Hairburst Affiliate Program Terms & Conditions
1. Acceptance of Terms
By applying to and/or participating in the Hairburst Affiliate Program, you (“Affiliate,” “Partner,” or “you”) agree to be bound by these Terms & Conditions, as well as the AWIN Network Agreement. If you do not agree, you may not participate in the Program.
2. Eligibility
You must be at least 18 years of age.
You must have a valid AWIN account in good standing.
Content creators, influencers, publishers, and other promoters are welcome provided their channels (websites, social media, newsletters, etc.) comply with applicable laws and these Terms.
We reserve the right to reject or remove any applicant at our sole discretion.
3. Program Participation
Affiliates promote Hairburst products and brand through unique AWIN tracking links or other approved methods.
Affiliates must not make false, misleading, or unapproved claims about Hairburst products.
All promotions must be in line with our brand guidelines and any regional legal requirements, including health, wellness, and cosmetic marketing regulations.
4. Commissions & Payments
Commission rates are set within the AWIN platform and may vary by campaign, product category, or geography.
Commissions are tracked and managed through AWIN and paid according to AWIN’s payment schedule.
Commissions are only payable on valid, completed sales (excluding cancellations, returns, chargebacks, or fraudulent activity).
5. Restrictions
Affiliates agree not to:
Use paid search ads that bid on Hairburst brand terms, misspellings, or close variations.
Operate websites or social channels containing offensive, discriminatory, or unlawful content.
Send unsolicited commercial emails (“spam”).
Misrepresent themselves as Hairburst or suggest they are an official representative.
Use coupon/discount sites unless expressly approved in writing.
Offer cashback, incentives, or rebates without prior approval.
6. Content & Brand Usage
Affiliates may use Hairburst logos, banners, product images, and text materials made available through AWIN or provided directly by Hairburst.
Any other use of Hairburst intellectual property (brand name, product photography, videos, etc.) requires prior written approval.
Affiliates must clearly disclose their relationship with Hairburst in accordance with applicable advertising disclosure laws (e.g., FTC guidelines in the US, ASA rules in the UK, or EU influencer disclosure requirements).
7. Compliance with Laws
Affiliates are solely responsible for ensuring compliance with:
Local advertising, consumer, and data protection laws (including GDPR in the EU).
AWIN’s policies.
Any relevant health and cosmetic product marketing restrictions in their market.
8. Term & Termination
This Agreement will remain in effect until terminated by either party.
Hairburst may terminate participation immediately if an Affiliate breaches these Terms, engages in fraudulent activity, or damages Hairburst’s brand reputation.
Affiliates may terminate participation at any time by removing Hairburst links and content.
9. Liability & Indemnification
Hairburst shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program.
Affiliates agree to indemnify and hold Hairburst harmless against any claims, damages, or liabilities arising from their participation, including non-compliance with applicable laws.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to Terms
Hairburst reserves the right to update, modify, or replace these Terms at any time. Affiliates will be notified of material changes via AWIN or email. Continued participation in the Program after such changes constitutes acceptance.
12. Promotional Products and Materials
From time to time, Hairburst may provide Affiliates with promotional products, samples, or materials for the purposes of review, promotion, or content creation.
Affiliates acknowledge and agree that:
Any products or materials provided remain the property of Hairburst until incorporated into agreed promotional activity.
Receipt of products does not entitle the Affiliate to keep such products without undertaking the agreed promotional obligations.
If an Affiliate receives products but fails to publish, share, or otherwise promote them in accordance with agreed campaign requirements or within the specified timeframe, Hairburst reserves the right to:
(i) require the return of such products at the Affiliate’s expense; and/or
(ii) withhold commissions or terminate participation in the Program.
Affiliates may not request, solicit, or accept promotional products from Hairburst under false pretenses or without genuine intent to promote.
