These Terms & Conditions (“Terms”) govern participation in the Pupper Crust Affiliate Program (“Program”) operated by pupper crust, LLC (“pupper crust,” “we,” “us,” “our”). By applying to or participating in the Program through AWIN, you (“Affiliate,” “you,” or “your”) agree to these Terms in full.
1. Eligibility & Approval
The Program is open to U.S.-based affiliates only.
Participation is subject to our approval. We may accept or reject any application at our sole discretion.
The following are not eligible to participate:
Coupon or deal aggregator sites
Websites or accounts containing adult, offensive, or otherwise inappropriate content
Affiliates engaging in pay-per-click bidding on “pupper crust,” misspellings, or related trademarks
2. Commission Structure
Subscription Box Sales: $20 one-time flat commission per first-time subscription box sale. No commissions on renewals.
Individual Product Sales: 8% of the sale price.
Tiered Commissions: At our discretion, we may offer higher rates to high-performing affiliates.
Exclusions: No commissions on self-purchases, fraudulent transactions, or refunded orders.
3. Tracking & Payment
Sales are tracked via AWIN’s platform. AWIN’s reporting is the sole and final source for determining commissions.
Commissions are paid according to AWIN’s payment schedule and subject to their policies.
If an order is refunded, the corresponding commission will be deducted from future payments.
4. Brand Assets & Usage Guidelines
“pupper crust” must always appear in lowercase.
No modifications to the logo are permitted.
You may use our product images, videos, and other creative assets provided through AWIN’s creative library or by us directly.
You may not:
Run paid ads bidding on “pupper crust,” brand misspellings, or related trademarks
Misrepresent yourself as an official representative of pupper crust
5. Compliance with Laws
You must comply with all applicable marketing and advertising laws, including the U.S. Federal Trade Commission (FTC) Endorsement Guides.
All promotional content must include a clear and conspicuous disclosure that you receive compensation for purchases made through your affiliate links (e.g., “This post contains affiliate links. I may earn a commission if you purchase through my link.”).
You are solely responsible for any legal, regulatory, or governmental action resulting from your failure to comply.
6. Prohibited Conduct
You may not:
Engage in spamming (email, social media, forums, or otherwise)
Make false, misleading, or unsubstantiated claims about our products, including health-related claims for dogs
Publish disparaging or defamatory statements about pupper crust
Use our affiliate links in any context that damages our reputation or violates these Terms
7. Placement Disclosure
Upon request, you must:
Provide us with a list of all locations where our affiliate links appear (including URLs, social media accounts, email campaigns, or other media)
Grant us access to any placements behind paywalls, in private groups, or in members-only areas
8. Termination
We may terminate your participation immediately, with or without cause, at our sole discretion.
If terminated for violation of these Terms, you forfeit all unpaid commissions.
Affiliates may appeal a termination in writing within 7 days. Our decision on appeal is final.
9. Liability & Indemnification
You are solely responsible for the content you create.
You agree to indemnify and hold harmless pupper crust from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:
Your breach of these Terms
Your violation of any laws or regulations
Any claims (including health claims) you make about our products
10. Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any dispute or claim arising out of or relating to these Terms shall be resolved by binding arbitration in Texas, administered by [Arbitration Provider], except that either party may bring an action in small claims court.
The prevailing party in any dispute shall be entitled to recover reasonable attorneys’ fees and costs.
11. Changes to Terms
We may update or modify these Terms at any time. Continued participation in the Program after changes are posted constitutes acceptance of the revised Terms.
By participating in the Pupper Crust AWIN Affiliate Program, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
