1. Program Overview
Welcome to the Pigment Affiliate Program ("Program"). These Terms and Conditions ("Terms") govern your participation in the Program. By applying to and participating in the Program, you agree to be bound by these Terms.
2. Eligibility and Application
2.1 Application Process
- All potential affiliates must submit a complete application for review
- Applications are reviewed weekly by our affiliate management team
- Approval is at Pigment's sole discretion
- We reserve the right to reject any application without providing specific reasons
2.2 Eligibility Requirements
- You must be at least 18 years of age
- You must have a legitimate website, social media presence, or marketing channel
- You must comply with all applicable laws and regulations
- You must not engage in any prohibited activities as outlined in these Terms
3. Commission Structure and Payment
3.1 Commission Tracking
- Cookie Window: 30 days from initial click
- Commissions are tracked through approved affiliate links only
- Multiple clicks within the cookie window will extend the attribution period
3.2 Validation Period
- Validation Period: 30 days post-purchase
- All sales must be validated before commission payment
- Commissions are subject to review during the validation period
3.3 Commission Rates
We’re offering a tiered commission structure to reward top partners who bring in high-quality traffic and conversions:
Tier 1: 30% commission for the first 100 sales of the month
Tier 2: 40% commission from the 101 sale of the month
- Special promotional rates may be offered for limited periods
4. Refunds and Clawbacks
4.1 Refund Policy
- Commission Cancellation: If a customer refunds their purchase, the associated commission will be canceled
- Clawbacks will be deducted from future commission payments
- If insufficient future commissions exist, you may be required to repay clawed-back amounts
4.2 Chargeback Protection
- Commissions on orders that result in chargebacks will be reversed
- Repeated chargebacks from your referrals may result in program termination
5. Promotion Rules and Guidelines
5.1 Brand Bidding Restrictions
- Prohibited: Bidding on Pigment's trademarked terms, brand name, or variations thereof
- Prohibited: Using Pigment's brand name in paid search campaigns
- Prohibited: Creating misleading ads that imply official Pigment affiliation
5.2 Content Guidelines
- No Misleading Language: All promotional content must be truthful and accurate
- No False Claims: Do not make unauthorized claims about Pigment products or services
- Disclosure Required: Clearly disclose your affiliate relationship with Pigment
5.3 Prohibited Promotion Methods
- Coupon-Only Pages: Sites primarily focused on coupon aggregation without substantial content
- PPC: PPC traffic is prohibited
- Pop-up Spam: Unsolicited pop-up advertisements or intrusive marketing tactics
- Email Spam: Unsolicited commercial emails or violation of CAN-SPAM Act
6. Blacklisted Sources and Prohibited Activities
6.1 Blacklisted Traffic Sources
- Low-Quality Cashback Sites: Sites that provide minimal value beyond cashback offers
- Coupon Farming: Automated coupon testing or invalid coupon generation
- Pop-up Spam Networks: Intrusive advertising networks or malicious software
- Incentivized Traffic: Paid-to-click schemes or artificial traffic generation
6.2 Additional Prohibited Activities
- Click fraud or artificial inflation of metrics
- Cookie stuffing or other deceptive tracking methods
- Trademark infringement or unauthorized use of Pigment branding
- Violation of advertising platform policies (Google, Facebook, etc.)
7. Affiliate Responsibilities
7.1 Compliance
- Maintain compliance with all applicable laws and regulations
- Follow platform-specific advertising policies
- Ensure all promotional content meets quality standards
7.2 Reporting
- Report any suspicious activity or potential violations
- Maintain accurate records of promotional activities
- Cooperate with program audits and investigations
8. Program Management
8.1 Account Management
- Pigment reserves the right to modify or terminate the Program at any time
- Affiliates may be suspended or terminated for violations of these Terms
- Account status and performance metrics are available through the affiliate dashboard
8.2 Communication
- Official communications will be sent through the affiliate platform or registered email
- Program updates and announcements will be posted in the affiliate portal
- Direct communication with the affiliate management team is available for approved affiliates
9. Intellectual Property
9.1 Licensed Materials
- Pigment may provide approved marketing materials for affiliate use
- Use of Pigment's trademarks and copyrighted materials is strictly limited to approved content
- Affiliates may not modify or create derivative works without explicit permission
9.2 Restrictions
- No unauthorized use of Pigment's brand name, logos, or trademarks
- No creation of misleading or unauthorized marketing materials
- All promotional content must comply with brand guidelines
10. Payment Terms

- Commissions are paid monthly following the validation period
11. Termination
11.1 Termination by Pigment
- Pigment may terminate affiliate accounts for violations of these Terms
- Termination may be immediate for serious violations
- Reasons for termination include but are not limited to fraud, spam, or policy violations
11.2 Termination by Affiliate
- Affiliates may terminate their participation at any time
- 30-day notice is recommended for proper account closure
- Outstanding commissions will be paid according to standard payment terms
12. Limitation of Liability
12.1 Disclaimers
- The Program is provided "as is" without warranties
- Pigment is not liable for lost profits or indirect damages
- Affiliate participation is at your own risk
12.2 Indemnification
- Affiliates agree to indemnify Pigment against claims arising from their promotional activities
- This includes violations of these Terms or applicable laws
- Legal fees and damages may be recoverable
13. General Provisions
13.1 Modification of Terms
- These Terms may be updated periodically
- Continued participation constitutes acceptance of modified Terms
- Material changes will be communicated with advance notice
13.2 Governing Law
- These Terms are governed by the laws of the state of New York
- Disputes will be resolved through binding arbitration
- Class action waivers may apply
13.3 Entire Agreement
- These Terms constitute the complete agreement between parties
- Previous agreements or communications are superseded
- Modifications must be in writing and signed by authorized representatives
