This Affiliate Program Agreement (the “Agreement”) is between Gorilla Mind LLC (the “Company”) and the individual or entity agreeing to these terms (the “Affiliate”).
Background
Welcome to the Gorilla Mind Affiliate Program (the “Program”). The purpose of the Program is to empower creators, publishers, and influencers who align with Gorilla Mind’s mission of delivering high-performance supplements, health products, and lifestyle solutions to a global audience.
We partner with Affiliates who are passionate about performance, self-improvement, fitness, and health, and who prioritize authentic content and value-driven recommendations over purely transactional promotion.
1. Affiliate Responsibilities
1.1 Affiliate Promotion
You agree to promote Gorilla Mind products in a way that is accurate, honest, and aligned with Gorilla Mind’s brand voice and strategic goals (as communicated to you through Program resources or directly).
1.2 Compliance with Laws
You must comply with all applicable laws, regulations, advertising standards, and FTC endorsement guidelines in your promotion of Gorilla Mind products. This includes proper disclosure of affiliate relationships.
1.3 Marketing Materials
Gorilla Mind may provide you with marketing materials (banners, graphics, copy, product images). You agree to:
Use only approved creative materials unless otherwise authorized.
Ensure all usage reflects Gorilla Mind’s brand identity, messaging, and compliance standards.
2. Restrictions and Regulations
2.1 Prohibited Activities
You agree not to engage in the following:
a. Using misleading, exaggerated, or deceptive claims about Gorilla Mind products.
b. Promoting products via spam, unsolicited communications, or incentivized clicks.
c. Offering unauthorized discounts, coupon codes, or promotions outside of those officially provided by Gorilla Mind.
d. Misrepresenting Gorilla Mind’s products or brand in any way.
e. Publishing or associating Gorilla Mind with content that is harmful, discriminatory, or offensive.
2.2 PPC Restrictions
You may not bid on paid advertising using Gorilla Mind’s branded terms (including but not limited to “Gorilla Mind,” “Gorilla Mode,” or product-specific terms), nor may you use broad match variations on these terms across search engines or paid ad platforms.
2.3 Conflict of Interest Disclosure
During the term of this Agreement, you must disclose any affiliate partnerships with direct competitors of Gorilla Mind if requested.
2.4 Confidentiality
You shall not disclose any confidential, proprietary, or Program-sensitive information received from Gorilla Mind, unless expressly permitted.
2.5 Termination & Non-Disparagement
If this Agreement is terminated, you agree to immediately discontinue all promotional activities related to Gorilla Mind and shall not disparage the Company, its products, or its brand.
3. Program Terms
All eligible sales referred through your affiliate links or authorized coupon codes will be tracked and credited to you through the Awin platform.
A 30-day cookie duration applies, meaning that purchases made within this time frame after a customer’s initial click will be attributed to you.
Payouts will be made in accordance with Awin’s payment schedules and policies.
Gorilla Mind reserves the right to modify Program terms, commission structures, or promotional rules at any time.
4. Termination
Gorilla Mind may suspend or terminate your participation at any time for:
Violation of this Agreement.
Misalignment with brand values.
Fraudulent, misleading, or unethical practices.
Inactivity or non-performance.
