AXOBOTANICA Affiliate Program: General Terms & Conditions
By applying to and joining the Axobotanica Affiliate Program, the Publisher (Affiliate) agrees to adhere to the following terms and conditions, which are non-negotiable and strictly enforced to ensure compliance and brand integrity.
1. Compliance & Health Claims (Non-Negotiable)
1.1. FTC Disclosure: Publishers MUST clearly and conspicuously disclose their financial relationship with Axobotanica on all promotional content (social posts, videos, blogs, emails). Required disclosures include, but are not limited to: #ad, #sponsored, or #paidpartnership placed prominently at the beginning of the post.
1.2. FDA/Health Claims: Publishers MAY NOT make any unsubstantiated or illegal health claims. This includes claims that Axobotanica products cure, treat, or mitigate any specific disease or condition. All health claims must be sourced directly from Axobotanica's official website or pre-approved by the Affiliate Manager.
1.3. Brand Authority: When referencing the physician founder, the exact approved title, "Physician-Formulated," must be used. Publishers may not create content that implies the founder endorses a specific post or outcome beyond their official formulation.
2. Trademark & Search Engine Marketing (PPC)
2.1. Brand Bidding (Prohibited): Publishers MAY NOT bid on the Axobotanica trademark or any close misspellings, variations, or derivatives (e.g., "Axo Botanica," "Axobotanica Reviews," "Axobotanica Discount") on any search engine (Google, Bing, Yahoo).
2.2. Negative Keywords (Required): All Axobotanica trademark terms MUST be added as negative keywords in all PPC campaigns to prevent ads from competing with the brand's official campaigns.
2.3. Direct Linking (Prohibited): Publishers MAY NOT direct link search traffic to the Axobotanica website. All paid traffic must land on the publisher's site (e.g., a dedicated review page) first.
3. Commission & Exclusions
3.1. Commissionable Value: Commission is paid exclusively on the final product subtotal after all discounts are applied. Commissions are NOT paid on VAT/Sales Tax, Shipping/Delivery Charges, or Credit Card/Processing Fees.
3.2. Wholesale Exclusion: Wholesale orders, distributor accounts, and bulk/resale purchases are NOT eligible for commission. Commissions associated with such orders will be automatically reversed.
3.3. B2B Lead Referral Bounty: If a publisher successfully refers a new, verified wholesale account or large B2B lead, a custom, manually negotiated finders fee or bounty may be paid outside of the standard commission structure. The publisher must contact the Affiliate Manager to discuss and pre-approve this activity.
3.4. Coupon/Voucher Codes: Commission is ONLY paid when a publisher promotes official, non-expired coupon codes explicitly provided within the Awin interface for their use. Promotion of any unauthorized codes will result in the immediate reversal of commissions and possible program termination.
4. Transaction Reversals
Axobotanica reserves the right to decline (reverse) commissions for any of the following reasons:
- Order canceled or order payment failed.
- Item was returned or fully refunded.
- Sale was deemed a duplicate order.
- Sale was generated by a Breach of these Program Terms (including illegal health claims or brand bidding).
- Order was identified as a non-commissionable Wholesale/B2B purchase.
5. Publisher Restrictions
5.1. Prohibited Methods: Publishers are expressly prohibited from using Adware, Toolbars, Cookie Stuffing, forced clicks, or any deceptive tactics that compromise the customer experience or artificially inflate conversion rates.
5.2. Media: Only official, approved creative assets (logos, images, video) provided in the Awin Creative Library may be used. Assets must not be altered, stretched, or distorted.
The acceptance of this agreement is a requirement for participation in the Axobotanica Affiliate Program.
