Welcome to the MAE Affiliate Program! These terms and conditions govern your participation in our program through AWIN. By joining, you confirm that you have read, understood, and agree to these terms, which comply with US laws and AWIN’s guidelines.
1. Eligibility
- Affiliates must be 18 years or older to participate.
- Only affiliates operating websites, blogs, or social media platforms in compliance with US law, including advertising regulations, are eligible.
- Affiliates must not promote MAE on websites containing inappropriate, illegal, or offensive content.
- MAE reserves the right to approve or reject any application without explanation.
2. Commission and Payments
- Affiliates will earn 15% commission on valid sales generated through their unique affiliate links.
- Qualifying transactions exclude refunds, cancellations, shipping costs, and discounts.
- Commissions are payable 30 days after the transaction is validated, subject to AWIN’s payment thresholds and schedules.
- Payments are made via AWIN's platform. Affiliates are responsible for ensuring their payment details are accurate and up-to-date.
3. Tracking and Attribution
- Sales are tracked using cookies valid for 30 days.
- Transactions completed outside the cookie window or not tracked due to user actions (e.g., clearing cookies) will not qualify for commission.
- MAE is not responsible for tracking failures caused by technical issues, platform errors, or violations of these terms.
4. Affiliate Responsibilities
- Affiliates must clearly disclose their affiliate relationship in compliance with American Advertising Guidelines e.g., using hashtags such as “#ad” or “#affiliate”.
- Affiliates may only use promotional materials provided or approved by MAE.
- Affiliates must not engage in deceptive marketing practices, such as misleading ads, cookie stuffing, or false claims about MAE products.
- Affiliates are prohibited from bidding on MAE branded keywords, using unauthorized PPC campaigns, or creating domains/social media handles that impersonate MAE.
5. Prohibited Activities
- Affiliates may not promote MAE on websites with offensive, illegal, or discriminatory content.
- Affiliates must not use spam emails, unsolicited messages, or deceptive practices to promote MAE.
- MAE reserves the right to suspend or terminate affiliates engaging in prohibited activities without notice.
6. Branding and Intellectual Property
- Affiliates are granted a limited, non-exclusive license to use MAE trademarks, logos, and marketing materials for promotional purposes.
- Affiliates must not modify MAE branding or create derivative works without explicit permission.
- Unauthorized use of intellectual property will result in immediate termination and potential legal action.
7. Termination
- Either party may terminate this agreement with 14 days' written notice.
- MAE reserves the right to terminate any affiliate without notice for breach of these terms.
- Upon termination, affiliates must cease all use of MAE promotional materials and branding.
8. Confidentiality
- Affiliates agree to treat all non-public information about the program, including commissions, campaign details, and performance metrics, as confidential.
- Affiliates must not disclose or share confidential information without MAE's prior written consent.
9. Liability
- MAE is not liable for indirect, incidental, or consequential damages arising from participation in the program.
- MAE is not responsible for untracked or invalid transactions due to technical errors, user actions, or policy violations.
- Affiliates participate in the program at their own risk.
10. Compliance with US Law
- Affiliates must comply with all applicable U.S. federal, state, and local laws and regulations, including but not limited to the Federal Trade Commission (FTC) Act, CAN-SPAM Act, and state consumer protection and privacy laws.
Affiliates must ensure that all marketing and promotional activities comply with the FTC’s Endorsement Guides, truth-in-advertising standards, and any other relevant industry advertising guidelines.
11. Governing Law
- This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Oregon, without regard to its conflict of law principles.
Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Oregon and each party hereby consents to the personal jurisdiction of such courts.
12. Amendments
- MAE reserves the right to update these terms at any time. Affiliates will be notified of any material changes, and continued participation constitutes acceptance of the revised terms.
