Affiliate Program Terms & Conditions
General
These Terms and Conditions (the "Affiliate Agreement") govern the Affiliate Program offered by Kinkly ("we" or "us"). This Affiliate Agreement represents the full agreement and understanding between Kinkly and the individual or entity participating in the Affiliate Program ("Affiliate" or "you").
Please read this agreement carefully as it forms a legally binding contract. By submitting your application and using the Affiliate Program, you agree to comply with all the terms set forth herein. Kinkly may terminate your Affiliate Account at any time, with or without notice, if your conduct breaches this Agreement or is deemed harmful to our business or any third party.
Referral Tracking
Kinkly will provide you with unique Referral Links to track traffic and sales. Our tracking is powered by AWIN, with cookies that last for 30 days. Only purchases made while the cookie is active will qualify for commissions.
You may not modify Referral Links or cookies. Kinkly and AWIN are not liable for errors resulting from unauthorized link modifications.
Affiliate Fees and Payouts
Affiliate commissions are paid monthly. A referral becomes eligible for payout ("Eligible Referral") after a 30-day holding period, provided:
The order is paid in full.
The referred customer’s account is in good standing.
The purchase hasn’t been refunded, charged back, or reversed.
De-duplication is in place: If the transaction is attributed to another channel or affiliate platform, it may not be eligible for commission.
The standard commission structure is:
15% for new customers
10% for existing customers
2% for voucher code sites
3% for cashback sites
Suspicious activity may result in delayed, adjusted, or canceled payouts.
Fraud, Content, and Legal Compliance
Fraud and Abuse: Any fraudulent activity—including self-referrals, cookie stuffing, or use of unauthorized discount codes—will lead to immediate removal from the program and forfeiture of all pending commissions.
Content Guidelines: Affiliates may not promote Kinkly on pages containing illegal, misleading, or hateful content.
FTC Compliance: Affiliates must follow all FTC guidelines and clearly disclose their relationship with Kinkly in any promotional materials.
Tax Responsibility: Affiliates are responsible for reporting and paying any applicable taxes on their commissions.
Advertisements & Creative Assets
Kinkly grants a non-exclusive, non-transferable license to use its logos, banners, and creatives solely for program promotion. These must be used tastefully and in line with Kinkly’s brand.

You are responsible for ensuring your promotional content complies with applicable laws. Kinkly reserves the right to request removal or modification of any promotional material.
Program Exclusions & Restrictions
No use of software/browser extensions is permitted.
SEM: Use of the Kinkly brand name in search engine marketing (e.g., ads) is prohibited.
Termination
You may terminate participation at any time by notifying us via the affiliate platform. Kinkly also reserves the right to terminate your participation for breaching this Agreement or engaging in harmful conduct.
Upon termination, access to the Affiliate Dashboard will be revoked, and unpaid earnings may be forfeited.
Relationship of Parties
Kinkly, AWIN, and the Affiliate are independent contractors. No employment, partnership, or agency relationship is formed.
Limitation of Liability
The Affiliate Program is provided "as is." Kinkly and AWIN are not liable for damages arising from its use. Affiliates agree to indemnify Kinkly and AWIN against any related losses or legal claims.
Modification
Kinkly may modify this Agreement at any time. Continued participation implies acceptance of the revised terms. Updates will be posted in the Affiliate Dashboard.
Miscellaneous
You confirm that you are 18 or older and legally eligible to enter this agreement. You are responsible for complying with all laws relevant to your participation.
This Agreement supersedes any prior agreements between the parties and represents the full understanding of the terms governing your participation in the Kinkly Affiliate Program.
