TabCouchCaddy Affiliate Program Terms & Conditions

1. Eligibility and Participation
The Program is open to individuals and organizations 18 years of age or older. By applying or participating, you (“Affiliate”) confirm that you have the legal authority to enter into this Agreement and will comply with all applicable laws and regulations. TabCouchCaddy reserves the right to approve, reject, or remove any Affiliate at its discretion, with or without cause.
2. Promotion Guidelines
Affiliates may promote TabCouchCaddy products through approved websites, blogs, newsletters, and social media accounts. All email marketing must comply with applicable anti-spam laws, including CAN-SPAM (U.S.) and CASL (Canada). Emails must include accurate sender information, a clear unsubscribe option, and must not mislead recipients. Affiliates may not represent themselves as TabCouchCaddy. Only authorized discount codes may be promoted; expired or unofficial coupon codes are prohibited.
3. Paid Search & Trademark Restrictions
Affiliates may not bid on or purchase keywords containing “TabCouchCaddy,” “TabCouch,” “CouchCaddy,” or any misspellings or variations. Paid advertising that links directly to www.tabcouchcaddy.com or any of its product pages is prohibited. Promotions must not imply official endorsement or create confusion regarding affiliation with TabCouchCaddy.
4. Content Standards
Affiliates may not post or share content that is defamatory, explicit, violent, discriminatory, or promotes illegal activity. All promotions must follow FTC Endorsement Guidelines and clearly disclose any paid or affiliate relationship. Affiliates must ensure product descriptions, pricing, and promotions remain accurate and up to date.
5. Compliance
Affiliates are responsible for ensuring their promotional activities comply with all federal, state, and local advertising laws, data privacy regulations, and the terms of the platforms they use (e.g., Meta, TikTok, YouTube, Google).
6. Commissions and Tracking
Affiliates earn a 15% commission on valid sales generated through approved affiliate links to www.tabcouchcaddy.com. The cookie duration is 30 days and the validation period is 35 days. Fraudulent, duplicate, canceled, or self-referred transactions are not eligible for commission. TabCouchCaddy reserves the right to withhold or reverse commissions for any policy violations or refunded orders. Approved commissions are paid promptly following the validation period via supported payment methods (e.g., PayPal, Debit, or Credit).
7. Limitation of Liability
To the fullest extent permitted by law, TabCouchCaddy, its owners, and employees shall not be liable for any indirect, incidental, consequential, or special damages arising from participation in this Program. Total liability shall not exceed the commissions paid to the Affiliate within the three (3) months preceding the claim.
8. Indemnification
Affiliate agrees to indemnify and hold harmless TabCouchCaddy, its employees, and partners from any claims, damages, or expenses (including legal fees) arising from Affiliate’s breach of this Agreement, violation of applicable laws, or promotional activities.
9. Term and Termination
Either party may terminate participation in the Program at any time, with or without cause. Upon termination, the Affiliate must remove all tracking links, creative assets, and brand mentions related to TabCouchCaddy within five (5) business days.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Florida.
