HELLO LOVE AFFILIATE MARKETING AGREEMENT
This Agreement is made between Hello Love Inc. (“Hello Love,” “we,” “us”) and the undersigned (“Affiliate,” “you”). By submitting an Affiliate Enrollment Application, you acknowledge that you have read this Agreement and agree to all its terms and conditions.
1. AFFILIATE RESPONSIBILITIES
● Promote Hello Love using the link we provide. It is your responsibility to ensure that your link is working properly and accurately tracking customer orders.
2. HELLO LOVE’S RESPONSIBILITIES
● Provide Affiliate link.
● Handle all order processing, shipping, customer service, and payments. ● Track Affiliate sales and commissions.
3. COMMISSION & PAYMENT
● You will earn an agreed-upon commission amount on qualifying customer purchases (excluding shipping, tax, and discounts).
● We may adjust the commission rate with 7 days’ notice. All notifications will be sent to the email address you provided on your Affiliate application.
● Overpayments must be returned.
4. RESTRICTIONS
You may not:
● Impersonate Hello Love or misrepresent your relationship with us.
● Use our name, trademarks, or slogans in domains, ads, or misleading ways. ● Sell Hello Love products on any other website or using any other sales channel. ● Offer Hello Love products for a price other than the current selling price on helloloveinc.com.
● Post your link on Hello Love’s official social channels.
● Copy or mimic our website design or branding.
● Contact customers gained via your Affiliate link for any reason, other than those outlined in the Privacy Policy on the Company website.
5. USE OF MATERIALS
● You may use approved Hello Love logos and content as provided. Do not alter our branding or use it in a harmful, misleading, or unapproved way.
● You acknowledge and agree that any and all content created, developed, or posted by you in connection with services performed for Hello Love, including but not limited to text, images, videos, and other media “Content”, shall be deemed work made for hire and shall be the sole and exclusive property of Hello Love. The right to such Content survives the termination or expiration of this agreement.
6. PRIVACY
We collect and use your information to manage the Affiliate program and contact you. You can request to update or delete your information anytime by reaching out to support@helloloveinc.com.
7. TERM & TERMINATION
● This Agreement starts on the date of application approval and renews automatically every year.
● Either party may terminate at any time, for any reason. To terminate your Affiliate account, please send an email to megan@helloloveinc.com.
● Upon confirmation of termination, you must stop using Hello Love links, branding, and materials. Customer orders placed after confirmation of termination, will not be paid.
8. LEGAL TERMS
● You are an independent contractor. You are not an employee of Hello Love. ● You are responsible for your taxes and legal obligations.
● Hello Love is not liable for damages, losses, or website issues related to your Affiliate activity.
● Any disputes will be governed by the laws of California and handled in Orange County.
9. GENERAL
● We may update this Agreement with notice to you. Any changes to this Agreement will be emailed to the email address you provided on your Affiliate application. If any changes to the Agreement are unacceptable to you, you may choose to terminate your Affiliate account. Your continued participation in the Affiliate program following the notification of a change will signify your acceptance of the change.
● You agree to keep any non-public information confidential.
● You confirm that you are over 18 and have the legal right to enter this Agreement.
