A Bathing Ape (BAPE) Affiliate Program Terms & Conditions
By participating in the A Bathing Ape (BAPE) Affiliate Program (the "Program"), you ("Affiliate," "You," or "Your") agree to comply with the following Terms and Conditions ("Terms"). These Terms govern your relationship with A Bathing Ape ("BAPE," "We," "Us," or "Our"). Please read them carefully before applying.
1. Program Enrolment & Eligibility
You must submit an application and be approved by BAPE before promoting our products.
We reserve the right to reject or terminate any Affiliate for any reason, including but not limited to inappropriate content, fraudulent activity, or brand misalignment.
You must be at least 18 years old to participate.
Affiliates must align with BAPE’s brand image—streetwear, fashion, sneakers, and urban culture.
2. Affiliate Responsibilities
You agree to promote BAPE ethically and in compliance with all applicable laws (including FTC disclosure requirements).
Clear disclosure of affiliate links is mandatory (e.g., "This post contains affiliate links").
You may not engage in deceptive practices (e.g., false advertising, trademark misuse, cookie stuffing, or spam).
Bidding on BAPE-branded keywords (e.g., "BAPE discount," "BAPE promo code") in paid ads requires prior written approval.
No pop-ups, forced redirects, or intrusive ad methods are allowed.
3. Commission Structure
Commissions are earned only on qualifying purchases made through your unique affiliate link.
Returns, cancellations, or fraudulent transactions void commissions.
Commission rates and payment thresholds are subject to change with prior notice.
4. Cookie Duration & Tracking
We use a 3-day cookie window to track referrals.
If a customer clicks your link and purchases within 3 days, you earn commission (unless another affiliate’s link is clicked later).
5. Prohibited Activities
❌ No unauthorized discounts/coupons (only use BAPE-approved promotions).
❌ No trademark bidding (e.g., Google Ads on "BAPE jacket" without permission).
❌ No fake traffic (bot clicks, self-referrals, or incentivized fraud).
❌ No misleading claims (e.g., "Exclusive BAPE collab" if false).
6. Termination
Either party may terminate this agreement at any time, with or without cause.
Upon termination, you must remove all BAPE affiliate links and branding.
Unpaid commissions may be forfeited if earned fraudulently.
7. Modifications
BAPE reserves the right to modify these Terms at any time. Continued participation means acceptance of updates.
8. Intellectual Property
You may not use BAPE’s logos, trademarks, or branding without prior written approval.
All creatives must be officially provided or approved by BAPE.
9. Limitation of Liability
BAPE is not liable for indirect, incidental, or consequential damages related to the Program.
We do not guarantee uninterrupted or error-free tracking.
10. Governing Law
These Terms are governed by the laws of New York, United States, without regard to conflict of law principles.
