentation: Avoid misrepresenting PLAYin CHOC products or services in any way.
- Spamming: Refrain from sending unsolicited emails or engaging in any form of spamming.
Brand Protection:
- Paid Search: Partners are kindly asked to refrain from bidding on "Branded terms" (e.g., "PLAYin CHOC," "Play in Choc," "Playinchoc," specific product names) or variations thereof without prior written consent.
Data Protection: Partners must ensure the confidentiality and security of any customer data obtained through the affiliate program.
Contact Information: All partners must be contactable within a reasonable timeframe (1 week).
Marketing Copy:
- Affiliates must only use the marketing copy approved by the merchant.
- Affiliates may request bespoke copy from the merchant or submit their own copy for review by the merchant prior to use.
- Affiliates who choose to host their own copy and creative must agree to amend or remove this copy within 7 days upon being requested to do so by the merchant. Failure to comply with a request of this nature will result in the affiliate being suspended from the affiliate program.
Email Marketing:
Email affiliates are permitted; however, all copy and creative must be submitted to the merchant prior to broadcast.
Deep Linking:
Affiliates may deep link to any page on the merchant's website.
PPC Activity:
No PPC activity is permitted unless explicit permission is given by the merchant.
3. Promotions
Voucher Codes: Voucher codes are available through the program and can be used by affiliates.
Specific Promotions: Where we've agreed on a special voucher code for a particular affiliate, the marketing activity will be sent for our prior approval by one of our account managers.
4. Program Termination
PLAYin CHOC reserves the right to terminate this agreement at any time, with or without cause, upon written notice. PLAYin CHOC may also terminate this agreement immediately if a partner violates these terms and conditions.
5. Disclaimer
PLAYin CHOC makes no warranties or representations regarding the affiliate program or the results that may be achieved through participation.
6. Amendments
PLAYin CHOC reserves the right to amend these terms and conditions at any time. Any changes will be communicated to partners.
7. Governing Law
Disputes related to the program are governed by the laws of England and Wales.
