Program Terms

Affiliate Program Terms & Conditions

 

These terms and conditions are between “you”—the affiliate—and Mebert Brands, an LLC doing business as Yaya Maria’s (“we”, “Yaya Maria’s”).
 

By joining our affiliate program on AWIN, you agree to the following terms and conditions. Complying with these terms is important because failure to comply may result in you (1) being removed from Yaya Maria’s affiliate program, and/or (2) not receiving commissions associated with non-compliant behavior, or—if those commissions were already paid out—having to give those commissions back.

 

1. General Guidelines

Be ethical and fair, and follow the law. Affiliates must promote our brand and products ethically, following all applicable laws and advertising regulations.

Make no false, misleading, or unsubstantiated health claims about our products. Such claims are strictly prohibited. For example, affiliates must not present Yaya Maria’s products as a cure or treatment for medical conditions.

Be positive. Affiliates agree to present our brand in a positive manner. Any negative content must be shown to an account manager prior to publication.

You and Yaya Maria’s are separate entities. Nothing contained within this Agreement shall be construed to form any joint venture, agency franchise, or employment relationship. 

No self-referrals or commissions on personal purchases.
 

2. Promotional Methods

Allowed Promotion Methods: You may promote Yaya Maria’s products through:

Content websites, blogs, and social media posts that provide valuable content.

Search engine optimization (SEO) for organic traffic.

Influencer marketing and reviews.

Email marketing, but only with prior approval by Yaya Maria’s, and you must familiarize yourself with and comply with anti-spam laws.

 

Prohibited Promotion Methods: You may not promote Yaya Maria’s products through:

Making false or exaggerated health claims.

Sending unsolicited emails (spam).

Deceptive marketing tactics.

Using misleading articles, deceptive advertorials, or unauthorized testimonials.

Coupon or discount sites. Also, coupon and cashback sites are not permitted to join our affiliate program.

Using unauthorized coupon codes, or on websites that promote unauthorized discount codes.

Linking directly to our website via paid ads.

Bidding on our brand name, product names, or related terms in Google Ads, Bing Ads, Facebook Ads, Tik Tok Ads or other similar platforms.

Using misspellings or variations on the Yaya Maria’s brand name in ad copy or domains.

On blogs, websites, or social media accounts that also contain or advertise adult, offensive, defamatory, violent, or illegal content.

On blogs, websites, or social media accounts with a thematic focus on content, products, services, or opportunities involving cryptocurrency, gambling, cannabis, violence, or illegal activity.
 

3. Branding & Compliance

Do not alter Yaya Maria’s branding, logos, or product images without permission. That is prohibited.

Do not mislead consumers into thinking you are an official Yaya Maria’s partner—for example, by using domain names that include the Yaya Maria’s brand name.

You must clearly state your affiliate relationship when promoting our products—for example, "This post contains affiliate links, and I may earn a commission." This is important to comply with U.S. Federal Trade Commission laws.

 

4. Social Media & Influencer Marketing

You must use authentic engagement. You may not purchase fake followers or use any kind of bots, website scrapers, malicious software, or misleading or illegal methods to generate engagement.

When promoting Yaya Maria’s products in social media posts, you must clearly disclose your affiliate relationship where applicable using hashtags or words such as #ad, #sponsored, or "Affiliate Link".

 

5. Commission & Payouts

Commissions are tracked via AWIN and paid per AWIN's payout schedule.

No commission is paid on wholesale purchases, shipping cost, sales tax, duplicate orders, disputed orders, cancelled orders, returns, or any fraudulent transactions.

 

6. Termination Policy

Affiliates violating these terms may be removed from the program without notice.

We reserve the right to modify these terms at any time.
 

7. You—Not Yaya Maria’s—are Responsible for Harm Arising from your Conduct (Indemnification):

The affiliate agrees to defend and indemnify our brand and hold us harmless against any and all legal claims and demands, including reasonable attorney’s fees, which may arise from or relate to Affiliates actions. In no event shall our company or any of our officers be liable for damages of any sort arising from an Affiliate’s conduct. 
 

8. Forum, choice of law, and jurisdiction

You, the affiliate, agree that Genesee County, Michigan shall be the sole and exclusive forum with jurisdiction over all claims relating to or arising out of this agreement. By entering into an affiliate arrangement with Yaya Maria’s (a Michigan LLC), you, the affiliate, agree to be subject to the personal jurisdiction of Michigan. You also agree to bring or transfer any claim against Yaya Maria’s in Genesee County Michigan, and hereby waive the right to any objection to that forum or venue, including assertion of the doctrine of forum non conveniens or similar doctrine. You further agree that all claims relating to or arising out of this agreement shall be governed by the laws of the state of Michigan.

 

9. Causes Beyond Our Control (Force majeure)

While we will deal fairly with affiliations and perform our obligations to you in good faith, we are not liable for any failure on our end to perform due to causes beyond our reasonable control.

 

You acknowledge and agree to these terms in exchange for the opportunity to earn commissions by participating in our AWIN affiliate program.
