Use of Cuckoo Brand
Cuckoo brand and trademarks must only be used in its current scheme and arrangement (as provided) and must not to be disaggregated or changed (including as to the colour scheme, palate, font style and size).
When displaying or using Cuckoo’s brand, Partner’s brand must be dominant and not give the impression that Partner and Cuckoo are part of the same group or in any way affiliated.
Partner may promote Cuckoo’s services through social media subject to these terms and conditions (see in particular “ethical alignment and compliance” and “use of Cuckoo materials and IP”)
Use of Cuckoo materials and IP
Partner must not incorporate, or copy Cuckoo URL or and derivation thereof as part of Partner’s URL.
Partner must bot hold itself out as Cuckoo, or otherwise give the impression that Partner is anything other than independent sales agent promoting and selling Cuckoo’s services as an independent business for a commission.
Partner may only use Cuckoo materials provided through the Awin Platform to sell and promote Cuckoo’s services and which must be used as directed, incorporating all qualifications, and not altered in any way.
Partner must ensure it only uses current Cuckoo material, offers and promotions and must therefore regularly check the Awin platform. Cuckoo reserves the right to reject any order placed by a customer which do not reflect Cuckoo’s then current promotional terms and Partner agrees to take full responsibility and issue an apology to any customer whose order is cancelled due to breach of this term.
If Partner wishes to use its own creative to sell or promote Cuckoo services or otherwise incorporate Cuckoo materials into Partner’s creative, it must first submit a copy of the creative to Cuckoo in the form in which it will appear, with at least seven days prior notice, which Cuckoo may approve or reject at its absolute discretion. If Cuckoo has not responded to Partner within 7 days of receipt, Partner may use the creative save that Cuckoo reserves the right to subsequently object to the use of such materials and instruct the Partner to remove or amend the same, which the Partner agrees to do no later than 72 hours after receiving Cuckoo’s instructions.
