Permanent Vacation Affiliate Program Terms and Conditions
These Terms and Conditions constitute a legal agreement between you ("Affiliate", "you", or "your") and Permanent Vacation ("Permanent Vacation", "we", "us", or "our"). By applying to or participating in the Permanent Vacation Affiliate Program ("Program"), you agree to comply with the following terms.
1. Program Enrollment and Eligibility
Participation in the Program is subject to approval by Permanent Vacation. We reserve the right to approve, reject, suspend, or terminate any Affiliate at our sole discretion, including but not limited to cases of fraud, misrepresentation, trademark misuse, or brand misalignment.
Affiliates must be at least 18 years old, operate in compliance with all applicable laws and regulations, and align with Permanent Vacation’s brand values and positioning.
2. Affiliate Responsibilities
Affiliates agree to promote Permanent Vacation in an ethical, accurate, and lawful manner.
You must clearly disclose affiliate relationships in accordance with FTC, ASA, and other applicable advertising regulations, use only approved creatives, links, and messaging, and represent yourself as an independent publisher and not as Permanent Vacation.
You may not engage in deceptive, misleading, or fraudulent practices, use spam, forced redirects, pop ups, or cookie stuffing, or imply exclusivity, endorsements, or collaborations without written approval.
3. Commission Structure
Commissions are earned only on valid, completed purchases tracked through your unique affiliate link.
Commission rates may vary and are subject to change. Returned, canceled, fraudulent, or invalid transactions are not commissionable. Commission increases are discretionary and performance based.
Payment terms are governed by the affiliate network platform and are typically paid monthly following the validation period.
4. Cookie Duration and Attribution
Unless otherwise stated, standard cookie duration is 30 days. Attribution is last click unless de duplicated by other paid channels. Creator partners may be eligible for extended attribution windows.
5. Promotional Restrictions and PPC Policy
Unless explicitly authorized in writing by Permanent Vacation, Affiliates may not bid on Permanent Vacation trademarks, brand terms, misspellings, or variations in paid search, register or use Permanent Vacation or variations thereof in domain names, subdomains, or social handles, or direct link to Permanent Vacation’s website from paid search or paid social ads.
If coupon related PPC is permitted, only approved keyword combinations may be used, landing pages must be coupon specific, and negative keyword lists must include Permanent Vacation exact match.
Failure to comply may result in commission reversals or termination.
6. Discount Codes and Offers
Affiliates may only promote discount codes provided directly by Permanent Vacation or through the affiliate network.
Use of unauthorized, expired, or misleading codes may result in commission being set to zero, and temporary suspension or permanent removal from the Program.
Expiration dates must be clearly displayed and outdated offers removed promptly.
7. Email and Social Media Marketing
Email marketing is permitted only if campaigns are CAN SPAM compliant, Permanent Vacation is notified in advance where required, and suppression lists are respected.
Social media content must be clearly disclosed as advertising using appropriate tags, avoid impersonating or registering accounts resembling Permanent Vacation, and not post directly on Permanent Vacation’s official social channels to divert traffic.
8. Intellectual Property
Affiliates are granted a limited, non exclusive, revocable license to use Permanent Vacation’s approved trademarks, logos, and creatives solely for Program participation.
You may not alter logos or brand assets, use Permanent Vacation IP outside the scope of approved promotion, or register trademarks, domains, or social accounts incorporating Permanent Vacation.
All goodwill generated inures solely to Permanent Vacation.
9. Monitoring and Compliance
Permanent Vacation reserves the right to monitor Affiliate activity and placements, request changes to content, links, or positioning, and audit traffic sources and promotional methods.
Affiliates must comply promptly with any corrective requests.
10. Termination
Either party may terminate participation at any time, with or without cause.
Upon termination, all affiliate links, creatives, and brand references must be removed. Outstanding commissions may be forfeited if earned through prohibited activity.
11. Limitation of Liability
Permanent Vacation shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program.
Total liability shall not exceed the commissions paid to the Affiliate under this Agreement.
12. Indemnification
Affiliate agrees to indemnify and hold harmless Permanent Vacation, its affiliates, officers, and employees from any claims, damages, or expenses arising from breach of these Terms, misrepresentation or unlawful promotion, or violation of third party rights.
13. Confidentiality
Any confidential or proprietary information disclosed during participation in the Program must not be shared or used outside the scope of the Program without written consent.
14. Modifications
Permanent Vacation reserves the right to modify these Terms at any time. Continued participation following updates constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction determined by Permanent Vacation, without regard to conflict of law principles.
