These are our terms and conditions which apply to our Service (explained below). Please read the entire document carefully and contact us if anything is unclear. Summaries in capitals are not a substitute for the full text. Save a copy for future reference. These terms are only in English and replace any previous versions.

“Consumer” – an individual acting for purposes wholly or mainly outside that person’s trade, business, craft or profession.

“Content” – all information of any kind (articles, documents, blogs, images, photos, audio, video, advertisements) displayed, stored, or sent on or in connection with our Service.

“Service” – our website, our Web App, and any related services.

“Web App” – the “Stress Control” web application and any related services supplied by us.

“User” – people or organisations using our Service (whether or not registered with us).

HERE IS SOME CRUCIAL INFORMATION THAT WE WANT TO TELL YOU ABOUT RIGHT AT THE START

Stress Control is an evidence-based Cognitive Behavioural Therapy (CBT) approach designed to help address common mental health issues, including anxiety, depression, panic, poor sleep, and poor wellbeing. However, while our Service can be beneficial, it is not tailored to your situation.

Our Service is not intended to diagnose, prevent, or treat any medical condition, or to be used as a substitute for medical advice. We make no promise that the Service provides therapeutic benefit or that any particular wellness objective will be achieved. You agree to consult a qualified health professional (e.g., GP or healthcare provider) if you have concerns about your health. For urgent support, contact local mental health services or the Samaritans at 116 123 (UK and Ireland).

5. How you enter a legal contract with us

THIS SECTION TELLS YOU HOW AND WHEN YOU BECOME LEGALLY BOUND BY A CONTRACT WITH US

By registering on our Service, you enter a legal contract with us.

Accessing any part of our Service that does not require registration/payment also binds you to these terms, to the extent relevant.

If booking for someone else, you ensure they comply with these terms and are responsible if they don’t.

6. No consumer legal right to cancel (“cooling off”)

IN SHORT: THE CONSUMER RIGHT TO CANCEL WITHIN 14 DAYS DOES NOT APPLY

Our Service involves digital content (e.g., streaming videos / downloadable PDFs) which begins before the end of the cancellation period with your agreement, and so you lose the right to cancel.

7. Changing these terms and conditions

IN SHORT: WE CAN CHANGE THESE TERMS BUT YOU MAY HAVE CERTAIN OPTIONS IF YOU DISAGREE

We may change these terms at any time, giving reasonable notice by posting on our website and/or emailing you.

If you disagree with significant changes, you can email us to end the contract before the new terms take effect.

8. Your right to use our Service

THIS SECTION SETS OUT CERTAIN LIMITS ON YOUR RIGHT TO USE OUR SERVICE

We grant a limited personal non-transferable right to use our Service on devices you own or control.

Our Service is intended for personal non-commercial use. Professionals must not use it without prior written agreement.

You must comply with third-party terms when using our Service.

You must be 18 years or over to register or use our Service.

You should back up your Content; we are not liable for avoidable loss.

12. Other peoples’ services / advertising / websites

We may display third-party services, advertising, and/or links. We are not responsible for them; you use them at your own risk.

13. If you create an account on our Service

IN SHORT: YOU ARE RESPONSIBLE FOR YOUR ACCOUNT AND MUST KEEP IT CONFIDENTIAL

Accounts are personal, non-transferable, and must remain confidential. Notify us of any breaches.

14. Paying us

THIS SECTION COVERS YOUR PAYMENT OBLIGATIONS

Payment is in advance on subscription. Prices include VAT unless stated otherwise.

Mispriced Services may be corrected; you can choose to continue at the correct price.

Subscriptions may auto-renew; you can cancel before the next renewal.

You authorise payment providers to charge as due and must keep card info up-to-date.

Any disputes must be reported immediately.

15. Discount codes

THIS SECTION TELLS YOU HOW YOU ARE ALLOWED TO USE DISCOUNT CODES ON OUR SERVICE

Codes are personal, for one-time use, expire after 30 days, and cannot be sold or transferred.

We may suspend or cancel codes or purchases if used fraudulently or in breach of terms.

Codes are subject to additional terms issued at the point of issue.

16. Support

THIS SECTION SETS OUT THE AMBIT OF OUR SUPPORT SERVICE, IF APPLICABLE

Support is optional and provided as specified.

It is intended only to address configuration, proper use, or errors in the Service.

Support is usually via email, 9am–5pm UK business days. We may change or withdraw support at any time.

17. Ending or suspending this contract

THIS SECTION TELLS YOU WHEN THIS CONTRACT CAN END OR BE SUSPENDED AND WHAT HAPPENS

The contract ends when your subscription finishes or if you email to cancel (refund depends on Consumer rights).

We may suspend or terminate for breach, insolvency, unpaid fees, security, technical, operational reasons, or legal requirements.

On termination, licenses end, Content may be deleted, and surviving clauses continue to apply.

18. If our Service doesn’t work properly

IN SHORT: WE DON’T PROMISE THAT OUR SERVICE WILL BE ERROR-FREE

We do not guarantee uninterrupted or error-free service.

We may suspend the Service for maintenance or technical reasons, giving reasonable notice when possible.

19. Restrictions on our legal responsibility – very important

THIS SECTION LIMITS OUR LEGAL RESPONSIBILITY IN VARIOUS WAYS

Nothing limits liability for death, personal injury, fraud, or other non-excludable liability.

Consumers: liability limited to foreseeable losses; you are responsible for misuse.

Non-consumers: liability excludes indirect, consequential, or special losses. Total liability capped at fees paid in the last 12 months.

You agree to indemnify us against claims from your misuse of the Service.

20. Intellectual property rights (IP)

THIS SECTION CONFIRMS OUR COPYRIGHT AND OTHER IP RIGHTS IN CONTENT

We and our partners own all IP in Content.

You may view Content for personal, non-commercial use.

You must not copy, distribute, or misrepresent ownership of Content without written permission.

21. Your personal information

We process personal data in accordance with our Privacy Policy, which may change.

22. Things we can’t control

IN SHORT: WE AREN’T RESPONSIBLE FOR “ACTS OF GOD”

We are not liable for delays or failures due to circumstances beyond reasonable control (e.g., telecom failures, pandemics).

23. Transferring this contract to someone else

IN SHORT: WE CAN TRANSFER OUR RIGHTS BUT YOU CANNOT WITHOUT PERMISSION

We may transfer rights/duties under this agreement, ensuring your rights are not prejudiced. You cannot transfer without consent.

24. English law and courts

IN SHORT: ENGLISH LAW APPLIES AND ONLY UK COURTS CAN ADJUDICATE ON DISPUTES

English law governs this contract. Consumers retain mandatory local rights.

Notices may be sent by email.

No party is an agent or employee of another unless explicitly stated.

28. Affiliate / Referral Terms

Our products and services may be promoted by approved affiliates through the Awin platform. Participation requires compliance with these terms, Awin Terms & Conditions, and all applicable laws.

Affiliates may only promote Stress Control services using approved marketing materials and links. Other use of our brand/content requires written consent.

Commission payments are handled via Awin. We are not responsible for payments outside the Awin system.

Prohibited affiliate activities include misleading advertising, cookie stuffing, incentivised clicks, spamming, or any method that artificially generates commissions. Breaches may result in removal and forfeiture of commission.

Affiliates must comply with privacy, advertising, and marketing laws, including GDPR and cookie regulations.

Stress Control may suspend, terminate, or amend the affiliate programme or individual participation at any time.

Affiliate Terms are governed by English law, and disputes fall under UK courts.
