BEAMS America Affiliate Program – Terms & Conditions
 

Welcome to the BEAMS America Affiliate Program (the “Program”). These Terms and Conditions (the “Terms”) govern the participation of creators, publishers and platforms (each, an “Affiliate”) in the Program, which are designed to promote fair, transparent and brand-aligned affiliate practices. By applying to and participating in our Program, you agree to be bound by the Terms outlined below.

Affiliate Benefits

Subject to the terms and conditions herein, approved Affiliates will receive access to:

• Official BEAMS America creative assets and tracking links
• Brand and editorial guidelines and requirements for aligned storytelling
• Priority consideration for seasonal campaigns, limited-edition launches, and elevated exposure opportunities
• Direct support from our affiliate management team

Commission Structure

[BEAMS America utilizes the Awin Affiliate Marketing platform to manage the Program. Affiliates may be subject to additional terms and conditions, including privacy policies, in connection with their use of the Awin platform.]

Standard commission rates are visible in your Awin dashboard and may vary based on:

• Publisher type (e.g., content, loyalty, editorial)
• Customer type (new vs. returning)
• Basket value or product category
• Promotional campaigns or special events

We reserve the right to update rates with advance written notice in accordance with Awin's platform policy.

Validation & Returns

Sales can be validated only after the order has been fulfilled and has passed the standard return period.

Commissions may be declined or reversed in cases of:

• Returned or cancelled orders
• Duplicate or out of stock orders
• Fraudulent or self-referral activity
• Duplicate tracking or technical manipulation

Voucher and Promotional Code Policy

Only voucher and promotional codes distributed through BEAMS America's official Awin channels (My Offers or Communication Centre) are eligible for commission.

Unauthorized or expired codes are not permitted and may result in commission reversal or removal from the Program.

Cookie Period

Our standard cookie duration is 30 days.

Paid Search (Pay-Per-Click) Policy

The following requirements apply to all Affiliates engaging in paid search activity:

• Bidding on BEAMS-branded terms (including, but not limited to,, "BEAMS," "BEAMS America", or misspellings and variations thereof) is strictly prohibited.
• Use of BEAMS brand name (or variations thereof) in ad copy, display URLs, destination URLs, or meta data is not allowed without prior written approval from us.
• Affiliates must proactively add BEAMS-branded terms (and variations thereof) to their negative keyword lists across all paid search campaigns.
• Generic keyword targeting may be permitted upon review and written approval by us.
• Cloaking, URL hijacking, or use of deceptive redirect techniques that misrepresent the Affiliate’s identity or purpose are strictly prohibited.
• Affiliates are responsible for the actions of any third-party vendors or agencies they employ for any paid search activity.

We reserve the right to monitor paid search campaigns for compliance with this policy at any time. Violations of this policy may result in immediate suspension or removal from the Program, forfeiture of commissions, and potential legal action.

Compliance & Content Standards

Affiliates must at all times during their participation in the Program comply with all applicable laws, regulations, guidelines and policies, including, but not limited to:

• Applicable consumer protection and advertising laws
• FTC Endorsement Guidelines, and other similar affiliate disclosure rules
• CAN-SPAM, and other similar regulations related to email, SMS and direct marketing
• GDPR, CCPA, and other similar applicable data privacy laws and regulations
• Awin's Network Policies, and any terms and advertising policies of other platforms utilized during Affiliate’s participation in the Program

We prohibit promotion by our Affiliates on websites or media containing adult content, hate speech, and deceptive messaging.  Additionally, our Affiliates are prohibited from promoting on websites that use our trademarks, logos or other brand elements without our permission, or in any misleading or unauthorized way.

Protection of BEAMS America’s Intellectual Property
 

All trademarks, service marks, trade names, logos, copyrights, product images, designs, and other intellectual property or proprietary materials (collectively, “BEAMS IP”) associated with BEAMS America are and shall remain the sole and exclusive property of BEAMS America. Nothing in these Terms grants or conveys to any Affiliate any right, title, or interest in or to the BEAMS IP, except for the limited license expressly set forth below. BEAMS America reserves all rights not expressly granted herein.

• Limited License: Subject to full compliance with these Terms and any applicable brand guidelines, BEAMS America grants you a limited, non-exclusive, non-transferable, revocable license to use approved BEAMS IP solely for the purpose of promoting authorized BEAMS America products and services under the Program. This license is granted only for the duration of your active participation in the Program and solely for use in approved promotional materials. Nothing in these Terms shall be construed as granting any ownership or proprietary rights in BEAMS IP to any Affiliate. All goodwill generated from an Affiliate’s use of the BEAMS IP shall inure solely to the benefit of BEAMS America.
• Prohibited Uses: As an Affiliate, you may not: (i) use BEAMS IP in any way other than as permitted under these Terms, (ii) modify, copy, imitate or create derivative works of the BEAMS IP, (iii) use BEAMS IP in any domain name, social media handle, display URL or meta tags, or (iv) use BEAMS IP in connection with any third-party marks without our express written consent, (v) represent that you are engaged in an official partnership with us without our express written consent, or use confusingly similar words, images or designs that may mislead consumers into believing there is an official partnership, sponsorship or endorsement by us.

We reserve the right to monitor your use of BEAMS IP at any time to ensure compliance with these Terms.

Any unauthorized use of BEAMS IP may result in immediate termination of your participation in the Program, removal from all associated promotional privileges, and forfeiture of accrued but unpaid commissions. Legal action may be taken in cases of willful infringement or brand harm.
 

Consequences for Breach of these Terms

BEAMS America reserves the right to take any of the following actions, in our sole discretion in response to violations of these Terms:

• Commission reversal or forfeiture
• Temporary suspension from the Program
• Permanent removal from the Program
• Other available legal action
