Terms and Conditions (T&Cs) for Participation in the Affiliate Program of Barça Mobile 

 

1. Scope

These T&Cs apply to all publishers/partners (hereinafter: “Partners”) participating in the affiliate program of Barça Mobile.

By registering in the Awin network and applying to the affiliate program, the Partner expressly accepts these T&Cs.
 

2. Obligations of the Partner

The Partner is solely responsible for the content and technical functionality of their website, social media channels, or other advertising spaces, and

must ensure that these always comply with all applicable laws.

The Partner must be of legal age and provide truthful, up-to-date information during the registration process.

The Partner guarantees that their content does not infringe the rights of third parties (in particular copyright, trademark, or personality rights).

The use of the provided advertising materials is permitted exclusively within the framework of the affiliate program.

Any misuse of affiliate links must be reported to Barça Mobile without delay.
 

3. Requirements for Partner Channels

The Partner guarantees that their channels do not contain or link to unlawful, violent, discriminatory, harmful-to-minors, or erotic content.

The following are specifically not permitted:

Websites without a valid legal notice or under construction.

Content that is unlawful, discriminatory, glorifies violence, harmful to minors, pornographic, or religiously offensive.

Content that promotes drugs, weapons, or illegal downloads.

Paid-mail or spam mailings, as well as email marketing that does not comply with GDPR.

Sub-affiliate networks, banner networks, or comparable meta models (unless expressly approved in writing in advance).

 

Brand bidding for:

“Barça Mobile,” “FC Barcelona,” “Barça eSIM,” as well as all variations, misspellings, and similar expressions.

Competitor brands of other eSIM and telecommunications providers.

Direct linking to Barça Mobile’s official domains in the context of search engine marketing.

Brand terms must be added as negative keywords in search engine campaigns.

 

The Partner may only use vouchers, discount campaigns, or promotions that have been expressly approved by Barça Mobile.

The use of third-party vouchers will result in cancellation of sales.

The use of cashback systems, browser plugins, or extensions that pass commissions on to end customers is not permitted (exceptions only with prior written consent).
 

4. Advertising Materials

Only advertising materials (banners, logos, text links) made available via Awin may be used.

All provided advertising materials (banners, logos, texts, links) are protected by copyright.

Layers, pop-ups, pop-unders, forced clicks, or cookie dropping are prohibited.

Editing, reproduction, or any other use of advertising materials outside the program is not permitted.

Any manipulation of the advertising materials will lead to immediate exclusion from the program and may result in claims for damages.

A product feed provided by Barça Mobile may only be used on the Partner’s own website.

Publication on third-party platforms (e.g., Google Shopping, price comparison sites) is not permitted.
 

5. Commission

Commissions are only paid for valid, confirmed, and non-cancelled eSIM orders.

Self-sales and orders placed by employees, relatives, or affiliated companies are not eligible for commission.

Barça Mobile reserves the right to withhold or reclaim commissions in cases of violations or suspected fraud.

The commission rates as well as any special promotions will be published in the Awin program profile.

 

6. Tracking and Attribution

The click-based tracking window of the program is 30 days: sales completed within 30 days of a valid click on an affiliate link will be attributed to the corresponding affiliate.

Attribution between eligible affiliates follows a last-click model.

View-through tracking (impression-based) does not apply unless expressly authorized in advance in writing by Barça Mobile; where enabled, the applicable window will be communicated in the program profile.

Self-purchases and purchases by employees, agents, or related parties, as well as any form of self-referral or fraud, are excluded from attribution and commission.
 

7. Validation and Cancellations

Barça Mobile validates transactions before commission approval. The standard validation period is up to 30 days from the order date; Barça Mobile may reasonably extend this period in cases of suspected abuse, fraud, or during peak trading periods, with notice via the Awin advertiser profile or partner messaging.

Sales that are cancelled, refunded, charged back, unpaid, or otherwise invalid (including orders arising from policy violations) will not be commissioned or will be reversed if previously credited.

Commissions are calculated on the net value of the qualifying order, excluding VAT/sales taxes, fees, shipping/handling, gift cards, discounts, and any non‑product charges or third‑party costs.

Barça Mobile reserves the right to withhold or claw back commissions for invalid, duplicate, or fraudulent transactions.

 

8. Termination for Convenience

Either party may terminate the Partner’s participation in the program for convenience at any time upon 14 days’ written notice (including via Awin platform messaging).

Termination for cause remains available at any time, including in the event of policy violations, fraud, or brand misuse.

 

9. Cessation of Trademark Use upon Termination

Upon termination for any reason, the Partner must immediately cease using Barça Mobile’s brands, trademarks, logos, and creative assets; remove all links, banners, and promotional materials within

48 hours; and stop bidding on brand terms.

Any license or permission to use Barça Mobile intellectual property granted under these T&Cs automatically terminates upon termination of participation, without the need for separate notice.

The Partner must promptly delete any stored Barça Mobile assets and materials, except where retention is required by law.

 

10. Sanctions

In case of breach of these T&Cs (including brand bidding, policy violations, fraud or misuse of assets), Barça Mobile may, at its reasonable discretion:

Suspend or terminate the Partner’s participation from the program with immediate effect,withhold, reverse, or claw back commissions related to affected transactions,

Apply a reasonable contractual penalty up to EUR 5,000 proportionate to the severity and impact of the breach, where lawful and appropriate.

The above remedies are cumulative and without prejudice to any other rights or remedies available.
 

11. Final Provisions

Changes to these T&Cs must be made in writing and will be communicated via the Awin partner account.

Should any provision of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.

Spanish law shall apply exclusively. The place of jurisdiction, where legally permissible, is Barcelona (Spain).

Affiliates with individual commission agreements are excluded from standard promotions.

Double registrations across multiple networks are not permitted; participation is only possible via Awin.
 

DATA PROTECTION & USE OF PERSONAL INFORMATION

DATA CONTROLLER: NEW ERA, with registered office at Carrer de Bailèn 105, 08009 Barcelona, Spain, and Tax ID B-70792197.

PURPOSE, LEGAL BASIS AND RETENTION PERIOD: By participating, personal data will be used for the following:

  • Registration & marketing consent: Data will be processed to manage registration (if not already registered) and to send marketing communications from NEW ERA and/or related entities (e.g., merchandising, ticketing, digital services), only with express consent.
  • Giveaway participation: Data will be processed throughout the duration of the promotion and, if the participant wins, for as long as necessary to manage prize logistics and legal obligations.

DATA SHARING: Personal data will not be shared with third parties unless required to manage the prize (e.g., travel, hotel bookings), or with NEW ERA service providers acting on its behalf who will not use the data for their own purposes. Some providers may be located outside the EU.


INTERNATIONAL DATA TRANSFERS: In cases where NEW ERA works with providers outside the EU, it ensures appropriate safeguards (e.g., standard contractual clauses, certifications).
 

EXERCISING RIGHTS: Participants may exercise their rights of access, rectification, deletion, objection, limitation or portability by writing to Carrer de Bailèn 105, 08009 Barcelona, or by emailing: dpo@barcamobile.com.
