1. Program Overview
Welcome to the OAS Mobility Awin Affiliate Program (the “Program”). By registering and participating, you (“Affiliate,” “you,” or “Partner”) agree to these Terms and to Awin’s rules and policies. If there is any conflict between these Terms and Awin’s policies, the stricter standard will apply.
2. Eligibility & Enrollment
You must complete Awin registration and submit your site/media for review. Promotion may begin only after our approval.
Approval or rejection is at our sole discretion based on brand fit, content quality, compliance, and historical performance.
We may suspend or terminate participation at any time via written notice (including Awin messages/email), especially in cases of non-compliance.
3. Commission & Invoicing
Standard Commission: 10% of Net Sales on Qualified Orders.
Net Sales Definition: Order value excluding taxes, shipping, gift card face value, discounts/coupons applied, and any amounts later refunded, charged back, or canceled.
Non-Qualifying Cases include (without limitation): fraudulent/invalid traffic or orders, duplicate/test orders, self-purchases/self-referrals, non-compliant traffic or promotion, missing disclosures, and resale via marketplaces or third-party channels.
Locking & Payment: Order validation/locking, declines, and commission payments follow Awin’s processes; commissions are paid via Awin subject to its thresholds and timelines.
Attribution & Tracking: Governed by Awin’s tracking and attribution rules (e.g., cookie window, cross-device, last-click/channel priority). Updates to Awin policies will apply automatically.
Currency & Taxes: Paid in Awin’s billing currency. You are responsible for complying with applicable tax laws and for any taxes due.
4. Permitted & Prohibited Promotion Methods
4.1 Content / Social / Blog / Reviews
Original reviews, guides, comparisons, and experience-based content are allowed. Claims must be truthful and not misleading.
You must include a clear and conspicuous affiliate disclosure (e.g., “This post contains affiliate links; we may earn a commission.”) and comply with applicable regulations (e.g., FTC/ASA).
Follow each platform’s community guidelines (YouTube, Instagram, TikTok, X, etc.); do not use banned tags or messaging.
4.2 Email Marketing
Allowed only to subscribers who have validly consented to receive marketing emails, in compliance with anti-spam laws (e.g., CAN-SPAM/GDPR/ePrivacy).
Buying lists, forced opt-ins, or hiding unsubscribe options is prohibited.
When using Awin tracking links, do not impersonate OAS Mobility in the sender name or subject line.
4.3 Paid Advertising (PPC/Display/Social)
Strictly prohibited: bidding on our brand/trademark terms or misspellings/variants (in search engines or marketplace search), and direct-linking with affiliate links.
Non-brand keyword buying is allowed only to your own content pages; no bridge/redirect cloaking.
Do not use our brand name/trademarks/official domain as the ad account name, ad title, or display URL.
You must also comply with each platform’s ad policies (Google, Meta, etc.).
4.4 Coupons / Cashback / Incentives
Coupons and promo information must come from our officially published sources.
Prohibited: posting or indexing non-public/expired/employee-only/erroneous codes.
Cashback/incentive sites must ensure compliant sources and genuine users; do not encourage fake transactions or coupon abuse.
4.5 Technical & Compliance Restrictions
Prohibited: cookie stuffing, forced redirects, cloaking, toolbar/extension hijacking, pop-ups/unders that interfere with user choice, auto-redirects, malicious code or tracking scripts, and unauthorized scraping of brand/product data.
Do not make misleading modifications to our assets; do not imply any undisclosed relationship (e.g., JV, agency, exclusivity).
Do not create domains, apps, or mini-programs that are confusingly similar to oasmobility.com.
5. Self-Purchase & Internal Use
Self-purchases and self-referrals are strictly prohibited (including purchases by close contacts or abnormal orders from the same device/address). We may cancel commissions and terminate participation if detected.
6. Brand & Asset Usage
We grant you a non-exclusive, revocable license to use our brand name, logo, product images, and official copy solely for Program promotion.
Do not alter assets in a misleading way, and do not suggest relationships beyond this Program.
We may request updates or removal at any time. All rights and IP remain with us or our licensors.
7. Pricing & Availability
Prices, availability, shipping times, and after-sales policies are subject to change. The oasmobility.com website prevails. Keep your content up-to-date to avoid outdated or inaccurate information.
8. Data & Privacy
Any personal data you collect must be processed lawfully (including GDPR where applicable) and secured appropriately, and used only for legitimate marketing purposes.
Order, conversion, and commission data for this Program are based on Awin’s reporting. Do not disclose or use such data for unrelated purposes without permission.
9. Intellectual Property & Confidentiality
Non-public information obtained through this Program (e.g., commission structures, KPIs, campaign plans) is confidential.
Do not register or apply for trademarks, domains, social handles, or app names that are identical or confusingly similar to ours.
10. Violations & Enforcement
For suspected non-compliance, we may: pause payouts, extend validation windows, cancel commissions, invalidate links, or terminate participation.
If violations or refunds/chargebacks are found after payment, we may claw back or offset from future commissions.
11. Term, Changes & Termination
The Program is effective upon your approval and continues until terminated by either party.
We may update these Terms or commission structures from time to time and notify you via the Awin Program page or message/email; continued participation after publication constitutes acceptance.
Either party may terminate via Awin’s notice mechanism. Upon termination, you must remove or replace all related links and assets within 【7】 days.
12. Limitation of Liability
To the extent permitted by law, we and our affiliates are not liable for any indirect, incidental, punitive, or consequential damages. Our aggregate liability for direct damages is limited to the total commissions you actually received under this Program during the preceding 3 months.
