1. Program Participation
1.1 To participate in the AWIN affiliate program, affiliates must apply and be approved by AWIN.
1.2 Upon approval, affiliates will receive access to affiliate links, banners, and other promotional materials.
1.3 Affiliates agree to comply with AWIN’s platform guidelines and the specific terms set by the advertiser.
2. Tracking and Reporting
2.1 The advertiser will provide tracking codes (such as tracking pixels, links, or cookies) that must be placed on the affiliate’s site for correct tracking of referred traffic and sales.
2.2 Affiliates must ensure that tracking tools are implemented correctly and in accordance with AWIN’s guidelines.
2.3 Sales, clicks, and conversions will be tracked and reported in the AWIN dashboard. The affiliate agrees to review the reports regularly to ensure accuracy.
3. Commission Structure
3.1 Affiliates will be compensated based on the commission structure agreed upon between the advertiser and the affiliate.
3.2 Commission rates may vary depending on the type of products or services promoted.
3.3 Commissions will be paid after the customer’s purchase is confirmed and cleared for payment, in accordance with AWIN’s payment cycle.
4. Payment Terms
4.1 Payment will be made through AWIN after the sale has been confirmed, and once the commission meets the minimum payout threshold.
4.2 Payments will be made on a monthly basis, depending on the affiliate’s commission earnings.
4.3 Affiliates are responsible for providing accurate payment details, and AWIN is not responsible for any delays due to incorrect payment information.
5. Affiliate Obligations
5.1 Affiliates must promote the advertiser's products or services in a manner that is legal, ethical, and compliant with local laws and regulations.
5.2 Affiliates are prohibited from using deceptive or misleading marketing practices, including but not limited to false advertising, spamming, or bidding on the advertiser’s brand name in paid search engines.
5.3 Affiliates must disclose their relationship with the advertiser where applicable (e.g., in blog posts or social media).
6. Termination of Participation
6.1 Either the advertiser or affiliate may terminate participation in the program at any time, with or without notice.
6.2 AWIN reserves the right to terminate or suspend an affiliate’s participation in the program if they violate these terms or engage in fraudulent activity.
6.3 Upon termination, any outstanding commissions will be paid in accordance with the payment terms, provided the necessary conditions for payment are met.
7. Dispute Resolution
7.1 Any disputes arising from participation in the AWIN affiliate program shall be resolved through good faith negotiation.
7.2 In the event of a dispute that cannot be resolved amicably, the parties agree to submit the matter to binding arbitration, in accordance with AWIN’s arbitration policy.
8. Modifications to Terms
8.1 AWIN reserves the right to modify these terms at any time. Affiliates will be notified of significant changes, and continued participation in the program will be deemed acceptance of the updated terms.
8.2 If affiliates do not agree with the modified terms, they can withdraw from the program.
9. Confidentiality
9.1 Both parties agree to keep all program details, including affiliate earnings, commission rates, and other sensitive data, confidential and not share them with third parties without prior consent.
9.2 This confidentiality clause remains in effect even after the termination of the affiliate program.
10. Limitation of Liability
10.1 AWIN, the advertiser, and the affiliate agree that neither party will be held liable for any indirect, incidental, or consequential damages arising out of the program’s operation or the use of the provided materials and tools.
