Thamara Affiliate Program – Terms & Conditions
Welcome to the Thamara Affiliate Program. By enrolling, you agree to the following rules and guidelines which define how we work with our partners. These terms are designed to protect both Thamara and our affiliates, while ensuring transparency and fair play in how commissions are earned.
1. Joining the Program
1.1 Application Requirement
To become part of our affiliate network, you must complete and submit the official application form.
1.2 Review & Approval
Each application undergoes a manual review and may take up to five (5) business days. Enrollment is not guaranteed, and we reserve the right to approve or reject applicants at our sole discretion.
1.3 Grounds for Rejection
Applications may be declined if we consider the website, traffic source, or promotional style inappropriate or inconsistent with our brand values. Examples include websites or campaigns featuring unlawful activity, spam, adult or offensive content, misleading claims, or practices that could harm Thamara’s reputation.
1.4 Reapplication Restrictions
If your application is denied, you may not attempt to reapply using the same domain/URL. Submitting a new application with another domain while later re-adding the previously rejected one is also prohibited.
1.5 Right of Termination
Thamara reserves the right to suspend or terminate any affiliate account at any point—with or without notice—if we find activity that conflicts with these terms or with the best interests of our brand.
2. Duties and Responsibilities of Affiliates
2.1 General Conduct
As an affiliate of Thamara, you agree to operate with integrity and professionalism. Specifically, you commit to:
2.2 Accurate Information
Providing accurate and current information during registration and throughout your participation. This includes your full legal name (and company name if applicable), payment details, tax information, valid contact information, and the URLs or channels where Thamara will be promoted. Outdated or false details may result in withheld payments or termination of your account.
2.3 Account Limitation
Maintaining a single affiliate account. Multiple or duplicate accounts are not permitted unless explicitly authorized by Thamara.
2.4 Referral Standards
Referring genuine customers. You are expected to attract users who provide real information, keep their accounts active, and comply with our service terms. Referrals that cancel during the 30-day money-back period will not generate commission.
2.5 Use of Promotional Assets
Using only approved promotional assets. All banners, creatives, coupon codes, and links must be taken directly from our affiliate portal or pre-approved by Thamara. Editing, recreating, or issuing your own promotional materials without permission is forbidden.
2.6 Brand Integrity
Protecting Thamara’s image. You must not misrepresent our services, create false claims, or encourage practices that result in financial or reputational loss to Thamara.
2.7 Legal Compliance
Complying with the law. Affiliates are responsible for ensuring that all their marketing activities follow applicable advertising regulations, copyright and trademark laws, and data protection standards.
2.8 Disclosure
Disclosing affiliate links. In line with FTC and similar international guidelines, you must clearly state your affiliate relationship when using our links. Failure to disclose may result in forfeited commissions.
3. Activities That Are Strictly Prohibited
3.1 Self-Referrals
Purchasing Thamara services through your own affiliate links (“self-referrals”), or encouraging employees, friends, or family to do so.
3.2 Paid Ads Restrictions
Running PPC/PPI campaigns that bid on “Thamara,” its variations, misspellings, or related branded keywords.
3.3 Direct Linking
Direct-linking to Thamara’s official website via paid ads.
3.4 Technical Manipulations
Using iframes, cloaking, bots, or any other technology that forces cookies or sets tracking without a user’s intentional click.
3.5 Unauthorized Incentives
Offering unauthorized incentives such as cashbacks, gifts, discounts, or bonus rewards.
3.6 Prohibited Content
Promoting Thamara through adult, violent, racist, hacking-related, illegal, or misleading content.
3.7 Fake Reviews
Publishing templated or fake reviews designed to manipulate user trust.
3.8 Spam Distribution
Distributing affiliate materials through unsolicited emails, spam forums, or automated posting tools.
3.9 Fraudulent Traffic
Benefiting from fraudulent, fake, or low-quality traffic sources, whether knowingly or not.
4. Liability and Ownership of Content
4.1 Responsibility for Content
Affiliates are fully responsible for the creation, operation, and maintenance of their websites or marketing channels. This includes ensuring that content is lawful, accurate, and respectful of intellectual property rights.
4.2 Thamara Disclaimer
Thamara assumes no responsibility for the content published on affiliate platforms—even if official banners or links are included.
4.3 Indemnification
You agree to indemnify and hold Thamara harmless against any claims, damages, or expenses (including legal fees) resulting from your website or promotional activities.
5. Affiliate Rights
5.1 License
Affiliates are granted a limited, revocable, non-transferable license to use Thamara’s promotional assets solely for the purpose of marketing our services. This license ends immediately if your affiliate account is suspended or terminated.
5.2 Request for Information
We may request, at any time, that you provide details of your promotional channels and strategies. Failure to comply may result in withheld commissions or account closure.
5.3 Thamara’s Discretion
Thamara retains the right to decide what qualifies as acceptable promotion and may cancel commissions that arise from activities deemed harmful, misleading, or non-compliant with these terms.
6. Affiliate Advertising & Promotional Guidelines
6.1 Use of Thamara Materials
Affiliates may only use official promotional assets provided in the Thamara Affiliate Area or materials that have been explicitly approved in writing by our team.
These assets may include our trade name, service marks, approved logos, and advertising slogans.
By using such materials, you are granted a limited, non-exclusive, non-transferable license to access and display them solely for promoting Thamara’s services.
This license automatically terminates if your affiliate account is suspended or closed.
6.2 Advertising Standards
Affiliates are expected to maintain ethical and transparent advertising practices. The following are not permitted under any circumstances:
6.2.1 Illegal or Spam Traffic
Unsolicited emails (spam), bot-generated clicks, or unauthorized posting of affiliate links in forums, message boards, or social groups.
Traffic driven by paid-to-click/read programs, banner exchanges, click farms, or any activity designed to artificially inflate visits.
6.2.2 Search Engine and Paid Ads Restrictions
You may not bid on keywords containing “Thamara,” any misspellings, or confusingly similar terms in Pay Per Click (PPC), Pay Per Impression (PPI), or paid social campaigns.
Direct linking to Thamara.com or using our domain/brand as a display URL in ads is forbidden.
Outranking Thamara’s own ads or competing with our official paid campaigns is strictly prohibited.
PPC campaigns must direct traffic to your own website or landing page, not directly to Thamara.
6.2.3 Content Misuse
Copying or modifying our creatives, icons, or banners without approval.
Publishing non-original, infringing, or templated reviews that mislead users.
Hosting expired offers, false promotions, or unauthorized coupon codes.
6.2.4 Incentives and Financial Offers
Offering cashbacks, rebates, gift cards, discounts, voucher codes, or “extra bonuses” to generate sales is not allowed unless explicitly approved by Thamara in writing.
Coupon-related campaigns are only valid when using codes we provide.
6.2.5 Technical Manipulations
Using iframes, cloaking, masking, or any method to drop affiliate cookies without an actual user click-through.
Masking the origin of traffic or hiding traffic sources not declared in your affiliate profile.
6.2.6 Unacceptable Content and Domains
Sites or campaigns containing pornography, adult material, racist, hateful, violent, defamatory, or illegal content are strictly prohibited.
Affiliate domain names, business names, logos, or products must not include “Thamara” or confusingly similar variations without our prior approval.
Affiliates must also not use third-party trademarks in domain names or campaigns without written authorization from the rightful owner.
6.3 Social Media & Public Channels
Affiliates may promote Thamara via social platforms such as Facebook, Twitter, Instagram, LinkedIn, or YouTube, provided that:
- You do not impersonate Thamara or create pages/accounts that appear to be official company channels.
- You do not use “Thamara” or confusingly similar variations in social handles, usernames, or page names.
- All posts comply with disclosure requirements, making it clear that affiliate links are used.
6.4 Thamara’s Right to Review
Thamara alone retains the authority to decide if your advertising and promotional activities align with our standards.
If we conclude that your methods are misleading, harmful, or otherwise unacceptable, we may take one or more of the following actions at our discretion:
- Provide you with a formal notice outlining the issue,
- Place your affiliate account on hold or permanently deactivate it without prior notice, and/or
- Withhold or revoke any commissions associated with the non-compliant activity.
7. Tracking & Cookies
7.1 Tracking Method
- Thamara uses browser cookies to automatically track affiliate referrals.
- When a visitor clicks on an affiliate link, a cookie is placed in their browser and used to record potential sales. This process may involve a redirect through Thamara’s affiliate tracking system.
- If technical, hardware, or software issues prevent proper tracking, cookies may not be placed. In such cases, commissions are not guaranteed, and any disputes will be reviewed on a case-by-case basis at Thamara’s sole discretion.
7.2 Cookie Duration
- Cookies are stored for ninety (90) days from the initial click.
- If the same user clicks a different affiliate’s link during this period, the most recent cookie overwrites any previous one. The commission will be assigned to the affiliate whose link was clicked last.
7.3 Limitations of Cookie Tracking
- Thamara is not responsible for commissions lost due to:
- Cookies deleted intentionally or unintentionally by the user,
- Users switching browsers, devices, or using Incognito/Private Browsing mode,
- Technical issues outside of Thamara’s reasonable control.
- In such scenarios, affiliates acknowledge that tracking cannot be guaranteed, and no retroactive claims for commissions will be accepted unless Thamara, at its discretion, validates the case.
7.4 Coupon Code Policy
- Coupons or promotional codes are not considered a valid tracking method unless the user also has a valid Thamara affiliate cookie in their browser at the time of purchase.
- Unauthorized coupon distribution may lead to cancellation of related commissions
8. Commissions & Payments
8.1 Eligibility for Commissions
A commission is only considered valid when all of the following conditions are met:
- The sale was generated through your active referral efforts and tracked by a valid Thamara affiliate cookie at the time of purchase.
- The referred customer has not previously used Thamara’s services or registered an affiliate account with us.
- The referred customer completed the order on their own, without your direct intervention (including acting on their behalf).
- The purchase was for a valid Thamara hosting plan (as published on our website). Services outside of these plans, or add-ons not listed, do not qualify.
- The customer’s initial payment has been fully processed and is not subject to refund, cancellation, or chargeback.
- The customer’s account remains active and in good standing beyond the applicable 30-day money-back guarantee period.
8.2 Commission Structure
- Commissions for recurring hosting plans are paid as a percentage of the sale value, typically ranging between 50% and 80%, depending on the plan and performance factors.
- Commissions for lifetime hosting plans are fixed amounts, usually between $50 and $100 per sale.
- The specific rate applicable to each referral will depend on the hosting package purchased, the market conditions at the time, and other internal factors determined by Thamara.
- While these ranges represent our standard commission framework, Thamara may, at its discretion, apply special considerations in certain cases to recognize outstanding performance or unique promotional efforts.
8.3 Approval Process
- All commissions are subject to manual review and approval by Thamara’s affiliate team.
- Commissions are not automatically approved after the refund window; they will be reviewed in line with Thamara’s internal schedules.
- Thamara reserves the right to freeze, delay, or reject any commission at our discretion if the sale appears fraudulent, non-compliant, or otherwise invalid.
8.4 Payout Schedule
- Approved commissions will be paid after the 30-day refund period has expired.
- Payments are issued during the first ten (10) days of each new month.
- Example: If a customer makes a purchase on November 20, their refund window closes on December 20, and your commission will be paid in the first 10 days of January.
- Only commissions with the status “Approved” are eligible for payout.
8.5 Payment Method & Thresholds
- Commissions are paid in USD via PayPal or wire transfer.
- Affiliates are responsible for ensuring their payment details are accurate and current.
- Payments will only be processed once the minimum payout threshold (as specified in the affiliate dashboard) has been met.
- Inactive balances below the threshold will roll over to the following month.
8.6 Taxes & Invoices
- Affiliates are solely responsible for reporting and paying taxes in accordance with the laws of their country of residence.
- If required by law, Thamara may deduct applicable taxes from commission payouts.
- By participating in this program, you agree that Thamara may issue self-billing invoices on your behalf for all commission payments.
8.7 Invalid or Reversed Commissions
- Commissions will not be paid for:
- Canceled accounts or accounts suspended for policy violations.
- Purchases refunded or subject to chargebacks.
- Sales generated through fraudulent, incentivized, or non-compliant practices.
- Thamara reserves the right to retract previously paid commissions if such conditions are discovered after payout.
8.8 Thamara’s Sole Discretion
- Thamara retains the exclusive right to determine what qualifies as a valid commission.
- We may decline or reverse a commission at any time, without the need to provide justification.
- Our decision regarding the status of a commission shall be final and binding.
9. Invoicing
9.1 Commission Statements
- Affiliates will have access to a detailed statement of commissions through their Thamara Affiliate Area.
- This statement serves as the official record of earned, pending, and approved commissions.
9.2 Self-Billing Invoices
- Where required by law, Thamara will issue self-billing invoices for all commission payouts, including any applicable taxes.
- By enrolling in the Thamara Affiliate Program, you expressly agree that:
- Thamara may generate invoices on your behalf for all commissions paid.
- You will not issue separate sales invoices for these payouts.
- You will promptly notify us if your legal name, company details, or tax registration status changes.
- This arrangement will remain in force for as long as your affiliate account is active or until your participation in the program ends.
10. Relationship of the Parties
10.1 Independent Contractors
- Participation in the Thamara Affiliate Program does not create any partnership, joint venture, franchise, agency, sales representative, or employment relationship between you and Thamara.
- As an affiliate, you act solely as an independent contractor.
10.2 Authority Limitations
- You are not authorized to make or accept offers, commitments, or representations on behalf of Thamara.
- You may not create content, statements, or marketing messages that suggest or imply a formal partnership beyond your role as an affiliate.
10.3 Ownership of Customers
- All individuals or businesses referred through affiliate links become direct customers of Thamara.
- Thamara retains full ownership of the customer relationship, and all rules, policies, and operating procedures applicable to customers will apply to them without exception.
10.4 Intellectual Property Rights
- Each party retains ownership of its own names, trademarks, service marks, logos, copyrights, and proprietary technologies.
- Affiliates may only use Thamara’s intellectual property in accordance with the limited license granted under this Agreement.
10.5 Confidential Information
- During your participation, you may receive access to confidential business information (e.g., commission rates, internal processes, customer data, or performance metrics).
- You agree to use such information exclusively for the purpose of promoting Thamara, and not to disclose it to any third party without our written consent.
- Your confidentiality obligations will continue even after termination of your affiliate account.
10.6 Indemnification
- You agree to indemnify and hold Thamara harmless from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from:
- The content and operation of your website or promotional channels,
- Your participation in the program, or
- Your violation of these Terms & Conditions.
11. Term & Termination
11.1 Term of Agreement
- This Agreement remains in effect from the date of your acceptance until it is terminated by either party.
11.2 Termination by Either Party
- Both Thamara and the Affiliate may terminate this Agreement at any time, with or without cause, by providing written notice (including email) to the other party. Such notice is considered immediate upon delivery.
11.3 Termination by Thamara
- Thamara reserves the right to suspend or close an affiliate account without prior notice in cases including, but not limited to:
- Violation of these Terms & Conditions,
- Fraudulent or harmful activity,
- Inactivity exceeding six (6) months without generating a sale.
11.4 Consequences of Termination
Upon termination of your account:
- You must remove all Thamara banners, links, promotional assets, and trademarks from your site within three (3) business days.
- All rights and licenses granted under this Agreement will be revoked immediately.
- You will only be entitled to unpaid commissions earned prior to the date of termination, provided they are valid and approved.
- If termination results from a violation of these Terms, Thamara reserves the right to withhold outstanding commissions.
- Termination does not release you from liability for any breach of this Agreement that occurred prior to termination.
12. Limitation of Liability
12.1 General Limitation
- To the maximum extent permitted by law, Thamara shall not be held liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to:
- Lost profits, revenue, or business opportunities,
- Costs of substitute services,
- Data loss, service interruptions, or reputational damages.
12.2 Aggregate Liability
- Thamara’s total liability to you, whether in contract, tort, or any other legal theory, shall not exceed the total commissions actually paid to you during the one (1) month period immediately preceding the claim.
12.3 Jurisdictional Limitations
- Some jurisdictions may not allow exclusions or limitations of liability. In such cases, Thamara’s liability will be limited to the maximum extent permitted by law.
12.4 Survival
- This clause shall survive termination of the Agreement.
13. Governing Law & Jurisdiction
13.1 Applicable Law
- This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Thamara operates, without regard to conflict of law principles.
13.2 Dispute Resolution
- Any disputes, claims, or controversies arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Thamara’s primary place of business.
14. Modifications to the Agreement
14.1 Right to Modify
- Thamara reserves the right to amend or update these Terms & Conditions at any time, at our sole discretion.
14.2 Notification of Changes
- Updates will be published on Thamara’s official website. This posting will serve as the sole method of notification unless otherwise required by law.
- Thamara may, at its discretion, also notify affiliates via email.
14.3 Acceptance of Modifications
- Your continued participation in the Affiliate Program after changes have been published constitutes your binding acceptance of the updated terms.
