Terms and Conditions

The following terms of participation for the journaway partner program apply in addition to the general terms and conditions of the affiliate network Awin.

 

Rights and Obligations of the Partner

  1. 1. The partner may only integrate the advertising materials into their partner websites. The partner is expressly prohibited from combining the provided links with other advertising formats (e.g. in newsletters or on social media), or from modifying the advertising materials in any way.

2. The partner is solely responsible for the content and operation of their partner website and agrees not to publish any content during the course of this partnership that violates applicable law, public morals, or third-party rights, or that could damage our reputation. We are entitled, but not obliged, to review the partner websites. The partner is especially prohibited from distributing or linking to content that:

  • - promotes racism,
  • - glorifies violence or extremism of any kind,
  • - incites or encourages criminal acts or legal violations, including threats against life, physical integrity or property,
  • - attacks individuals or companies,
  • - includes defamatory, libelous, or personally abusive statements or violates competition law,
  • - infringes copyrights or other intellectual property rights,
  • - constitutes sexual harassment of users or third parties.

3. Such content must not be hosted on the partner website, nor may the site link to such content elsewhere.

4. Any form of abuse is prohibited – in particular, generating leads and/or sales through dishonest or impermissible methods that violate applicable law or these terms. The partner is especially prohibited from attempting, either personally or via third parties, to generate or assign leads and/or sales using methods such as:

  • - Fabricating leads or sales that did not actually occur, e.g. using false, third-party or non-existent data during orders,
  • - Using advertising methods that enable tracking but do not properly or visibly display the advertising material in the prescribed form or size,
  • - Cookie dropping: cookies may only be set if the user has actively and knowingly clicked on the advertising material,
  • - Other forms of affiliate fraud (e.g. cookie spamming, forced clicks, affiliate hopping), including use of layers, add-ons, iframes or postview technology to manipulate results,
  • - Using legally protected terms (especially trademarks) in search engines, advertising or promoting the partner site, without our prior written consent. The partner may not create websites that could be mistaken for journaway or its services, copy our website, landing pages or other elements, or give the impression that they are operating as an official project of journaway. Any use of our content, logos or trademarks requires our prior written approval.

5. The partner agrees to operate their website in accordance with applicable law and must provide a proper legal notice (imprint).

6. Email marketing that includes advertising materials or promotes journaway in any form is only permitted with our prior approval and if all recipients have expressly consented to receive marketing emails and have confirmed their address via a documented double opt-in process.

7. The partner must immediately remove advertising materials from their site upon our request. This also applies to any sites on which we no longer wish our content to be shown, for any reason.

8. The partner must refrain from suggesting any official connection between their platform and journaway or its products. This includes using context-based ads (e.g. Google Ads, AdSense) that contain our brand name, company terms or product names, or ads that target those keywords.

9. The partner must refrain from any kind of electronic attacks on our tracking system or websites. These include attempts to bypass or disable security systems, using scripts or tools to extract data, or spreading malware (viruses, worms, trojans), brute force attacks, spam, or other harmful technologies.

 

Commission

1. The partner will receive a performance-based commission for valid sales that are completed on our website as a result of partner leads.

2. The right to receive commission only arises if the following conditions are met:

 - A sale by an end customer has resulted directly from the partner’s promotional efforts,

- The sale has been properly tracked by journaway,

- The sale has been confirmed and approved by us

- No abuse as defined in Section 3 (Rights and Obligations) of these terms has occurred.

3. A sale is defined as a completed and paid booking made by an end customer on our website. Cancellations of any kind do not count as a sale.

4. A sale will be confirmed once the customer has departed and the travel services included in the sale have been fully delivered.

5. Orders placed by the partner or their immediate family members are not commissionable.

6. Orders originating from websites or placements for which journaway has requested the removal of advertising materials are not commissionable from the moment the request is made.

7. Whether a sale can be attributed to a partner lead is determined solely by our tracking system. Unless otherwise specified in the program or campaign, the "Last Cookie Wins" principle applies, with a cookie duration of 60 days. journaway is not liable for commission payments if tracking fails or malfunctions and sales cannot be clearly assigned to a partner.

8. The commission rate is based on the rate applicable at the time of the sale as defined in the relevant campaign.

- For bookings made directly on journaway.com, the commission is 6% of the net sale value.

9. All commission rates are stated as net amounts and will be paid plus applicable VAT.

10. Bookings made using external or exclusive voucher codes that are not directly and publicly visible on the advertiser's website are not eligible for commission.

(11) Bookings from exclusive deal offers – such as a “2for1 Deal” – are excluded from the regular commission. These offers are clearly marked as such on the advertiser’s website and will be remunerated with a reduced commission rate of 3%.
